LUCIE COUNTY ADMINISTRATOR (HURRICANE DORIAN) WHEREAS, the St. Lucie County Administrator has made the following determinations: 1. Pursuant to Section 252.38, Florida Statutes, political subdivisions of the state have the power during a state of local emergency to provide for the health and safety of persons and property. 2. The Board of County Commissioners of St. Lucie County has adopted Resolution No. 00-277 authorizing the St. Lucie County Administrator and the St. Lucie County Public Safety Director to exercise certain emergency powers and authority during a local emergency. 3. The National Hurricane Center identified Hurricane Dorian as a hurricane and issued Hurricane Warnings for the east coast of Florida, including St. Lucie County. 4. The Governor of the State of Florida issued Executive Order 19-189 dated August 28, 2019, declaring a state of emergency for the entire State of Florida. 5. Executive Order 19-189, in accordance with Section 252.38, Florida Statutes, authorizes political subdivisions to take whatever prudent action is necessary to ensure the health, safety, and welfare of the community. 6. The presence of Hurricane Dorian placed St. Lucie County in a state of emergency. 7. On August 30, 2019, at 12:00 pm, the St. Lucie County Public Safety Director declared a state of local emergency (copy attached). 8. In order to respond to such emergency, upon this declaration, the County Administrator or his designee is authorized to initiate and take such actions authorized by Resolution No. 00-277 (copy attached) for and on behalf of the Board of County Commissioners during the term of such local state of emergency. 9. St. Lucie County (the "County"), owns and operates the Port of Fort Pierce located in St. Lucie County, Florida. 10. The County approved the establishment of general port fees for the Port of Fort Pierce. 11. Portions of the Bahamas have been devastated by Hurricane Dorian, requiring hurricane relief and recovery efforts. 12. St. Lucie County desires to support hurricane relief and recovery efforts by providing for an exemption from the payment of port fees for humanitarian relief from the Port JOSEPH E. NOW, THEREFORE, I am issuing the following Order: 1. Effective September 10, 2019 at 3:00 pm, the County's Port and Airport Director is authorized to provide an exemption from the payment of Port Fees for cargo ships providing humanitarian relief to the Bahamas from the Port of Fort Pierce at no cost or expense to the victims of Hurricane Dorian and where the Port Operator received no compensation for transporting the cargo. For purposes of this Order, humanitarian relief means a cargo operation conducted for the purpose of providing medical services or supplies, conducting search and rescue operations, transportation of individuals providing humanitarian relief services, evacuation assistance, transportation of food and water, and the transportation of other similar supplies or services to aid in Hurricane Dorian recovery efforts, at no cost or expense to the victims of Hurricane Dorian. Port Operators shall document all exempt cargo operations and shall report all exempt cargo operations to the Port of Fort Pierce as a part of their monthly reports. Port Operators shall be required to provide evidence, in a form and substance acceptable to the Port of Fort Pierce, that the requirements of this Order have been satisfied for each exempt cargo operation, which shall include, at a minimum, the cargo destination, name of the port operator, cargo information, the humanitarian relief to be provided and a signed statement from the Port Operator that the humanitarian relief is being provided at no cost or expense to the victims of Hurricane Dorian and that the Port Operator received no compensation for transporting the cargo. 2. McCulley Marine shall be granted temporary exclusive use of the North Dock for Bahamian Relief through October 1, 2019. 3. This Order shall automatically terminate upon a declaration terminating the state of local emergency or upon further Order of the County Administrator or the Board of County Commissioners. This Order may be modified at any time by subsequent Order of the County Administrator or the Board of County Commissioners. This Order may be extended in not more than seven (7) day increments by subsequent Orders issued by the County Administrator or the Board of County Commissioners. 4.
