AN ORDER GRANTING A MAJOR ADJUSTMENT TO THE
PREVIOUSLY APPROVED MINOR SITE PLAN KNOWN AS ST.
LUCIE VET CLINIC AND BOARDING FACILITY (FKA ST. LUCIE
VETERINARY HOSPITAL AND EMERGENCY CLINIC) LOCATED
AT 201 DYER ROAD AND 7790 S. US HIGHWAY 1, PORT SAINT
LUCIE.
WHEREAS, the St. Lucie County Planning and Development Services Director has reviewed the
request for a Major Adjustment to the Minor Site Plan to be known as St. Lucie Vet Clinic and
Boarding Facility and reviewed the comments of the Development Review Committee and has
made the following determinations:
Michael Geraghty requested a Major Adjustment to the Minor Site Plan known as St.
Lucie Vet Clinic and Boarding Facility (FKA St. Lucie Veterinary Hospital and Emergency
Clinic) to allow for the proposed addition of a two-story, 10,906 gross square foot animal
boarding facility, as an accessory use to the existing veterinary clinic. The subject
property is located at 201 Dyer Road and 7790 S. US Highway 1, Port Saint Lucie as
described in Part B.
2. On December 3, 2009, the St. Lucie County Growth Management Director, through GM
No. 09-023, granted Minor Site Plan approval of a two-story, 12,758 gross square foot
veterinary hospital and emergency clinic known as St. Lucie Veterinary Hospital and
Emergency Clinic.
3. On March 29, 2012, the St. Lucie County Growth Management Director, through approval
letter, granted a Minor Adjustment to the Minor Site Plan for approval to reconfigure the
parking in the northwest area of the parking lot, extend the masonry wall along the east
property line, and add stairs and a concrete pad at the south and east sides of the
building.
4. The Development Review Committee has reviewed the Major Adjustment to the
proposed project pursuant to the Land Development Code (LDC), Section 11.02.07 and
found it to meet technical requirements and to be consistent with the general purpose,
goals, and objectives, of the St. Lucie County Comprehensive Plan.
5. Planning staff has performed a detailed analysis of the project and found it to be
consistent with the St. Lucie County Land Development Code and Comprehensive Plan.
The analysis is found in the Planning and Development Services memorandum titled St.
Lucie Vet Clinic and Boarding Facility (SPMj-220185275) Major Adjustment to Minor Site
Plan, dated September 17, 2018.

6. The project will not have an undue adverse effect on adjacent property, the character of
the neighborhood, traffic conditions, parking, utility facilities, or other matters affecting the
public health, safety, and general welfare.
7. All reasonable steps have been taken to minimize any adverse effect of the proposed
project on the immediate vicinity through building design, site design, landscaping and
screening.
8. The project is designed, constructed and operated so as not to interfere with the
development and use of neighboring property, in accordance with applicable district
regulations.
NOW, THEREFORE, BE IT ORDERED by the Planning and Development Services Director of
St. Lucie County, Florida:
A. Pursuant to Section 11.02.03(E) of the St. Lucie County Land Development Code, the
Major Adjustment to a Minor Site Plan known as St. Lucie Vet Clinic and Boarding Facility
(FKA St. Lucie Veterinary and Emergency Clinic) is hereby approved as shown on the
drawing prepared by Engineering Design and Construction, Inc., date stamped by the
Planning & Development Services Department on July 24, 2018 for the property
described in Paragraph B below, subject to the following conditions:
1. All kennel activities shall occur within an enclosed structure, with the exception of
walking the dogs in the designated outdoor run area and outdoor play areas. No
dogs shall be outside in the activity areas before 7:00 a.m. and after 8:30 p.m.
2. No more than 192 dogs shall be boarded on the property at any one time.
3. The owner at all times shall comply with the St. Lucie County Code of Ordinances,
Section 28-107 through 28-112, as amended regulating noise.
4. All dog waste shall be immediately bagged by staff and properly disposed of in
enclosed dumpsters.
5. At time of constructability review, detailed offsite improvement plans for the
proposed paving of Dyer Road will be required. The plans will need to include, but
not be limited to, typical sections, striping, and signage details complying with
County standards.
6. At time of constructability review, include detail of pulling the north side of the
directional median back 1.5' form the travel lane on Dyer Road.
7. Prior to issuance of a Certificate of Occupancy all Category I listed invasive
species shall be eradicated from the site.
8. Prior to issuance of a Certificate of Occupancy missing hedge material and
unhealthy existing landscape trees shall be replaced per the existing approved
landscape plans.
9. The issuance of County development permit does not in any way create any rights
on the part of the applicant to obtain a permit from a state or federal agency and
does not create any liability on the part of the County if the applicant fails to obtain
requisite approvals or fulfill the obligations imposed by a state or federal agency
or undertakes actions that result in a violation of state or federal law.
10. All other applicable state or federal permits must be obtained before
commencement of the development.

