HomeMy WebLinkAbout19-038RESOLUTION NO. 2019-38 A RESOLUTION AUTHORIZING AN EXCHANGE OF LAND BETWEEN ST. LUCIE COUNTY, FLORIDA AND TAYLOR (A PRIVATE OWNER) OF PROPERTY LOCATED IN ST. LUCIE COUNTY, FLORIDA; AUTHORIZING THE CHAIR OF THE COUNTY COMMISSION TO EXECUTE DEEDS AND OTHER INSTRUMENTS TO EFFECTUATE SAID EXCHANGE; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE WHEREAS, Taylor is the owner of property located on the East side of U.S. Highway 1, South of Easy Street, more particularly described in PART A below; and, WHEREAS, St. Lucie County is the owner of property located on the East side of U.S. Highway 1, South of Easy Street, more particularly described in PART B below; and, WHEREAS, Taylor has clear title to the property described below in PART A and has agreed to convey said property by Warranty Deed, free and clear of all encumbrances, to St. Lucie County; and, WHEREAS, the property described in PART A below is valued at $330,000 by Fuller- Armfield-Wagner and $350,000 by Callaway & Price, Inc.; and, WHEREAS, the property described in PART B below is valued at $375,000 by Fuller- Armfield-Wagner and $360,000 by Callaway & Price, Inc.; and, WHEREAS, the County and Taylor wish to exchange a portion of the County "D" property for Taylor "A" property; and, WHEREAS, the Board of County Commissioners of St. Lucie County Commission has determined that an exchange of a portion of County "D" property for Taylor "A" property serves a valid public purpose by providing for the expansion of an existing County storm water pond to accept storm water discharges from future Indian River Estates storm water projects and for future right-of-way for the north -south alternate road if the alternate is ever built for the citizens of St. Lucie County, Florida; and, WHEREAS, pursuant to Section 125.37, Florida Statutes, the Board of County Commissioners of St. Lucie County is authorized and empowered to exchange property described below in PART B for the property described below in PART A; and, WHEREAS, the Board of County Commissioners of St. Lucie County deems the above described exchange of property to be for public purpose and in the best interest of the citizens of St. Lucie County; and, Page 1 of 4 WHEREAS, the Board caused the above described exchange of property to be advertised for Public Hearing and said Public Hearing was held on March 5, 2019 pursuant to Section 125.37, Florida Statutes. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of St. Lucie County, Florida; Section 1: Exchange Authorized PART A LEGAL DESCRIPTION FOR TAYLOR PROPERTY TO BE EXCHANGED FOR COUNTY PROPERTY: Part of Parcel ID 3415-501-0009-000-4 The north half of Lot 6, Block 1, Model Land Company's Subdivision, Section 15, Township 36 South, Range 40 East as per plat thereof, recorded in Plat Book 1, Page 41, of the public records of St. Lucie County, Florida. Containing 4.247 acres more or less. LEGAL DESCRIPTION FOR COUNTY PROPERTY TO BE EXCHANGED FOR TAYLOR PROPERTY: Part of Parcel ID 3415-501-0009-010-7 That part of Lot 7, Block 1, THE MODEL LAND COMPANY SUBDIVISION of Section 15, Township 36 South, Range 40 East, according to the Plat thereof recorded in Plat Book 1, at Page 41, of the Public Records of St. Lucie County, Florida, being more particularly described as follows: COMMENCING at the Northwest corner of the Northeast % of said Section 15; thence South 00' 14' 33" East, 557.88 feet along the West line of the Northeast % of said Section 15; thence North 89' 46' 55" East, 78.00 feet to the East Right -of -Way line of U.S. Highway No. One and the POINT OF BEGINNING; thence South 00' 14' 33" East along said East Right -of -Way line 100.00 feet to a point on the South line of said Lot 7; thence North 89' 46' 55" East along said South line 561.56 feet; thence North 00' 11' 43" West, 357.25 feet; thence South 89' 45' 27" West, 557.06 feet to a point that is 4.80 feet East of the East Right -of -Way of U.S. Highway No. One; thence North 04' 03' 24" West, 72.10 feet to a point on the East Right -of -Way line of said U.S. Highway No. One; thence South 00' 14' 33" East 328.95 feet along the East Right -of -Way line of U.S. Highway No. One to the POINT OF BEGINNING. LESS AND EXCEPT the South 214.33' therefrom. Containing 1.754 acres more or less. The exchange is subject to: 1. The County and Taylor executing an Exchange Agreement. 2. The County obtaining a Title Insurance Commitment for the County parcel and the Taylor parcel. 3. The County obtain a Phase I Environmental Site Assessment of PART A certified to the County which reflects no evidence of hazardous waste contamination on PART A. 4. Taylor conveying PART A to the County by Warranty Deed free and clear of all liens and encumbrances, except taxes for 2019. 5. The County conveying PART B to Taylor by Warranty Deed free and clear of all liens and encumbrances, except taxes for 2019. 6. Each party shall provide the other party prior to closing a current Boundary Survey of the parcel being exchanged. Section 2: Authority of Board of County Commissioners The Chair of the Board of County Commissioners for St. Lucie County is hereby Page 3 of 4 authorized to execute any and all Deeds or other instruments necessary to effectuate the exchange authorized by this Resolution. Section 3: Severability In the event a Court of competent jurisdiction shall hold or determine that any part of this Resolution is invalid or unconstitutional, the remainder of the Resolution shall not be affected and it shall be presumed that the St. Lucie County Board of County Commissioners did not intent to enact such invalid or unconstitutional provision. It shall further be assumed that the Board of County Commissioners would have enacted the remainder of this Resolution without said invalid or unconstitutional provision, thereby causing said remainder to remain in full force and effect. Section 4: Effective Date This Resolution shall be effective upon adoption by the Board of County Commissioners for St. Lucie County.
