HomeMy WebLinkAboutPDS-18-041 - East Side of Brocksmith Road1 PDS NO. 18-041 2 File No. LS 620185336 3 4 AN ORDER APPROVING AN LOT SPLIT/BOUNDARY ADJUSTMENT 5 FOR PROPERTY CONSISTING 38.153 ACRES LOCATED ON THE 6 EAST SIDE OF BROCKSMITH ROAD AND ABUTTING OKEECHOBEE 7 ROAD TO THE SOUTH. 8 9 WHEREAS, the St. Lucie County Planning and Development Services Director has reviewed the 10 application for a Lot Split in the name of Emma Viamontes and makes the following findings: 11 12 1. The Lot Split application has been approved for property zoned AG -5 (1 du/5 ac) 13 consisting of 38.153 acres m.o.l. and legally described as follows: 14 15 See Attached Exhibit A. 16 17 2. The division of the subject property creates two lots depicted on the boundary survey(s) 18 created by Richard E. Barnes III, PSM, revised and dated 7/24/2018. Parcel A con$isting 19 of 27.928 acres and Parcel B consisting of 10.225 acres. 20 21 3. Staff has reviewed the lot split on the subject property and found it to meet technical 22 requirements of the Code and the standards of review in Section 11.03.04.D of the St. 23 Lucie County Land Development Code as conditioned below and to be consistent with the 24 St. Lucie County Comprehensive Plan. 25 26 4. Staff has provided an analysis of the parcel's eligibility for a Lot Split pursuant to Section 27 11.03.04 of the St. Lucie County Land Development Code. That analysis is found in a 28 memorandum dated July 30, 2018 entitled Viamontes, lot split LS 620185336. 29 30 NOW, THEREFORE, BE IT ORDERED: 31 32 A. Pursuant to Section 11.03.04 of the St. Lucie County Land Development Code, the Lot 33 Split/boundary adjustment as described hereinabove is approved, by the Planning and 34 Development Services Director, as shown on the boundary survey prepared by Richard E. 35 Barnes III, PSM, dated June 13, 2018 and revised July 24, 2018, by , subject to the following 36 conditions: 37 38 1. Within 90 days of the recorded order of approval, the applicants, property owners, 39 developer, their successors or assigns, shall convey to St. Lucie County, in a manner 40 or form acceptable to the County Attorney, 40 feet of right-of-way which includes the 41 5 foot easement easterly of and congruent with the 35 feet of additional dedication for 42 the length of the property frontage along Brocksmith Road. Road impact fee credits 43 shall be applicable in accordance with the Code. (Section 4.12.10, LDC.) 44 45 2. No further division of the property is permitted unless a final record plat is submitted 46 in accordance with the Code. (Section 11.03.04, LDC) 47 IOSEPH E. St. Lucie County is not responsible for the maintenance, upkeep or improvement of any private drives, roads, streets, easements, or rights-of-way providing ingress and egress or drainage service to the subject property herein. C. A copy of this Order shall be attached to the boundary survey described in hereinabove, and shall be placed on file in the Planning and Development Services Department. D.
