The Lot Split application has been approved for property consisting of 9.42 acres of property zoned RS 3 (Residential, single family- 3 du/ga) Zoning District, located on the east side of Hartman Road and legally described as follows: THE NORTH '/2 OF THE SOUTH '/z OF THE SW'/a OF THE NW'/a OF SECTION 17, TOWNSHIP 35S RANGE 40E SUBJECT TO ALL RIGHT-OF-WAY ACROSS OR OVER SAID LAND FOR DRAINAGE CANAL AND PUBLIC ROAD PURPOSES, AND ALSO SUBJECT TO ANY EASEMENTS OR RIGHTS -OF -WAY FOR ELECTRIC TRANSMISSION OR DISTRIBUTION LINES PARCEL ID: 2417-233-0001-000/9 2. The division of the parent tract creates two lots depicted on the Boundary Survey created by Kenneth J. Osborne, dated September 12, 2018 for the parent tract and November 13, 2018 for the newly created parcels. The two lots are further described on the boundary survey (consisting of two pages dated November 13, 2018). 3. Staff has reviewed the lot split on the subject property and found it to meet technical requirements of the Code and the standards of review in Section 11.03.04.D of the St. Lucie County Land Development Code and to be consistent with the St. Lucie County Comprehensive Pan. 4. Staff has provided an analysis of the parcel's eligibility for a one-time split pursuant to Section 11.03.04 of the St. Lucie County Land Development Code. That analysis is found in memorandum dated March 18, 2019 entitled Noelke Lot Split, File No. LS 1220185433. 5. Section 11.03.04.F of the Land Development Code provides that no further division is permitted unless a final record plat is prepared and submitted in accordance with the Code. NOW, THEREFORE, BE IT ORDERED: A. Pursuant to Section 11.03.04 of the St. Lucie County Land Development Code, the Noelke Lot Split is hereby approved by the Planning and Development Services Director as shown on the boundary survey prepared by Kenneth J. Section 11.03.04 F of the Land Development Code provides that no further division is permitted unless a final record plat is prepared and submitted in accordance with the Code. 2. Prior to issuance of a Vegetation Removal Permit or Exemption, and/or Building Permit, the recorded warranty deeds reflecting final division of the property describing the newly created parcels shall be provided to the Planning and Development Services Department. 3. Within 90 days after receiving lot split approval or prior to the issuance of the Building Permit, whichever comes first, the applicant shall convey the required road right of way of 20 feet for Hartman Road and 15 feet for S. 37th Street. Manner and form of conveyance shall be acceptable to the County Attorney. The sketch and legal description shall be prepared by a Florida licensed surveyor. Pursuant to Section 7.05.03 of the LDC, the applicant may be granted credits against road impact fees for Hartman Road. B. St. Lucie County is not responsible for the maintenance, upkeep or improvement of any private drives, roads, streets, easements or rights -of -way providing ingress and egress or drainage service to the subject property herein. C. A copy of this Order shall be attached to the boundary survey described in hereinabove, and shall be placed on file in the Planning and Development Services Department. D.
