A RESOLUTION APPROVING A VARIANCE FOR
CERTAIN PROPERTY LOCATED AT 5421 STATELY OAKS STREET, IN ST. LUCIE
COUNTY, FLORIDA
WHEREAS, the Board of Adjustment of St. Lucie County, Florida, based on the testimony and
evidence, including, but not limited to the staff report, has made the following determinations:
Petition of David & Susan Munyan for a variance from the minimum lot width established
by the Southern Oaks Estates Planned Unit Development (PUD). The applicants
propose a reduction in the required 100 ft. lot width by 12.42 ft. to a minimum width of
87.58 ft. for the subject 5-sided "pie shaped" lot, in order to construct a single-family
home at a 25 ft. setback distance (minimum for Southern Oaks Estates PUD) from the
front property line. St. Lucie County Land Development Code Section 2.00.00 requires
the main building (house) be behind the line of minimum lot width, or in this case where
this lot has a width of 100 ft.
2. On May 22, 2019, this Board held a public hearing on the petition, after publishing a
notice of such hearing, installing a sign on property and notifying by mail all owners of
property within 500 feet of the subject property.
3. After consideration of the staff comments and applicant's exhibits presented during the
public hearing, including the standards of review for granting variances set out in Section
10.01.02, St. Lucie County Land Development Code, the Board of Adjustment has made
the following determinations:
The requested variance has met the standards of review as set forth in Section
10.01.02, St. Lucie County Land Development Code and is not in conflict with the goals,
objectives, and policies of the St. Lucie County Comprehensive Plan, because the
following:
1)There was no objection from the Home Owners Association or the neighbors;
2)There will be no injury to property values or other properties in the
neighborhood, and;
3)The variance provides reasonable use of the property.
NOW, THEREFORE, BE IT RESOLVED by the Board of Adjustment of St. Lucie County,
Florida:
A. Petition of David and Susan Munyan for a variance from the provisions of the Southern
Oaks Estates — PUD Site Plan, which requires a minimum lot width of 100 ft. for all
residential lots within the development, to reduce the required lot width by 12.42 ft. to a
minimum width of 87.58 ft. for the subject 5-sided "pie shaped" lot, in order to construct a
single-family home at a 25 ft. setback distance (minimum for Southern Oaks PUD) from
the front property line. St. Lucie County Land Development Code Section 2.00.00
requires the main building (house) be situated behind the line of minimum lot width, or in

this case where this lot has a width of 100 ft. The petition site is located within the
Planned Unit Development (PUD) - Southern Oaks Estates Zoning District, for property
depicted on the attached map as Exhibit "A" and described as follows:

recorded in Plat Book 33, Page 12 of the Public Records of St. Lucie County,
Florida.
SAID SITE CONTAINING 0.57 ACRES, MORE OR LESS.

B. Based on the evidence presented, this variance is approved.
C. This variance shall expire twelve months from the date of adoption unless a building
permit is approved or an extension is granted in accordance with Section 10.01.06, of
the St. Lucie County Land Development Code
D. An appeal from the Board of Adjustment's action may be processed in accordance with
Section 10.01.07, of the St. Lucie County Land Development Code.
