5 A RESOLUTION APPROVING A VARIANCE FOR
6 CERTAIN PROPERTY LOCATED IN ST. LUCIE COUNTY, FLORIDA

8 WHEREAS, the Board of Adjustment of St. Lucie County, Florida, based on the testimony and
9 evidence, including, but not limited to the staff report, has made the following determinations:

11 1. Petition of Millhess Inc. & Southall, Inc. for a variance from the provisions of Section
12 4.01.04 (Hutchinson Island Height Limitations) of the St. Lucie County Land
13 Development Code to allow two (2) non-residential buildings to exceed the maximum 35
14 foot building height requirement, in Zone B, by seven (7) feet, for a total building height
15 of 42 feet in the HIRD, Hutchinson Island Residential District (Proposed PNRD, Planned
16 Non-residential Development) Zoning District.

18 2. On July 25, 2018, this Board held a public hearing on the petition, after publishing a
19 notice of such hearing, installing a sign on property and notifying by mail all owners of
20 property within 500 feet of the subject property.

22 3. After consideration of the staff comments and applicant's exhibits presented during the
23 public hearing, including the standards of review for granting variances set out in Section
24 10.01.02, St. Lucie County Land Development Code, the Board of Adjustment has made
25 the following determinations:

27 The requested variance has met the standards of review as set forth in Section
28 10.01.02, St. Lucie County Land Development Code and is not in conflict with the goals,
29 objectives, and policies of the St. Lucie County Comprehensive Plan, because the
30 variance does not impair or otherwise injure other property or improvements in the area
31 in which the subject property is located, and will not adversely impact travel lanes or
32 traffic associated with the subject site.

35 NOW, THEREFORE, BE IT RESOLVED by the Board of Adjustment of St. Lucie County,
36 Florida:

38 A. Petition of Millhess Inc. & Southall, Inc. for a variance from the provisions of Section

46 D. An appeal from the Board of Adjustment's action may be processed in accordance with
47 Section 10.01.07, of the St. Lucie County Land Development Code.
