4 AN ORDER GRANTING A MINOR ADJUSTMENT TO A MAJOR SITE
5 PLAN PROJECT KNOWN AS MAVERICK BOAT COMPANY ON
6 APPROXIMATELY 36.33 ACRES OF PROPERTY LOCATED IN ST.
7 LUCIE COUNTY, FLORIDA.

9 WHEREAS, the St. Lucie County Planning and Development Services Director has
10 reviewed the request for a Minor Adjustment to Major Site Plan submitted by the
11 Maverick Boat Company, evaluated the comments of the St. Lucie County
12 Development Review Committee on this application, and made the following
13 determinations:

15 1. On June 5, 2018, the Maverick Boat Company (aka Maverick Boat Group) filed
16 an application requesting a Minor Adjustment to the Major Site Plan, known as
17 Maverick Boat Company, to amend the parking configuration and access
18 driveways to loading areas, reduce surplus (non -required) parking spaces, and
19 correct minor errors within the site area data table.

21 2. On May 16, 2017, the Board of County Commissioners approved Resolution
22 2017-112, granting Major Site Plan Approval for the construction of a 252,500 sq.
23 ft. (280,400 sq. ft. inclusive of covered areas) boat manufacturing facility, to be
24 constructed in four (4) phases on approximately 36.33 acres of land as described
25 in Part B, within the IL (Industrial Light) Zoning District, located at 4551 St. Lucie
26 Boulevard as more particularly described in Part A below and depicted on Exhibit
27 A.

29 3. The St. Lucie County Development Review Committee has reviewed the
30 proposed Minor Adjustment to Major Site Plan, as depicted on Exhibit C
31 incorporated herein, for the project and found it to meet all technical
32 requirements of the St. Lucie County Land Development Code, and to be
33 consistent with the St. Lucie County Comprehensive Plan, and to have satisfied
34 the standards of review set forth in Section 11.02.07, Standards for Site Plan
35 Review, subject to the conditions set forth in Part A of this Order.

37 4. The proposed project will not have an undue adverse effect on adjacent property,
38 the character of the neighborhood, traffic conditions, parking, utility facilities or
39 other matters affecting the public health, safety and general welfare.

41 5. All reasonable steps have been taken to minimize any adverse effect of the
42 proposed project on the immediate vicinity through building design, site design,
43 landscaping and screening.

1 6. The proposed project will be constructed, arranged and operated so as not to
2 interfere with the development and use of neighboring property, in accordance
3 with applicable district regulations.

5 7. Planning Staff has performed detailed analysis of the project and determined it to
6 be consistent with Sections 11.02.04 C., Minor Adjustment to Major Site Plan and
7 11.02.07., Standards for Site Plan Review, of the St. Lucie County Land
8 Development Code. The analysis is found in the Staff Report for the Maverick
9 MinorAdjustment to Major Site Plan, dated September 20, 2018.

11 8. The Certificate of Capacity issued for this development, on May 24, 2017,
12 remains in effect, a copy of which is attached to this order, as required under
13 Chapter V, St. Lucie County Land Development Code.

15 NOW, THEREFORE, BE IT ORDERED by the Planning and Development Services
16 Director of St. Lucie County, Florida:

18 A. Pursuant to Sections 11.02.04 and 11.02.07 of the St. Lucie County Land
19 Development Code, the Minor Adjustment to Major Site Plan for the project known
20 as Maverick Boat Company is hereby approved as shown on the site plan drawings
21 for the project prepared by Knight, McGuire and Associates, Inc. dated September
22 5, 2018 (labeled side panel) and date stamped received by the St. Lucie County
23 Planning & Development Services Department on September 12, 2018, subject to
24 the following conditions:

28 1. Prior to a Certificate of Occupancy for Phase ll, or other subsequent phases,
29 of development as depicted on the site plan, the applicant shall install the
30 ingress turn lanes (an eastbound right-turn lane and a westbound left-turn
31 lane) within the right-of-way at the intersection of St. Lucie Boulevard and
32 Hammond Road and modify the east driveway to provide exclusive left and
33 right turn egress lanes in order to decrease the amount of internal queuing
34 during the peak hours.

36 2. All boat manufacturing activities shall occur within an enclosed structure.

38 3. The applicant shall locate the sign and flagpole on private property, or obtain
39 a revocable license agreement prior to issuance of a building permit for
40 construction of this site feature.

44 1. The issuance of County development permit does not in any way create any
45 rights on the part of the applicant to obtain a permit from a state or federal

1 agency and does not create any liability on the part of the County if the
2 applicant fails to obtain requisite approvals or fulfill the obligations imposed by
3 a state or federal agency or undertakes actions that result in a violation of
4 state or federal law.

6 2. All other applicable state or federal permits must be obtained before
7 commencement of the development.

11 1. Prior to the issuance of a Building Permit for Phase II development as
12 depicted on the Site Plan, off-site construction (engineering) plans shall be
13 submitted to the Engineering Division for review and approval.

15 2. Prior to the issuance of a right-of-way permit for completion of off-site
16 improvements, the applicant shall execute a Road Improvement Agreement
17 with St. Lucie County and provide a surety for the proposed public
18 improvements. The agreement and amount of surety shall be in accordance
19 with Section 11.04.00 of the County Land Development Code, or succeeding
20 ordinance.

22 B. The property on which the Minor Adjustment to Major Site Plan is being granted is
23 described as follows:

33 C. The property owner, including any successors in interest, shall obtain all applicable
34 development permits and construction authorizations from the appropriate State and
35 Federal and local regulatory agencies including, but not limited to, the United States
36 Army Corps of Engineers, the Florida Department of Environmental Protection,
37 Florida Department of Transportation, South Florida Water Management District,
38 and the St. Lucie County Environmental Resources and Building Departments prior
39 to the commencement of any development activities on the property described in
40 Part B. Issuance of this permit by the County does not in any way create any rights
41 on the part of the developer to obtain a permit from a state or federal agency and
42 does not create any liability on the part of the County for issuance of this permit if
43 the developer fails to obtain requisite approvals or fulfill the obligations imposed by a
44 state or federal agency or undertake actions that may result in a violation of state or
45 federal law.

D. This Order shall become effective upon the date of approval indicated below.
Should the property owner, developer or authorized agent wish to appeal any
condition described in Part A above, all such appeals must be filed in writing with the
County Administrator within 30 days of the rendering of this Order, as described in
Section 11.02.04(B), St. Lucie County Land Development Code. Should an appeal
to this Order be filed, no permitting reviews or further administrative action shall take
place on the processing of this development project until the appeal is resolved.
E. The conditions set forth in Part A are an integral non -severable part of the site plan
approval granted by this Order. If any condition set forth in Part A is determined to
be invalid or unenforceable for any reason and the developer declines to comply
voluntarily with that condition, the site plan approval granted by this order shall
become null and void.
F. A Certificate of Capacity, a copy of which is attached hereto as Exhibit B and made
a part hereof the Order, was granted by the Planning & Development Services
Department Director on May 16, 2017.
G. This order shall be recorded in the Public Records of St. Lucie County.
H. A recorded copy of this Order shall be attached to the site plan drawings described
in Part A, which plan shall be placed on file with the St. Lucie County Planning &
Development Services Department Director.
