LUCIE COUNTY, FLORIDA, APPROVING A VARIANCE PURSUANT TO SECTION 7.10.23.D.4. OF THE ST. LUCIE COUNTY LAND DEVELOPMENT CODE FROM VARIOUS REQUIREMENTS OF SECTION 7.10.23, TELECOMMUNICATIONS TOWER SITING, FOR A PROJECT TO BE KNOWN AS HARBOUR RIDGE CLUBHOUSE TOWER LOCATED AT 12600 HARBOUR RIDGE BOULEVARD WITHIN THE HARBOUR RIDGE PLANNED UNIT DEVELOPMENT ZONING DISTRICT ON CERTAIN PROPERTY SITUATED IN ST. LUCIE COUNTY, FLORIDA WHEREAS, the Board of County Commissioners of St. Lucie County, Florida, based on the testimony and evidence, including, but not limited to the application and the staff report, hereby makes the following determinations: Vertex Development, LLC and Harbour Ridge Yacht & Country Club, Inc. filed an application for a variance from certain provisions of the St. Lucie County Land Development Code, pursuant to Section 7.10.23.D.4., which provides in relevant part: "It is the County's intention that the requirements of this Section 7.10.23 shall not prohibit or have the effect of prohibiting the ability of a service provider to provide wireless services in violation of federal law. If an applicant maintains that compliance with one (1) or more of the provisions of this section will prohibit or have the effect of prohibiting the provision of wireless services in violation of federal law, the applicant may apply for a variance to be exempted from the requirements of one (1) or more provisions of this section for its proposed wireless telecommunications facility or tower." 2. The applicants submitted an application for a conditional use permit for the proposed tower simultaneously with this application for a variance. 3. Vertex Development, LLC and Harbour Ridge Yacht & Country Club, Inc. are requesting a variance from the 750 foot separation requirement in Section 7.10.23.0 of the St. Lucie County Land Development Code. The proposed tower will be within 750 feet of 17 habitable residential homes or vacant residential parcels. Pages 4.A.b. pages 13 - 14 of the agenda detail the separation of the proposed tower to specific residential properties. The closest home is 282.9 feet from the proposed tower. The variance needed ranges from 6.5 to 467.1 feet. 4. Vertex Development, LLC and Harbour Ridge Yacht & Country Club, Inc. are requesting a variance from the telecommunication tower setback requirement in Section 7.10.23.N of the St. Lucie County Land Development Code. The proposed 124 foot tower requires a setback from the property line of 110% of the fall radius or 136.4 feet. The proposed tower will be setback 124.1 feet from the south property line and 62.2 feet from the east property line. The JOSEPH E. The fall radius would not impact structures or public rights - of -way. 5. Section 7.10.23.0 of the St. Lucie County Land Development Code requires that the proposed tower be stealth since it is within a residential zoned district. Vertex Development, LLC and Harbour Ridge Yacht & Country Club, Inc. maintain that the proposed tower meets the definition of stealth contained in Section 2.00.00 of the St. Lucie County Land Development Code. In the alternative, the applicants request that the Board grants a variance to the requirement of a stealth tower. The proposed tower's design, as described within the application, is a 124' tall "unipole" with all antenna and wiring placed within the tower. The tower has an engineered break point at 48 feet with no more than four canisters of 12 feet each to accommodate up to four wireless carriers. There will be no antenna or wiring installed on the exterior of the tower, which would be painted grey to blend in with the sky, and have a diameter of approximately six feet at the base tapering to four feet at the top and will be a flagless, unlit pole (except as may be required by applicable FAA regulations). The compound containing the tower will be landscaped as described in the application. 6. Vertex Development, LLC submitted an affidavit from a licensed engineer with Verizon Wireless, which will be the main wireless provider on the tower, supporting its claim for a variance pursuant to Section 7.10.23.D.4. The County's engineering consultant, Omnicom Consulting Group, Inc., submitted a report and testified at the hearing, confirming the position of Vertex Development, LLC and Verizon Wireless' engineer with respect to wireless coverage in the Harbour Ridge community now and after the proposed tower would be constructed, and that there are no existing tower sites that could be used to address the coverage issues. 7. The St. Lucie County Planning and Development Services Division issued a staff recommendation for approval of the variance. 8. On May 7, 2019, this Board held a public hearing on the application, after publishing a notice of such hearing, installing a sign on property and notifying by mail all owners of property within 750 feet of the subject property. The Board passed a motion to continue the public hearing until its May 14, 2019, meeting. 9. On 'May 14, 2019 this Board conducted the public hearing on the application, at which all interested persons had an opportunity to be heard. The complete record of such hearing is available to the applicants and the public. 10. As reflected in the written agenda materials and testimony provided at the hearing, residents within the Harbour Ridge Planned Unit Development submitted comments either in objection to or in support of this location of the proposed tower. Residents supported generally the need for the tower to improve wireless communications services in the Harbour Ridge area, although many residents opposed the proposed location of the tower and indicated alternative locations would., be preferable. The Harbour Ridge Property Owners Association, Inc., which is the homeowner's association representing approximately 695 homeowners within the Harbour Ridge Planned Unit Development, issued a request for proposals to obtain a telecommunications tower to improve wireless coverage in the. Harbour Ridge area. The Harbour Ridge Property Owners Association, Inc. supports the application submitted by Vertex Development LLC and the proposed location for the tower on the Harbour Ridge Yacht & Country Club, Inc.'s property. 12. After consideration of the testimony and evidence presented during the public hearing, including the application, staff comments, staff reports and exhibits, public comments, and the standards of review for granting variances set out in Section 7.10.23.D.4 and Section 10.01.02, St. Lucie County Land Development Code, the Board of County Commissioners makes the following findings: The requested variance meets the standards of review as set forth in Section 7.10.23.D.4 and Section 10.01.02, St. Lucie County Land Development Code and is not in conflict with the goals, objectives, and policies of the St. Lucie County Comprehensive Plan, because a. There is a need for improved wireless coverage in the Harbour Ridge Planned Unii Development area, which the proposed tower will sufficiently address. b. A literal interpretation of and compliance with the provisions of Section 7.10.23.0 Table 7-40, Section 7.10.23.N and Section 7.10.23.0 will prohibit or have the effect of prohibiting the provision of wireless service in the Harbour Ridge Planned Unii Development area, in violation of Federal law. c. The granting of the variance will not be detrimental or injurious to surrounding properties, and will not endanger public safety. d. The granting of the variance will support the surrounding properties and public safety by improving wireless service in the area, including access to 911 and emergency services. c. The variance is the minimum variance that will make possible reasonable use of the land, building, and structures. Based on the conditions existing within the Harbour Ridge Planned Unit Development, alternative locations suggested by residents opposed to the tower at this location will require similar or greater variances to the requirements of the St. Lucie County Land Development Code, including to the requirement that a proposes tower be at least 750 feet from residential properties. d. The variance requested arises from a condition that is unique and peculiar to the la involved and that it is created by the conditions of this Code and not by the actions the property owner or applicant. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of St. Lucie County, Florida: A. The foregoing findings and determinations are hereby approved and adopted by the Board. F. This Order shall become effective upon the date indicated below. An appeal from the Board of County Commissioners' action may be processed within thirty (30) days in accordance with Section 11.11.02.F, of the St. Lucie County Land Development Code. G.
