PDS Order 18-065 SPMj-820185363 AN ORDER OF THE PLANNING & DEVELOPMENT SERVICES DIRECTOR GRANTING APPROVAL OF A MAJOR ADJUSTMENT TO A MINOR SITE PLAN TO BE KNOWN AS TRUE STONE MASONRY LOCATED AT 7324 COMMERCIAL CIRCLE, FORT PIERCE, FL WHEREAS, the St. Lucie County Planning and Development Services Director has reviewed the request for a Major Adjustment to Minor Site Plan submitted by True Stone Properties LLC., evaluated the comments of the St. Lucie County Development Review Committee on this application, and made the following determinations: The property owner, True Stone Properties LLC presented a petition for a Major Adjustment to a Minor Site Plan Permit for reuse of, and phased site improvements to support, an existing 6,000 sq. ft. light industrial structure as a specialty concrete product manufacturing, warehouse, and retail showroom facility in the IL (Industrial Light) Zoning District for the property located at 7324 Commercial Circle as legally described in Paragraph "B" and depicted on the attached map as Exhibit "A". 2. On November 13, 2018, the Board of County Commissioners approved Resolution 18-233, granting approval of a Conditional Use Permit for True Stone Masonry to operate a concrete product manufacturing business within an existing 6,000 sq. ft. structure on .69 acres of land located at 7324 Commercial Circle, within the Kings Highway Industrial Park. The site is located within the IL, Industrial Light Zoning District. 3. The scale of the existing development as originally constructed in the absence of site plan review, has been designated as a Minor Site Plan pursuant to Section 11.02.02 B. for purposes of reviewing the proposed reuse and site improvements related to parking, landscaping, buffering, and stormwater maintenance to the site. 4. The Development Review Committee has reviewed the Site Plan for the proposed Major Adjustment to Minor Site Plan and found it to meet the technical requirements of the St. Lucie County Land Development Code, with the proposed conditions, in satisfaction of the standards of review set forth in Section 11.02.07, Standards for Site Plan Review, of the St. Lucie County Land Development Code. 5. The Site Plan for the proposed Major Adjustment to Minor Site Plan encompasses detail of the pre-existing site adjustments and site improvements proposed in two (2) Phases to support the proposed use, in accordance with the approved Conditional Use Permit and provisions of PDS Order 18-042. Planning staff has performed a detailed analysis of the project and found it to be consistent with the St. Lucie County Land Development Code and Comprehensive Plan. The analysis is found in the Planning and Development Services memorandum titled True Stone Masonry Major Adjustment to Minor Site Plan (SPMj-820185363), dated November 29, 2018. 7. The proposed site plan adjustment will not have an undue adverse effect on adjacent property, the character of the neighborhood, traffic conditions, parking, utility facilities, or other matters affecting the public health, safety, and general welfare. 8. All reasonable. steps have been taken to minimize any adverse effect of the proposed project on the immediate surroundings through building design, site design, landscaping and screening. 9. The project is designed, and will be constructed and operated so as not to interfere with the development and use of neighboring property, in accordance with applicable district regulations. NOW, THEREFORE, BE IT ORDERED by the Planning and Development Services Director of St. Lucie County, Florida. A. Pursuant to Section 11.02.03 of the St. Lucie County Land Development Code, the Major Adjustment to Minor Site Plan to be known as True Stone Masonry is hereby approved as shown on the site plan drawings, attached as Exhibit "B", for the project prepared by Architectonic, Inc., revised through September 24, 2018 and date stamped received by the St. Lucie County Planning and Development Services Division on October 10, 2018, subject to the following conditions: Planning & Development Services Department — Planning Division Phase II site improvements incorporate required landscape terminal islands and interior vehicular use area landscaping in accordance with Section 7.09.04 C. within the St. Lucie County Land Development Code (LDC). Public Works Department - En ineerin Division 2. A directional sign is installed to identify public parking located beyond the entry gate. 3. Phase II improvements will be reviewed at time of submittal of Construction Plans for said improvements. Public Works Department — Water Quality Division 4. Phase II improvements will require filing of a stormwater management plan. SPMj-820185363 PDS Order 18-065 Page 2 of 7 Environmental Resources Department 5. Prior to the issuance of a Zoning Compliance for the manufacturing operation, the landscaping onsite shall be brought into compliance with the approved landscape plan. 6. The issuance of County development permit does not in any way create any rights on the part of the applicant to obtain a permit from a state or federal agency and does not create any liability on the part of the County if the applicant fails to obtain requisite approvals or fulfill the obligations imposed by a state or federal agency or undertakes actions that result in a violation of state or federal law. 7. All other applicable state or federal permits must be obtained before commencement of the development. B. The property on which this Major Adjustment to Minor Site Plan approval is being granted is described as follows: LEGAL DESCRIPTION LOT 7, BLOCK D, KINGS HIGHWAY INDUSTRIAL PARK UNIT ONE, ACCORDING TO THE MAP OR PLAT THEREOF, AS RECORDED IN PLAT BOOK 26, PAGE(S) 16 AND 16A, OF THE PUBLIC RECORDS OF ST. LUCIE COUNTY, FLORIDA. Containing +/-.69 acres. Parcel ID#: 1335-801-0043-000-4 Location: 7324 Commercial Circle C. The approvals granted by this administrative order shall expire on December 7, 2020, unless a building permit or Zoning Compliance is issued or an extension is granted in accordance with the provisions of Section 11.02.06 of the St. Lucie County Land Development Code. D. The developer is advised as part of this Major Adjustment to Minor Site Plan, including any successors in interest, the developer shall obtain all applicable development permits and construction authorizations from the appropriate State and Federal and local regulatory agencies including, but not limited to, the United States Army Corps of Engineers, the Florida Department of Environmental Protection, and South Florida Water Management District, and the St. Lucie County Environmental Resources and Building Departments prior to the commencement of any development activities on the property described in Part B. Issuance of this permit by the County does not in any way create any rights on the part of the developer to obtain a permit from a state or federal agency and does not create any liability on the part of the County for issuance of this permit if the developer fails to obtain requisite approvals or fulfill the obligations imposed by a state or federal agency or undertake actions that may result in a violation of state or federal law. A copy of this Order shall be attached to the site plan drawings described in Part A, which plan shall be placed on file with the St. Lucie Planning and Development Services Director and mailed to the developer and agent of record as identified on the site plan applications. F The conditions set forth in Part A are an integral nonseverable part of the site plan approval granted by this Order. If any condition set forth in Part A is determined to be invalid or unenforceable for any reason and the developer declines to comply voluntarily with that condition, the site plan approval granted by this order shall become null and void. G. The Site Plan, attached as Exhibit B, shall be valid for the same period as this order. H. A Certificate of Capacity Exemption, attached as Exhibit "C", is provided in accordance with LDC Section 5.03.01. F. as the scope of the site plan adjustment does not create additional impact on public facilities. I. This order shall be recorded in the Public Records of St. Lucie County.
