HomeMy WebLinkAboutPDS-18-040 - 14 Nettles BlvdE 1 PDS NO. 18-040 2 File No. AV 520175131 3 4 AN ORDER GRANTING TEMPORARY ADMINISTRATIVE APPROVAL 5 FOR PROPERTY LOCATED AT 14 NETTLES BLVD. 6 JENSEN BEACH, FLORIDA 7 8 WHEREAS, the St. Lucie County Planning and Development Services Director has reviewed the 9 application for an administrative variance including but not limited to the staff report and made the 10 following determinations: 11 12 1. The temporary administrative variance for Jennifer Oram has been approved for property 13 located at 14 Nettles Blvd., Jensen Beach, Florida. 14 15 2. The Administrative Variance allows for an encroachment into the minimum required 8 foot 16 side setback by 4 feet or a reduction in the required side setback from 8 feet to 4 feet. 17 18 3. The Administrative Variance allows for an encroachment into the minimum required side 19 setback by 4 feet for a temporary ramp that will extend approximately 28 feet with a width 20 of 3.5 feet. Measurements relied upon have been drawn by the agent for the applicant on 21 a survey by Earl R. Starkey dated 5/10/2006 as well as pictures of the ramp providing the 22 measure width. 23 24 4. Staff has reviewed the administrative variance on the subject property and found it to meet 25 technical requirements of the St. Lucie County Land Development Code and to be 26 consistent with the St. Lucie County Comprehensive Plan. 27 28 5. Staff has provided an analysis of the parcel's eligibility for an encroachment into the 29 minimum required setback by no more than 50 percent in an existing recreational vehicle 30 park pursuant to Section 10.01. 14 of the St. Lucie County Land Development Code (LDC). 31 That analysis is found in a memorandum dated June 28, 2018 entitled Oram 32 Administrative Variance — File No. AV 620185332. 33 34 6. The requested encroachment will not have an undue adverse effect on adjacent property, 35 does not encroach into any easements or common areas, does not conflict with other 36 codes and otherwise meets the intent and purpose of the general standards for issuing a 37 variance pursuant to Section 10.01.14.A(2)(a-g). An analysis of the general standards may 38 be found in a Planning and Development Services memorandum described above. 39 40 NOW, THEREFORE, BE IT ORDERED: 41 42 A. Pursuant to Section 10.01.14A(2), LDC, the Oram Administrative Variance is hereby 43 approved as described herein above subject to the following conditions: 44 45 1. The temporary ramp shall be removed 6 months from the date of approval or when 46 Mr. Oram becomes ambulant, whichever occurs first. An additional 6 months may be 47 approved upon receipt of a written Doctor's statement prior to the expiration of the 48 initial 6 month period. The ramp must be secured or removed in the event an emergency is called for a hurricane with winds of 75 mph or more. B.
