A RESOLUTION OF THE ST. LUCIE COUNTY BOARD OF COUNTY COMMISSIONERS
SITTING AS THE COMMISSION OF THE ST. LUCIE COUNTY WATER AND SEWER
DISTRICT, TO APPROVE A REQUEST FROM THE CITY OF PORT ST. LUCIE TO
EXTEND POTABLE WATER SERVICE WITHIN THE DISTRICT'S UTILITY SERVICE
AREA; ESTABLISHING CONDITIONS FOR SUCH APPROVAL; AND PROVIDING FOR
AN EFFECTIVE DATE.
WHEREAS, the City of Port St. Lucie, Florida ("City") has requested the District to approve
the City's Utility Systems Department to extend potable water service to Liberty Tire Recycling,
Inc., located on 9675 Range Line Road, Port St. Lucie, Florida, PID # 4201-113-0001-010-6 and
PID #4201-113-0001-020-9 (the "Property"), which property lies within the District's exclusive
utility service area;
WHEREAS, pursuant to the Interlocal Agreement Providing for the acquisition of General
Development Utilities between the City and St. Lucie County, dated June 28, 1994 (the "Service
Area Agreement"), the City requires the approval of the District to provide potable water and
wastewater service to properties within the District's exclusive service area; and
WHEREAS, the District is amendable to providing such approval to the City for the
Property, subject to consent by the City to certain conditions to the approval;
NOW THEREFORE, BE IT RESOLVED by the Board of County Commissioners of St. Lucie
County, Florida, sitting as the Commission of the St. Lucie County Water and Sewer District
("District"):
Section 1. APPROVAL OF POTABLE WATER SERVICE TO THE PROPERTY. The District
approves the City providing potable water service to the Property within the District's exclusive
utility service area, subject to receipt from the City of written consent to the following conditions
precedent to the District's approval:
a. The approval is limited to potable water service only to the Property via the City's 16 -
inch potable water main located on the Property in an existing easement, and does
not approve extension of wastewater or reclaimed water service to the Property;
b. The City agrees that the approval does not serve to contract or otherwise alter the
District's exclusive utility service area as described in the Service Area Agreement, and
the City acknowledges and confirms that the Service Area Agreement remains in full
force and effect;
c. The City agrees that the District's approval to the City to provide utility service to the
Property does not extend consent to the City to provide utility service to any other
property within the District's exclusive utility service area without the District's
consent;
d. The City agrees that the District retains and reserves the right to construct water
mains, wastewater mains or reuse water mains which cross or parallel the City 16 -
inch water line to provide utility service to any customers and properties within the
District's utility service territory, other than to the Property.
Section 2. EFFECTIVE DATE. The Resolution shall be effective upon adoption.
Section 4. ADOPTION. After motion and second, the vote on this Resolution was as
follows:
