LUCIE COUNTY, FLORIDA, CLOSING, VACATING AND ABANDONING A PORTION OF A 54' RIGHT-OF-WAY KNOWN AS HURON AVENUE IN SAN LUCIE PLAZA UNIT ONE AS RECORDED IN PLAT BOOK 5, PAGE 57 OF THE PUBLIC RECORDS OF ST. LUCIE COUNTY, FLORIDA. WHEREAS, the Board of County Commissioners of St. Lucie County, Florida, has made the following determinations: 1 2 That Sections 177.101, 336.09 and 336.10, Florida Statutes, as amended, and Section 11.10.01 et. seq. of the St. Lucie County Land Development Code, provide that the County may adopt resolutions vacating plats in whole or in part, which are under the jurisdiction of the Board of County Commissioners of St. Lucie County, Florida. Pursuant to Plat Book 5, Page 57, known as San Lucie Plaza Unit One, St. Lucie County and the general public have a dedicated interest in the following described land: rasterly half of a 54.00 feet wide right of way situated in part of Chippewa Avenue, per San Lucie Plaza Unit One as recorded in Plat Book 5, Page 57, of the Public Records of St. Lucie County, Florida. Said right of way lying between St. Lucie Boulevard and Mark Twain Road (per Plat,) Industrial Avenue One (Field); said right of way being 54.00 feet wide (per Plat): Commencing at the Northwest corner of Block 62, of the aforesaid San Lucie Plaza Unit One also being the Point of Beginning, thence run South 00`4746" East, along the West line of Block 62, a distance of 900 feet to a point; thence South 89003'00" West, a 1 distance of 27.00 feet, to a point on the center line of Chippewa Avenue, of the aforesaid San Lucie Plaza Unit One, thence North 00`47'46" West, along the center line of the aforesaid Chippewa Avenue, a distance of 900.00 feet to the South right of way of Industrial Avenue One; thence South 89`03'00" West along the South right of way of Industrial Avenue One, a distance of 27.OQ feet to a Point of Beginning. and Above right of way contains 24,300.00 square feet or .056 acres, more or less One 54.00 feet wide right of way situated in part of Huron Avenue, per San Lucie Plaza Unit One, as recorded in Plat Book 5, Page 57, of the Public Records of St Lucie County, Florida. Said right of way lying between St. Lucie Boulevard and Mark Twain Road (per Plat) Industrial Ave One (Field); said right of way being 54.00 feet wide (per Plat): Commencing at the Northeast corner of Block 62, of the aforesaid San Lucie Plaza Unit One being the Point of Beginning; thence run South 00'47'46" East along the East line of Block 62, a distance of 900.00 feet, to a point; thence run North 89`03'00 East, a distance of 54.00 feet to a point on the West line of Block 61, of the aforesaid San Lucie Plaza Unit One thence North 00047'46" West; along the West line of the aforesaid Block 61, a distance of 900.00 feet to the South right of way of Industrial Avenue One; thence South 89`03'00" West, along the South right of way of Industrial Avenue One, a distance of 54 feet to the Point of Beginning. The above described right of way containing 48,600.00 square feet or 1.12 acres more or less. 2 3. A Notice of Intent to Abandon was advertised on March 15, 2019 and March 22, 2019 and no objections were received. 4. On June 4, 2019, the Board of County Commissioners approved Permission to Advertise a Public Hearing on July 2, 2019. 5. On June 12, 2019, property owners within 500 feet were notified and no objections were received. 6. On June 12, 2019, a Notice of Public Hearing was advertised in the St. Lucie News Tribune. 7. All relevant public utilities have been notified. Fort Pierce Utilities Authority has stated they are willing to consent to the abandonment if the property owners grant an Easement to Fort Pierce Utilities Authority. If the Board of County Commissioners recommend approval, the affected property owners will have forty-five (45) days to grant the Easement to Fort Pierce Utilities Authority. If the Easement is not granted within forty- five (45) days, the Board of County Commissioners will rescind approval of the abandonment. 8. County staff has reviewed the petition to abandon a portion of Huron Avenue and a portion of Chippewa Avenue. Staff does not recommended approval of Chippewa Avenue being abandoned because it would land lock one property owner. County staff has no objections to the proposed abandonment of a portion of Huron Avenue. 9. It is in the best interest of the public to vacate and abandon a portion of Huron Avenue in San Lucie Plaza Unit One more particularly described as follows: One 54.00 feet wide right of way situated in part of Huron Avenue, per San Lucie Plaza Unit One, as recorded In Plat Book 5, Page 57, of the Public Records of St. Lucie 3 County, Florida. Said right of way lying between St. Lucie Boulevard and Mark Twain Road (per Plat) Industrial Avenue One (Field); said right of way being 54.00 feet wide (per Plat): Commencing at the Northeast corner of Block 62, of the aforesaid San Lucie Plaza Unit One also being the Point of Beginning; thence run South 00'47'46" East along the East line of Block 62, a distance of 900.00 feet, to a point; thence run North 89°03'00" East, a distance of 54.00 feet to a point on the West line of Block 61, of the aforesaid San Lucie Plaza Unit One thence North 00'47'46" West; along the West line of the aforesaid Block 61, a distance of 900.00 feet to the South right of way of Industrial Avenue One; thence South 89'03'00" West, along the South right of way of Industrial Avenue One, a distance of 54 feet to the Point of Beginning.
