LUCIE COUNTY INTERNATIONAL AIRPORT CONDITIONAL USE AND MINOR ADJUSTMENT TO THE MAJOR SITE PLAN FOR THE PROJECT KNOWN AS THE FT. PIERCE AIR CENTER - WEST HANGARS WHEREAS, the St. Lucie County Planning and Development Services Director has reviewed the application for site plan approval and reviewed the comments of the St. Lucie County Development Review Committee on this application, and made the following determinations: 1. Pursuant to Section 3.3.122(7) of the St Lucie County Zoning Ordinance, effective July 1, 1984 and Section 3.01.03(W)(7)(a) of the St Lucie County Land Development Code effective August, 1 1990, the St Lucie County International Airport is considered to be an existing Conditional Use. 2. The Ft. Pierce Air Center has been operating as a Fixed Base Operations Center FBO on leased land since 1987. This FBO is located on the western side of the existing airport grounds. 3. On October 3, 2006, the St. Lucie County Board of County Commissioners approved Resolution 06-234, granting Ft. Pierce Air Center a Major Adjustment to an Existing Conditional Use and Major Site Plan for the project known as Ft. Pierce Air Center- West Hangars consisting of 71,600 square feet of hangar space and associated office space, including four (4) 14,000 sq. ft. hangars with office space and one (1) 15,600 sq. ft. hangar with office space. 4. The site being property located at the St Lucie County International Airport adjacent to Taxiway C8, in the U, (Utilities) Zoning District, at 3180 — 3190 Airmans Drive, Fort Pierce, Florida and described in Part B below and depicted on Exhibit A. 5. The applicant, Byte Me Transportation, has applied for a minor adjustment to the conditional use permit and major site plan to add 1,600 sq. ft. of office space to Hangars #4 and #5, totaling 3,6200 sq. ft., add four (4) 1,800 sq. ft. solar panel canopies over approved parking, and memorialize an extra 640 sq. ft. of space contained within Hangar #3 — previously built. 6. The Development Review Committee has reviewed the site plan for the proposed project and found, with the proposed conditions, it meets the technical requirements of the St. Lucie County Land Development Code and has satisfied the standards of review set forth in Land Development Code Sections 11.07.03-Standards for Review of Conditional Use Permits, PDS Order 19 — 036 SPMn — 6201925550 & CUMn-6201925551 Page 1 of 7 11.07.05 E. 2. - Adjustments to an Approved or Existing Conditional Use, and 11.02.07, Standards for Site Plan Review. 7. The project will not have an undue adverse effect on adjacent property, the character of the neighborhood, traffic conditions, parking, utility facilities, or other matters affecting the public health, safety, and general welfare. 8. Planning Staff has performed a detailed analysis of the project and determined it to be consistent with the St. Lucie County Land Development Code and Comprehensive Plan. The analysis is found in the Staff Report for the Ft. Pierce Air Center Hangars West — Minor Adjustment, dated August 26, 2019. 9. The applicant has applied for and received a Certificate of Capacity Exemption, a copy of which is attached to this order, as required under Chapter V, St. Lucie County Land Development Code. NOW, THEREFORE, BE IT ORDERED: A. Pursuant to Sections 11.07.05 and 11.02.04 of the St. Lucie County Land Development Code, the Minor Adjustment to an Existing Conditional Use and Major Site Plan proposed for the project known as Ft. Pierce Air Center -Hangars West is hereby approved as shown on the site plan drawings for the project prepared by The Velcon Group Inc., dated June 5, 2019, revised through August 15, 2019, and date stamped received by the St. Lucie County Planning and Development Services Director on August 15, 2019, subject to the following conditions: 1) Prior to the initiation of site development activities, the applicant shall relocate all impacted gopher tortoise burrows per Florida Fish and Wildlife Conservation Commission protocol. 2) Prior to issuance of a Certificate of Occupancy, all Category I listed invasive species shall be eradicated from the site. B. C. The developer is advised as part of this minor adjustment approval that the developer or any successor in interest shall obtain all applicable development permits and construction authorizations from the appropriate State and Federal and local regulatory agencies including, but not limited to, the United States Army Corps of Engineers, the Florida Department of Environmental Protection, and South Florida Water Management District, and the St. Lucie County Environmental Resources, Public Works and Building Departments prior to the commencement of any development activities on the property described in Part B. Issuance of this approval by the County does not in anyway create any rights on the part of the developer to obtain a permit from a state or federal agency and does not create any liability on the part of the County for issuance of this permit if the developer fails to obtain requisite approvals or fulfill the obligations imposed by a state or federal agency or undertake actions that may result in a violation of state or federal law. D. This Order shall become effective upon the date of approval indicated below. Should the property owner, developer or authorized agent wish to appeal any condition described in Part A above, all such appeals must be filed in writing with the County Administrator within 30 days of the rendering of this Order, as described in Section 11.02.04(B), St. Lucie County Land Development Code. Should an appeal to this Order be filed, no permitting reviews or further administrative action shall take place on the processing of this development project until the appeal is resolved. A copy of this Order shall be attached to the site plan drawings described in Part A, which plan shall be placed on file with the St. Lucie Planning and Development Services Director and mailed, return receipt requested to the developer and agent of record as identified on the site plan applications. F. The conditions set forth in Part Aare an integral nonseverable part of the site plan approval granted by this Order. If any condition set forth in Section A is determined to be invalid or unenforceable for any reason and the developer declines to comply voluntarily with that condition, the site plan approval granted by this order shall become null and void. G. The adjusted Major Site Plan, attached as Exhibit B, shall be valid for twenty-four (24) months, or for the same period as the original approval, unless extended in accordance with Section 11.02.06 B. of St. Lucie County Land Development Code. H. The Certificate of Capacity, attached as Exhibit C, shall be valid for the same period as this order. If this order expires or otherwise terminates, the Certificate of Capacity shall automatically terminate. This order shall be recorded in the Public Records of St. Lucie County.
