HomeMy WebLinkAbout19-194RESOLUTION NO. 19-194 A RESOLUTION PROVIDING FOR AN EXEMPTION FROM PORT FEES FOR HUMANITARIAN CARGO TO THE BAHAMAS AND GRANTING TEMPORARY EXCLUSIVE USE OF THE NORTH DOCK TO MCCULLEY MARINE FOR BAHAMIAN HURRICANE RELIEF; PROVIDING FOR SEVERABILITY AND PROVIDING FOR AN EFFECTIVE DATE AND EXPIRATION DATE WHEREAS, the Board of County Commissioners of St. Lucie County, Florida, has made the following determinations: 1. St. Lucie County (the "County"), owns and operates the Port of Fort Pierce located in St. Lucie County, Florida. 2. The County approved the establishment of general port fees for the Port of Fort Pierce. 3. Portions of the Bahamas have been devastated by Hurricane Dorian, requiring hurricane relief and recovery efforts. 4. The Board of County Commissioners desires to support hurricane relief and recovery efforts by providing for an exemption from the payment of port fees for humanitarian relief from the Port of Fort Pierce for humanitarian cargo to the Bahamas and granting temporary exclusive use of the North Dock to McCulley Marine for Bahamian Relief. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of St. Lucie County, Florida: 1. Recitals. The foregoing recitals are true and correct and are expressly incorporated herein by reference and made a part hereof. 2. Fee Exemption. The Board of County Commissioners hereby approves an exemption from the payment of Port Fees for cargo ships providing humanitarian relief to the Bahamas from the Port of Fort Pierce at no cost or expense to the victims of Hurricane Dorian and where the Port Operator received no compensation for transporting the cargo. For purposes of this Resolution, humanitarian relief means a cargo operation conducted for the purpose of providing medical services or supplies, conducting search and rescue operations, transportation of individuals providing humanitarian relief services, evacuation assistance, transportation of food and water, and the transportation of other similar supplies or services to aid in Hurricane Dorian recovery efforts, at no cost or expense to the victims of Hurricane Dorian. Port Operators shall document all exempt cargo operations and shall report all exempt cargo operations to the Port of Fort Pierce as a part of their monthly reports. Port Operators shall be required to provide evidence, in a form and substance acceptable to the Port of Fort Pierce, that the requirements of this Resolution have been satisfied for each exempt cargo operation, which shall include, at a minimum, the cargo destination, name of the port operator, cargo information, the humanitarian relief to be provided and a signed statement from the Port Operator that the humanitarian relief is being provided at no cost or expense to the victims of Hurricane Dorian and that the Port Operator received no compensation for transporting the cargo. Section 3. Temporary Use of North Dock. McCulley Marine shall be granted temporary exclusive use of the North Dockfor Bahamian Relief through October 1, 2019. Section 4. Conflict. In the event of a conflict between this Resolution and any other Resolution, the provisions of this Resolution shall prevail. Section 5. Severability. If any section, paragraph, sentence clause or word of this Resolution is for any reason held by the Court to be unconstitutional, inoperative, or void, such holding shall not affect the remainder of this Resolution. Section 6. Effective Date/Expiration Date. Except as provided in Section 3, this Resolution shall be effective as of September 10, 2019 and shall expire on October 1, 2019.
