LUCIE COUNTY CODE SH:2Supp. No. 10 (6) If an examination was required when the original certificate of competency was issued, proof of having taken and passed, with a grade of 75 percent or higher if the examination was taken on or before April 7, 1992, or with a grade of 70 percent or higher if the examination was taken after April 7, 1992, an examination approved by the appropriate examining board. (7) The holder of a reactivated certificate of competency shall not engage in the business of contracting until a copy of the certificate holder's state-registered license has been provided to the director. (c) Applications for reactivation of an inactive certificate of competency will be processed and reviewed in the same manner as an original application for a certificate of competency. (d) All holders of inactive certificates of competency shall pay the annual renewal fee for inactive certificates during the month of September. (e) The provisions of this section shall not apply to any employee of the United States, the state, any county, municipality, or other political subdivisions, where the employee is required to refrain from the business of contracting as a condition of his employment. Any person seeking to obtain a voluntary inactive status under the provision of this subsection shall submit written notice to the director along with verification of employment and the employer's regulation restricting the ability of the employee to continue engaging in the business of contracting during the term of his employment. Within 30 days of the date of termination of his employment, the employee shall notify the director of the termination and request the employee's certificate of competency be reinstated to active status; or that the employee wishes to have his certificate placed on standard inactive status pursuant to this section. Any employee of the United States, state, any county, municipality, or political subdivision who is required to refrain from the business of contracting as a condition of his employment shall be exempt from any fees associated with obtaining voluntary inactive status for his certificate of competency pursuant to this subsection. (a) In the event that there is a change in the status of a business organization or an individual from that contained in an original application for a certificate of competency which has been approved by an examining board, the certificate holder shall be required to submit a new application which reflects the change in status. The certificate holder will not be required to take the approved examination as part of the change of status application process if there is no change in qualifying agent. (b) An application for a change in status shall be submitted to the director within 45 days of the date on which the change of status occurs. (c) All applications for change of status shall be processed and reviewed in the same manner as an initial application for a certificate of competency. § 10-62BUILDINGS AND BUILDING REGULATIONS CD10:15Supp. No. 10 (d) A change of status of a business organization and/or a change of status of the contractor shall cause the previously issued certificate of competency to be invalid and the certificate holder shall not engage in the business of contracting under the previous certificate. (a) The director shall issue letters of reciprocity to contractor licensing officials in other jurisdictions for those parties who have been issued a county certificate of competency. A letter of reciprocity shall state the name and address of the certificate holder, the type and class of certificate issued, the title, date, location, and grade for the examination taken, and the current status of the certificate. (b) The fee for the preparation and issuance of a letter of reciprocity shall be as prescribed by resolution of board of county commissioners. (c) In lieu of meeting the requirements of section 10-59(a)(2), the county shall accept original letters of reciprocity from other jurisdictions only for those applicants who have obtained a grade of 70 percent or higher on a competency examination which has been approved by the appropriate county examining board. Such letters of reciprocity shall be on letterhead of the other jurisdiction's contractor licensing official and shall be signed by the official or his designee. The letter of reciprocity shall contain the applicant's name and address, the date and place the applicant took the competency examination, the name of the examination, the grade obtained on the examination, a copy of the applicant's current credit report, and the current status of the applicant's license. The date of the competency examination shall not be older than five years when it is submitted. If the competency examination date is over five years, the applicant must provide proof of having a current license in another Florida jurisdiction or the applicant would have to retake the required examination and obtain a passing score. A letter of reciprocity shall be no older than six months when it is submitted to the director. (d) In addition to the reciprocity procedures set forth above, an applicant who holds a current and valid certificate of competency issued by the City of Fort Pierce or the City of Port St. Lucie shall be issued a county certificate of competency in the same contractor category upon submission of following to the director: (1) Completed application for a county certificate of competency and required applica- tion fee. (2) Proof of current and valid certificate of competency issued by City of Fort Pierce or City of Port St. Lucie in the field of contracting for which he seeks a county certificate of competency. § 10-62 ST. COMMUNITY DEVELOPMENT CD14:3Supp. No. 10 over levees and embankments, and to construct any and all of such works and improvements across, through, or over any public right-of-way, highway, grade, fill, or cut; d. District roads equal to or exceeding the specifications of the county in which such district roads are located, and street lights; e. Buses, trolleys, transit shelters, ridesharing facilities and services, parking improvements, and related signage; f. Investigation and remediation costs associated with the cleanup of actual or perceived environmental contamination within the district under the supervi- sion or direction of a competent governmental authority unless the covered costs benefit any person who is a landowner within the district and who caused or contributed to the contamination; g. School buildings and related structures, which may be leased, sold or donated to the school district, for use in the educational system, when authorized by the district school board; and k. Security, including, but not limited to, guardhouses, fences and gates, electronic intrusion detection systems, and patrol cars, when authorized by proper governmental agencies; except that the district may not exercise any police power, but may