LUCIE COUNTY, FLORIDA WHEREAS, the Planning and Development Services Director of St. Lucie County, Florida, based on the written request and staff report, has made the following determinations: Melissa Patrick, General Manager of The Lake House, located at 321 Lamont Road, petitioned for a use consistency determination per Section 3.01.02, Administrative Use Regulations for Permitted and Conditional Uses, under the Waiver, Deferral and Alternative provisions (Ordinance 12-003) of the St. Lucie County Land Development Code (LDC). Along with the use consistency determination, alternative site development are required through the provisions of Section 7.06.01.F to allow alternative paving materials for on-site parking and Section 7.09.04 to allow alternative landscaping. 2. The subject property is within the AR -1 (Agricultural, Residential — 1 du/ac) Zoning District and consists of a main building totaling 4,451 square feet and a garage of 1,264 square feet on a second parcel. Both parcels total 28.26 acres as depicted on the attached map as Exhibit "A". 3. The request for use consistency determination has met the provisions identified in LDC Section 3.01.02, Administrative Use Regulations for Permitted and Conditional Uses, and the Standards of Review for rezoning in Section 11.06.03. 4. The request for administrative relief for alternative paving materials has met the provisions for relief set forth in LDC Section 7.06.01. Staff has provided a written analysis that demonstrates the proposed relief is based upon conditions that are unique and peculiar to the site conditions, including but not limited to, an historic structure surrounded by an approximately 20 -acre lake, and is not anticipated to negatively impact the surrounding properties nor the safety of the onsite circulation pattern. 5. Administrative relief for required landscaping has met the provisions for relief set forth in LDC Section 7.09.04.0. Staff has provided a written analysis that demonstrates the proposed relief is based upon conditions that are unique and peculiar to the site conditions and will not affect surrounding property. The Environmental Regulations Manager has reviewed the request for administrative relief from the minimum landscaping requirements and found it to be acceptable. 6. Planning and Development Services Department, Planning Division staff has performed a detailed analysis of the request and determined it to be consistent with the St. Lucie County Land Development Code. The analysis is found in the Planning and Development Services Department Memorandum entitled The Lake House — 321 Lamont Road, WDA -120186246 dated May 9, 2018. PDS Order 18-027 WDA 120186246 Page 1 NOW, THEREFORE, BE IT ORDERED: A. The petition of Melissa Patrick, General Manager of The Lake House, located at 321 Lamont Road, for an administrative relief under the Waiver, Deferral and Alternative provisions (Ordinance 12-003) of the St. Lucie County Land Development Code (LDC) is granted. This PDS Order, under the conditions listed below, shall allow the proposed use per Section 3.01.02, Administrative Use Regulations for Permitted and Conditional Uses, for alternative paving materials for on-site parking per Section 7.06.01.17, and for alternative landscaping per Section 7.09.04.0 of the St. Lucie County Land Development Code. This approval will allow the parking area to be surfaced with crushed shell or concrete, and for the use of existing vegetation to satisfy an alternative landscape pian. The proposed event rental facility will be permitted subject to the following conditions of approval: 1. This approval order does not explicitly authorize or permit alcohol to be served on site. The service or provision of alcoholic beverages on-site and/or during events shall comply with all applicable state and local regulations, and shall further be protected with appropriate liability insurance. 2. This approval order shall not be construed to permit any alcohol to be served on site. Any alcoholic beverages served during events shall be provided by a licensed vendor. 3. This approval order does not permit food service, cooking or food preparation on site. All food service must be provided by a licensed vendor, prepared in a licensed commercial kitchen and brought in from off site. 4. All tents must be approved by the St. Lucie County Fire District in accordance with current building code and fire prevention regulations. 5. The noise level for this property shall not exceed the acceptable decibel level as adopted by the St. Lucie County Code of Ordinances, Chapter 28, Article V. No outdoor music or the use of speakers is allowed between 10:OOpm and 8:OOam. No fireworks are permitted in association with any contracted event on the property. 6. No event -related signs are permitted. Any temporary or permanent signs erected must follow the St. Lucie County Land Development Code Section 9.01.00 for a residential use in the existing AR -1 zoning district. 7. No light spillover onto neighboring properties is permitted. 8. Hours of operation for events are limited to Fridays and Saturdays, 11:00am to 11 �OOpm, and Sundays, 11:00am to 9:OOpm. 9. Number of events is limited to 30 separately contracted events per calendar year. 10. Attendance at each event will be limited to 150 total guests. 11. This approval order does not permit guests to stay on premises overnight. 12. The parking area must be improved with spaced -organizing devices, such as wheel stops or pavers to delineate individual parking spaces. PDS Order 18-027 WDA 120186246 Page 2 13. Within 90 days of this approval, the applicant is required to provide two paved parking spaces that meet the requirements of the Americans with Disabilities Act (ADA). 14. Due to driveway restrictions, only standard passenger vehicles will be permitted to access or leave the subject property between 7:00pm and 7Mam; delivery trucks and limousines will only be permitted to access the site during daylight hours. 15. All events hosted on the property are required to rent portable restrooms, which include hand washing or sanitizing facilities; a minimum of one restroom must be ADA compliant. 16. Only employees associated with managing the events rental business and associated property, lawn and building maintenance are permitted on site outside of scheduled events. Any staff associated with setting up for renting the property for events are permitted on site 24 hours before and after the scheduled event. 17. All refuse generated during events shall be cleaned up and contained in authorized debris receptacles within 24 hours of the completion time of the contracted event. 18. This approval order addresses only administrative determinations or alternatives available through the St. Lucie County Land Development Code, Ordinance 12-003. Nothing in this approval shall be construed to negate the requirement to comply with other applicable local, state or federal codes and laws. B. The subject property is described as follows: Address: 321 Lamont Road, Fort Pierce, FL 34947 Parcel No. 2312-213-0001-000-5 C. The approvals and authorizations granted by this Order are granted to the applicant for the purpose of obtaining construction authorizations or Zoning Compliance from St. Lucie County. D. This approval order for use determination as an event rental facility and associated alternative paving and landscaping is granted on an intermittent basis with the presumption that the number of events allowed will not create an adverse impact on neighboring properties, area traffic, the current condition of Lamont Road, or the existing site conditions. If such impacts are generated, the approval of the event rental use may be revoked, or the applicant may be required to make necessary repairs to Lamont Road or improvements to the subject site to come further toward compliance with the strict application of the Land Development Code. E. An appeal of the Planning and Development Services Director's action may be processed in accordance with Section 11.11.02 of the St. Lucie County Land Development Code.
