HomeMy WebLinkAboutPDS-19-003 - 3803 Eleven MIle RdPDS NO. 19-003 File No. LS 1020185386 AN ORDER APPROVING LOT SPLIT FOR PROPERTY CONSISTING OF 34.72 ACRES LOCATED AT 3803 ELEVEN MILE ROAD WHEREAS, the St. Lucie County Planning and Development Services Director has reviewed the application for a Lot Split submitted by Michael T. Owen, on behalf of David and Linda Lloyd, and makes the following findings: 1. The Lot Split application has been approved for property consisting of 34.72 acres of property zoned AG 2.5 (Agricultural- 1 du/2.5 Ac) Zoning District, located on the west side of Eleven Mile Road and legally described as follows: See Exhibit "A" 2. The division of the parent tract creates two lots depicted on the Boundary Survey created by Michael T. Owen, PSM, February 6, 2019. 3. Staff has reviewed the lot split on the subject property and found it to meet technical requirements of the Code and the standards of review in Section 11.03.04.D of the St. Lucie County Land Development Code and to be consistent with the St. Lucie County Comprehensive Pan. 4. Staff has provided an analysis of the parcel's eligibility for a one-time split pursuant to Section 11.03.04 of the St. Lucie County Land Development Code. That analysis is found in the memorandum dated January 25, 2019 entitled Lloyd Lot Split, File No. LS 1020185386 NOW, THEREFORE, BE IT ORDERED: A. Pursuant to Section 11.03.04 of the St. Lucie County Land Development Code, the Lloyd Lot Split is hereby approved by the Planning and Development Services Director as shown on the boundary SLirvey prepared by Michael T. Owen, PSM, revised February 6, 2019 subject to the following conditions: 1. Section 11.03.04 F of the Land Development Code provides that no further division is permitted unless a final record plat is prepared and submitted in accordance with the Code. 2. Prior to issuance of a Vegetation Removal Permit or Exemption, and/or Building Permit, the recorded warranty deeds reflecting final division of the property describing the newly created parcels shall be provided to the Planning and Development Services Department. Within 90 days after receiving lot split approval or prior to the issuance of the Building Permit, whichever comes first, the applicant shall convey the required road right of way of 20 feet for Eleven Mile Road. Manner and form of conveyance shall be acceptable to the County Attorney. The sketch and legal description shall be prepared by a Florida licensed surveyor. B. St. Lucie County is not responsible for the maintenance, upkeep or improvement of any private drives, roads, streets, easements or rights -of -way providing ingress and egress or drainage service to the subject property herein. C. A copy of this Order shall be attached to the boundary survey described in hereinabove, and shall be placed on file in the Planning and Development Services Department. D.
