HomeMy WebLinkAbout18-075RESOLUTION NO. 18-075 A RESOLUTION ALLOWING LINCOLN PARK MAIN STREET, INC., A 501(c)(3) ORGANIZATION, THE USE OF COUNTY OWNED PROPERTY FOR JAZZ ON MOORE'S CREEK; PROVIDING FOR AN EFFECTIVE DATE WHEREAS, Lincoln Park Main Street, Inc., a 501(c)(3), ("Christmas Kids"), has requested the use of space at the Beth Ryder Intermodal Transit Facility, located at 725 Avenue D, Fort Pierce, Florida, and three (3) lots on the northeast corner of the intersection of Avenue D and North 8th Street, Fort Pierce, Florida, (collectively the "Site"), for parking in conjunction with its Jazz on Moore's Creek events; and WHEREAS, Section 125.38, Florida Statutes (2017) requires that any not for profit organization wishing to use any real or personal property that may be owned by any county or this state or by its board of county commissioners, for public or community interest and welfare, may apply to the Board of County Commissioners for a conveyance or lease of such property; and WHEREAS, Section 125.38 further states that if it is determined by the Board of County Commissioners that such property is required for such use and is not needed for County purposes, the Board can allow the use of such property; and WHEREAS, the County desires to make the Site available to Lincoln Park Main Street, Inc., for parking in conjunction with its 2018 Jazz on Moore's Creek events. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of St. Lucie County, Florida: 1. The Board does hereby grant permission to Lincoln Park Main Street, Inc., to use the Site for parking in conjunction with its Jazz on Moore's Creek events. 2. The term of this use shall begin on May 1, 2018 and run through and including May 1, 2019, unless otherwise terminated. After motion and second, the vote on this resolution was as follows: Commissioner Frannie Hutchinson, Chair AYE Commissioner Linda Bartz, Vice Chair AYE Commissioner Chris Dzadovsky AYE Commissioner Anthony Bonna AYE Commissioner Cathy Townsend AYE 1 PASSED AND DULY ADOPTED this lst day of May 2018.
