HomeMy WebLinkAboutPDS-18-045 - The Crossing - Oleander Avenue Campus1 2 3 11 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 37 38 39 40 41 42 43 PDS Order No. 18-045 SPMN-320185282 AN ORDER GRANTING A MINOR ADJUSTMENT TO AN EXISTING SITE PLAN PROJECT KNOWN AS THE CROSSING — OLEANDER AVENUE CAMPUS WHEREAS, the St. Lucie County Planning and Development Services Director has reviewed the application for a site plan approval and reviewed the comments of the St. Lucie County Development Review Committee on this application, and made the following determinations: 1. The Crossing, a Network of Community Churches, submitted an application for a minor site plan adjustment to reduce the size of the approved 16,000 sq. ft. sanctuary structure by 6,636 sq. ft., to provide for a 9,364 sq. ft. sanctuary for completion in two (2) phases, and increase the size of the approved multi-purpose building by 275 sq. ft. to accommodate educational services authorized by the Board of County Commissioners through Resolution 18-118, for the existing church campus located at 5200 Oleander Avenue 2. On October 20, 1992, the St. Lucie County Board of County Commissioners approved Resolution 92-240, granting site plan approval for a 43,058 square foot project known as New Hope Baptist Church located at 5200 Oleander Avenue in St. Lucie County, Florida. 3. On August 30, 2000, the site plan was modified by a minor adjustment, reducing the overall development from 43,058 square feet to 31,386 square feet of building area. 4. On September 12, 2014, a modification to the site plan was approved which provided for construction of a 16,000 sq. ft. sanctuary and a 10,877 sq. ft. multi-purpose facility, in three phases. The authorized total buildable area with the adjustment was 35,325 square feet, 2,669 less than previously approved and 7,733 square feet less than project's original site plan approval. 5. The Development Review Committee has reviewed the proposed site plan adjustment and found, with the proposed conditions, it meets the technical requirements of the St. Lucie County Land Development Code and has satisfied the standards of review set forth in Section 11.02.07, Standards for Site Plan Review, of the Land Development Code. 1*1 Planning Staff has performed a detailed analysis of the project and determined it to be consistent with the St. Lucie County Land Development Code and Comprehensive Plan. The Crossing - Oleander Avenue Campus site plan, inclusive of the presented 4 adjustment, will maintain a Certificate of Capacity Exemption, a copy of which is 5 attached to this order, as Exhibit B, as required under Chapter V, St. Lucie County Land 6 Development Code. 7 8 NOW, THEREFORE, BE IT ORDERED: 9 10 A. Pursuant to Section 11.02.03 of the St. Lucie County Land Development Code, the 11 proposed Minor Adjustment to the Site Plan project to be known as The Crossing — 12 Oleander Avenue Campus, is hereby approved as shown on the site plan drawings, 13 attached as Exhibit A, for the project prepared by Ladyko Design Group, LLC., dated 14 July 25, 2018, as revised and date stamped received by the St. Lucie County Planning 15 and Development Services Director on July 27, 2018, subject to the following 16 conditions: 17 18 1. The proposed modular multi-purpose (classroom) structure is removed, 19 appropriately modified, or replaced with a structure in compliance with the 20 Community Architectural Guidelines adopted within LDC section 7.10.24, within 21 five (5) years of a certificate of occupancy. 22 23 2. Prior to the issuance of a building permit for any additional buildings or 24 structures within the project, except as noted above for the modular multi - 25 purpose (classroom) structure, the Planning and Development Services 26 Planning Division shall review the proposed structure for consistency with Land 27 Development Code Section 7.10.24. 28 29 3. Prior to the issuance of a building permit, the applicant shall submit an updated 30 landscape plan depicting the required wall and landscaping between the 31 proposed institutional use and adjacent residential uses. The wall requirement 32 shall be waived through the Administrative Wall Waiver process should the 33 adjacent property owners consent to removing the wall between their parcel and 34 the proposed use [Land Development Code 7.09.04.E]. 35 36 4. The issuance of County development permit does not in any way create any 37 rights on the part of the applicant to obtain a permit from a state or federal 38 agency and does not create any liability on the part of the County if the applicant 39 fails to obtain requisite approvals or fulfill the obligations imposed by a state or 40 federal agency or undertakes actions that result in a violation of state or federal 41 law. 42 43 5. All other applicable state or federal permits must be obtained before 44 commencement of the development. The Code Compliance Manager shall receive a copy of this Development Order and the site plan it approves and shall not approve any building permits that do not implement or are not consistent with this Development Order and the plans hereby approved. B. The property on which this Minor Adjustment approval is being granted is described as follows: LEGAL DESCRIPTION: Beginning at a stake at the center of Oleander Avenue and Fourth Street, according to the Plat of White City, being recorded in Plat Book 1, Page 23, of the Public Records of St. Lucie County, Florida, thence run east 1060 feet, thence run east 495.00 feet; thence run west 1060.00 feet to the center of Oleander Avenue; thence run south 495.00 feet to the Point of Beginning, excepting there from the following tract of land, to wit; Beginning at the intersection of Oleander Avenue and Fourth Street, run east 400.00 feet; thence run north 217.50 feet; thence run west 400 feet to the east right- of-way line of Oleander Avenue; thence run south along right-of-way line 217.50 feet to the Point of Beginning, said Plat of White City Florida; being recorded in Plat Book 1, Page 23, of the Public Records of St. Lucie County, Florida. And also less the west 68.00 feet thereof. Containing +/- 9.55 acres. Parcel ID#: 3403-323-0002-000-2 Location: 5200 Oleander Ave C. The developer is advised as part of this minor adjustment approval for the Crossing - Oleander Avenue Campus, including any successors in interest, the developer shall obtain all applicable development permits and construction authorizations from the appropriate state, federal and local regulatory agencies including, but not limited to, the United States Army Corps of Engineers, the Florida Department of Environmental Protection, South Florida Water Management District, and the St. Lucie County Environmental Resources and Building Department prior to the commencement of any development activities on the property described in Part B. Issuance of this order by the County does not in any way create any rights on the part of the developer to obtain a permit from a state or federal agency and does not create any liability on the part of the County for issuance of this development order if the developer fails to obtain requisite approvals or fulfill the obligations imposed by a state of federal agency or undertake actions that may result in a violation of state or federal law. This Order shall become effective upon the date of approval indicated below. Should the property owner, developer or authorized agent wish to appeal any condition described in Part A above, all such appeals must be filed in writing with the County Administrator within 30 days of the rendering of this Order, as described in Section 11.02.03(8), St. Lucie County Land Development Code. Should an appeal to this Order be filed, no permitting reviews or further administrative action shall take place on the processing of this development project until the appeal is resolved. E. A copy of this Order shall be attached to the site plan drawings described in Part A, which plan shall be placed on file with the St. Lucie County Planning and Development Services Director and mailed to the applicant and agent of record as identified on the site plan applications. F. The conditions set forth in Part A are an integral nonseverable part of the site plan approval granted by this Order. If any condition set forth in Part A is determined to be invalid or unenforceable for any reason and the developer declines to comply voluntarily with that condition, the site plan approval granted by this order shall become null and void. G. A Certificate of Capacity Exemption in accordance with Section 5.03.02(B) 6 of the St. Lucie County Land Development Code, attached as Exhibit B, has been issued with this order. H.