contract with the appropriate local general purpose governmental agencies for an increased level of such services within the district boundaries. (2) The district will use its best efforts to develop in an integrated fashion the traffic circulation, water, and sewer facilities on the district property as one functional interrelated community. (3) The district shall take no action which is inconsistent with the comprehensive plan, ordinances or regulations of the county. (4) No publicly owned property that may be located or acquired within the legal description of this community development district shall be assessed for, or obligated in any way to pay for the infrastructure constructed, maintained, or operated by the community development district described in section 14-273. (5) The district shall take affirmative steps to provide for the full disclosure of information relating to the public financing and maintenance of improvements to real property undertaken by the district. Such information shall be made available § 14-274COMMUNITY DEVELOPMENT CD14:29Supp. No. 10 to all existing residents, and to all prospective residents, of the district. The district shall furnish each developer of a residential development within the district with sufficient copies of that information to provide each prospective initial purchaser of property in that development with a copy, and any developer of a residential development within the district, when required by law to provide a public offering statement, shall include a copy of such information relating to the public financing and maintenance of improvements in the public offering statement. The boundaries of the Waterstone Community Development District are as set forth in the legal description contained in the amended Exhibit A attached to Ordinance No. 06-016. Sec. 14-321. Powers. The Waterstone Community Development District shall have all those general powers granted pursuant to F.S. § 190.011, and those special powers granted pursuant to F.S. § 190.012(1) and (3). Consent is hereby given to the district to exercise those powers relating to recreation and security contained in F.S. § 190.012(2)(a) and (d), subject to the following limitations: (1) The Waterstone Community Development District shall not provide water or wastewater service to the lands located within or outside the boundaries of the district. (2) The Waterstone Community Development District shall not be authorized to construct fire stations or provide for fire trucks or other vehicles and equipment related thereto. A, 5-16-2006) § 14-321COMMUNITY DEVELOPMENT CD14:31Supp. No. 10 three or more than four shall be owners or operators of motels, hotels, recreational vehicle parks, or other tourist accommodations in the county subject to a tax levied pursuant to F.S. § 125.0104. (3) All members of the council shall be electors of the county. (4) The board of county commissioners shall have the option of designating the chairperson of the council or allowing the council to elect a chairperson. (a) The council shall meet at least once each quarter and shall, from time to time, make recommendations to the board of county commissioners for the effective operation of the special projects or for use of the tourist development tax revenue and perform such other duties as may be prescribed by resolution of the board of county commissioners. (b) The council shall continuously review expenditures of revenues from the tourist development trust fund established pursuant to F.S. § 125.0104, and shall receive, at least quarterly, expenditure reports from the board of county commissioners or its designee. Expenditures that the council believes to be unauthorized shall be reported to the board of county commissioners and the state department of revenue. The board of county commis- sioners shall review the council's findings and take appropriate administrative or judicial action to ensure compliance with F.S. § 125.0104. (Code 1982, § 1-19.5-23; Ord. (a) Pursuant to F.S. § 336.025(1)(a), a $0.06 local option motor fuel tax is reauthorized and imposed upon every gallon of motor fuel and diesel fuel sold in the county, and taxed under the provisions of F.S. ch. 206. The revenues received pursuant to the tax levied pursuant to this paragraph (a) shall only be utilized for transportation expenditures as defined in F.S. § 336.025. *State law reference—Gas taxes, F.S. ch. 206. § 42-192TAXATION CD42:25Supp. No. 10 (b) Pursuant to F.S. § 336.025(1)(b), Florida Statutes, $0.05 local option motor fuel tax is reauthorized and imposed upon every gallon of motor fuel sold in the county and taxed under the provisions of F.S. ch. 206, Part 1. The revenues received from the additional $0.05 local option motor fuel tax may only be utilized for transportation expenditures needed to meet the requirements of the capital improvements element of an adopted comprehensive plan. For purposes of this subsection, expenditures for the construction of new roads, or reconstruction or resurfacing of existing paved roads shall be deems to increase capacity and such projects shall be included in the capital improvements element of the adopted comprehensive plan. All divisions of tax proceeds shall be determined by the county on or before October 1 of each year during the duration of the tax as set out in Section 42-194 beginning October 1, 2015. The annual redetermination by the county of the division of the tax proceeds for the period from September 1, 2015 through December 31, 2019 shall be based on transportation expenditures of the county and all eligible municipalities based on the transportation expenditures of each for the five fiscal years preceding the year in which the annual redetermination is made in accordance with F.S. § 336.025(4)(a). The county shall notify the department of revenue of the results of the county's redetermination of the tax proceeds by October 1 of the year the redetermination is made. The annual redetermination shall be effective beginning January 1 of the year after the redetermination is made. Any dispute as to the determination by the county of the distribution of the tax proceeds shall be in accordance with F.S. § 336.025(5)(b). (Code 1982, § 1-19.3-42; Ord. No. 97-15, pt. The initial $0.06 local option gas tax imposed by this article shall be effective from September 1, 1987, through August 31, 2015, both dates inclusive. The first initial additional $0.02 local option motor fuel tax imposed by this article shall be effective from January 1, 1998, through August 31, 2015, both dates inclusive. The remaining initial additional $0.03 local option motor fuel tax imposed by this article shall be effective from January 1, 2000, through August 31, 2015, both dates inclusive. The reauthorized $0.06 local option gas tax imposed by this article through the adoption of Ordinance No. 15-008 shall be effective from September 1,2015 through December 31, 2017, both dates inclusive.
