SMITH, CLERK OF THE CIRCUIT COURT SAINT LUCIE COUNTY FILE # 4537326 03/01/2019 0128:25 PM OR BOOK 4238 PAGE 2428 - 2430 Doc Type: ORD RECORDING: $27.00 PDS ORDER 19-005 File No.: WDA 1120185408 AN ORDER GRANTING APPROVAL TO ALLOW A VEHICULAR USE AND PARKING AREA TO BE CONSTRUCTED OF AN ALTERNATE PAVING MATERIAL (MILLINGS) SURFACE FOR THE PROJECT KNOWN AS RICHMOND HYDRAULICS WHEREAS, the St. Lucie County Planning and Development Services Director has reviewed the request for the vehicular use and parking area to be constructed of an alternate paving material (millings) and forwarded the request to the County Engineer for a recommendation for property located at 505 Angle Road and made the following determinations: 1. On August 1, 1990, the Board of County Commissioners of St. Lucie County, Florida, adopted the St. Lucie County Land Development Code and has adopted amendments to the Land Development Code through certain ordinances. 2. On May 15, 2012, the Board of County Commissioners of St. Lucie County, Florida, adopted Ordinance 12-003 granting the Planning and Development Services Director the authority to make the determination after full analysis of all potential impacts that an alternate paving material (millings) surface is in compliance with the provisions of the Land Development Code and the St. Lucie County Comprehensive Plan. 3. On February 14, 2019, the County Engineer per Land Development Code, Section 7.06.02(B)(3) approved plans to construct a vehicular use and parking area with an alternative paving material (millings) for the subject property described in Part B. 4. The determination to allow a vehicular use and parking area to be constructed of an alternate paving material (millings) surface is consistent with the general purpose, goals, and objectives of the St. Lucie County Comprehensive Plan, the Land Development Code and Ordinance 12- 003, is in the best interest of the health, safety and public welfare of the citizens of St. Lucie County, Florida. 5. The Development Review Committee reviewed the request and Planning Staff has performed an analysis of the request to allow the vehicular use and parking area to be constructed of an alternate paving material (millings) surface is found in the Planning and Development Services Department memorandum entitled Richmond Hydraulics - Wavier, Deferrals & Alternatives (WDA-1120185408) dated February 19, 2019. 6. The proposed project will not have an undue adverse effect on adjacent property, the character of the neighborhood, traffic conditions, parking, utility facilities, or other matters affecting the public health, safety, and general welfare. The proposed project will be constructed, arranged, and operated so as not to interfere with the development and use of neighboring property, in accordance with St. Lucie County Land Development Code requirements. The requested administrative relief has met the standards of review as set forth in Section 10.01.02, St. Lucie County Land Development Code, and is not in conflict with the goals, objectives, and policies of the St. Lucie County Comprehensive Plan, because. - a) The granting of the requested administrative relief arises from the conditions that the property owner Bill Richmond improved the existing vehicular use area with millings; prior to receiving approval by the County Engineer, b) The granting of the requested administrative relief does not expand or intensify the use. The millings installed as a stabilization method over a portion of the previously existing stabilized soil vehicular use area. c) The granting of the requested administrative relief is to allow millings as an alternative material, providing a parking surface forcustomers; including a stabilized handicap parking space. d) The granting of the requested administrative relief does not authorize alterations within the right-of-way. NOW, THEREFORE, BE IT ORDERED: by the Planning and Development Services Director of St. Lucie County, Florida: A. Pursuant to Section 7.06.03 Administrative Relief of the Land Development Code for Richmond Hydraulics to allow for the vehicular use and parking area to be constructed of an alternate paving material (millings) surface is hereby approved. The site work shall be in conformance with the plans prepared by Velcon Engineering & Surveying, LLC, dated September 27, 2018 and date stamped November 13, 2018 by the Planning & Development Services Department, subject to the following conditions of approval. 1) The millings shall not be expanded or increase beyond the approved parking area. If the parking area is expanded, it would need to comply with the impervious surface materials found in Section 7.06.02 of the LDC. 2) The property may not be allowed any further variances or waivers without full compliance of all vehicular use area(s) and property access. B. The property on which this alternative paving material (millings) surface is being granted is described as follows: BEGINNING AT A CONCRETE MONUMENT MARKING THE INTERSECTION OF THE WESTERLY RIGHT-OF-WAY OF ANGLE ROAD AND NORTHERLY RIGHT-OF-WAY OF AVENUE "D", AS THEY NOW EXIST, RUN NORTH 43 DEGREES 11' 30" WEST ALONG SAID WESTERLY RIGHT-OF-WAY OF ANGLE ROAD 250 FEET; THENCE NORTH 89 WDA-1120185408 PDS 19-005 Page 2 of 3 DEGREES 55' 30" WEST, 360.65 FEET; THENCE SOUTH 0 DEGREES 15' 45" EAST, 182.05 FEET TO THE NORTHERLY RIGHT-OF-WAY OF AVENUE "D"; THENCE SOUTH 89 DEGREES 55' 30" EAST, 532.00 FEET ALONG SAID RIGHT-OF-WAY TO THE POINT OF BEGINNING. ALL OF THE ABOVE SITUATE IN THE NORTH '/z OF SECTION 8, TOWNSHIP 35 SOUTH, RANGE 40 EAST, ST. LUCIE COUNTY, FLORIDA. Parcel No. 2408-221-0001-000-4 C. The developer is advised as part of this Waiver, Deferral, and Alternative approval for Richmond Hydraulics including any successors in interest, the developer shall obtain all applicable development permits and construction authorizations from the appropriate State and Federal and local regulatory agencies including, but not limited to, the United States Army Corps of Engineers, the Florida Department of Environmental Protection, and South Florida Water Management District, and the St. Lucie County Environmental Resources and Building Departments prior to the commencement of any development activities on the property described in Part B. Issuance of this permit by the County does not in any way create any rights on the part of the developer to obtain a permit from a state or federal agency and does not create any liability on the part of the County for issuance of this permit if the developer fails to obtain requisite approvals or fulfill the obligations imposed by a state or federal agency or undertake actions that may result in a violation of state or federal law. D. The conditions set forth in Part A are an integral non -severable part of the Administrative Relief approval as granted by this Order. If any condition set forth in Part A is determined to be invalid or unenforceable for any reason and the developer declines to comply voluntarily with that condition, the administrative relief approval granted by this order shall become null and void. E. A copy of this order shall be attached to the drawings described in Part A, which plans shall be placed on file with the Planning and Development Services Director and mailed to the developer or agent of record as identified on the written request for administrative relief.