B. The property on which this Major Adjustment to the Minor Site Plan approval is being
granted is described as follows:
PART OF LOT 10, BLOCK 3, ST. LUCIE GARDENS, ACCORDING TO THE PLAT
THEREOF, RECORDED IN PLAT BOOK 1, PAGE 35, MORE PARTICULARLY
DESCRIBED AS FOLLOWS:
THE WEST 324 FEET OF THAT PART OF SECTION 23, TOWNSHIP 36 SOUTH,
RANGE 40 EAST, LYING SOUTH OF THE 80 FEET COUNTY ROAD RIGHT-OF-WAY
(DYER ROAD), OF THE PUBLIC RECORDS OF ST. LUCIE COUNTY, FLORIDA.
CONTAINING 1.396 ACRES (60,808 SF)

THE SOUTH 55 FEET OF THAT PORTION OF THE SOUTH 200 FEET OF SECTION
22, TOWNSHIP 36 SOUTH, RANGE 40 EAST, SITUATE AND LYING EASTERLY OF
THE EAST RIGHT-OF-WAY OF STATE ROAD NUMBER 5, (US HIGHWAY NO. 1) SAID
55 FEET SHALL BE MEASURED PERPENDICULAR TO THE SOUTH SECTION LINE
OF THE PROPERTY.

The approvals and authorizations granted by this Resolution shall expire within twenty
four (24) months of the effective date of this order, unless the developer has obtained a
building permit for the site plan described in Part A, or an extension has been granted in
accordance with the provisions of Land Development Code Section 11.02.06.
2. The developer is advised as part of this Major Adjustment to Site Plan approval for St.
Lucie Vet Clinic and Boarding Facility, including any successors in interest, the developer
shall obtain all applicable development permits and construction authorizations from the
appropriate state, federal and local regulatory agencies including, but not limited to, the
United States Army Corps of Engineers, the Florida Department of Environmental
Protection, South Florida Water Management District, and the St. Lucie County
Environmental Resources and Building departments prior to the commencement of any
development activities on the property described in Part B. Issuance of this permit by the
County does not in any way create any rights on the part of the developer to obtain a
permit from a state or federal agency and does not create any liability on the part of the
County for issuance of this permit if the developer fails to obtain requisite approvals or
fulfill the obligations imposed by a state or federal agency or undertake actions that may

result in a violation of state or federal law.
3. A copy of this Order shall be attached to the site plan drawings described in Part A, which
plan shall be placed on file with the St. Lucie County Planning and Development Services
Department and mailed to the developer and agent of record as identified on the site plan
application.
4. The conditions set forth in Part A are an integral nonseverable part of the site plan
approval granted by this Order. If any condition set forth in Part A is determined to be
invalid or unenforceable for any reason and the developer declines to comply voluntarily
with that condition, the site plan approval granted by this order shall become null and
void.
5. This order shall be recorded in the Public Records of St. Lucie County.
