HomeMy WebLinkAboutPDS-18-038 - Decorative Concrete1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 37 38 39 40 41 42 43 44 PDS ORDER 18-038 WDA -620185326 AN ORDER GRANTING A USE DETERMINATION TO PROVIDE ELIGIBILITY OF SMALL SCALE MANUFACTURING OF CONSUMER CONCRETE PRODUCTS AS A CONDITIONAL USE WITHIN THE IL (INDUSTRIAL LIGHT) ZONING DISTRICT FOR CERTAIN PROPERTY LOCATED AT COMMERCIAL CIRCLE SITUATE IN ST. LUCIE COUNTY, FLORIDA WHEREAS, the St. Lucie County Planning and Development Services Director has reviewed the request to allow a subset of SIC Code (3272), manufacturing of consumer concrete products, for application of a conditional use request within the Industrial Light, IL zoning district for property located at Commercial Circle, Fort Pierce, FL, and made the following determinations: On August 1, 1990, the Board of County Commissioners of St. Lucie County, Florida, adopted the St. Lucie County Land Development Code and has adopted amendments to the Land Development Code through certain ordinances. 2. On May 15, 2012, the Board of County Commissioners of St. Lucie County, Florida, adopted Ordinance 12-003 granting the Planning and Development Services Director the authority to make the determination after full analysis of all potential impacts that a proposed use is in compliance with the provisions of the Land Development Code and the St. Lucie County Comprehensive Plan. 3. The determination to allow a subset of SIC Code (3272), manufacturing of consumer concrete products, for application of a conditional use request within the Industrial Light, IL zoning district, subject to the following baseline operational requirements: a) The property on which the product manufacturing activity is to take place shall beat least twenty-one thousand, seven hundred and eighty (21,780) square feet (0.5 acre) and no more than one -hundred, eight thousand and nine hundred (108,900) square feet (2.5 acres) in total area. b) The structure(s) for which the product manufacturing activity is to take place shall be no greater than six (6) thousand square feet in total area. c) All activities (except for employee and customer parking), including storage of unfinished and finished materials, and equipment, shall be conducted within a completely enclosed structure. No outside storage of materials of any kind shall be permitted. d) The operation demonstrates a method of delivery and transfer of aggregates (sand/rock) to the site, and into the structure that minimizes dropping, discharge, or JOSEPH E. (i.e. delivery truck which contain materials via covering or enclosure and facility design such as roll up doors, industrial type vestibule, etc.). e) The property on which the manufacturing activity is taking place shall be surrounded by a fence, wall, or vegetative screening eight (8) feet in height. f) Regardless of building size, a complete site plan prepared in accordance with the provisions of Section 11.02.00 (Site Plan) shall be required with the application for conditional use. 4. The determination to allow manufacturing of consumer concrete products, within operational criteria, for submission of a conditional use application subject to review pursuant to Land Development Code Section 11.07.00, within the IL (Industrial Light) zoning district for the subject property, is consistent with the general purpose, goals, and objectives of the St. Lucie County Comprehensive Plan, the Land Development Code and Ordinance 12-003, is in the best interest of the health, safety and public welfare of the citizens of St. Lucie County, Florida. 5. The proposed use determination does not authorize a conditional use permit for the subject site but provides for further application and review as to whether the use will have an undue adverse effect on parking, utility facilities, or other matters affecting the public health, safety, and general welfare within the IL (Industrial Light) zoning district. NOW, THEREFORE, BE IT ORDERED: by the Planning and Development Services Director of St. Lucie County, Florida: Has determined the manufacturing of consumer concrete products, a subset of (3272), subject to integration of the baseline operational requirements may be appropriate as a conditional use, within the IL, Industrial Light zoning district. The determination affirms the use classification to be subject to the established review standards of LDC Section 11.07.03 and collective application process of Section 11.07.00. PART A. SEVERABILITY If this Order or any provision thereof shall be held to be inapplicable to any person, property, or circumstances, such holding shall not affect its applicability to any other person, property or circumstances. PART B. APPLICABILITY OF ORDINANCE This Order shall only constitute determination manufacturing of consumer concrete products, a subset of (3272), as an eligible conditional use and be applicable in the IL, Industrial Light zoning district for property located at Commercial Circle of the unincorporated area of St. Lucie County. PART C.
