AN ORDER GRANTING APPROVAL OF A MINOR ADJUSTMENT TO A
MINOR SITE PLAN TO BE KNOWN AS FRANCESCHI MARBLE AND
GRANITE (FKA TERRA INTERNATIONAL), LOCATED AT 7361
COMMERCIAL CIRCLE, FORT PIERCE, FLORIDA
WHEREAS, the St. Lucie County Planning and Development Services Director has reviewed
the application for a minor adjustment to the minor site plan submitted by Richard K. Davis
Construction Corporation, on behalf of Franceschi Marble and Granite Inc. and reviewed this
application, and made the following determinations:
Richard K. Davis Construction Corporation filed an application, on behalf of Franceschi
Marble and Granite Inc., for a Minor Adjustment to the Minor Site Plan, for the addition
of a 6,000 square foot metal warehouse building, the addition of a one-in/one-out
driveway, and associated parking improvements, to be located at 7361 Commercial
Circle in the IL (Industrial, Light) Zoning District, as more particularly described in Part B
below and depicted on Exhibit A.
2. On June 14, 1993, St. Lucie County Community Development granted site plan
approval through CD Order 93-009, for a 17,920 square foot office and warehouse
project site, which project was formerly known as Terra International.
3. On August 22, 2012, through PDS Order 12-029, the St. Lucie County Planning and
Development Services Department granted approval of a WDA (Waivers, Deferrals,
and Alternatives), allowing for the fabrication of marble and granite countertops as a
permitted use within the IL (Industrial, Light) zoning district.
4. The Development Review Committee has reviewed the Minor Adjustment for the
proposed project pursuant to Land Development Code (LDC), Section 11.02.03 and
found it to meet the technical requirements of LDC Section 11.02.07 and is consistent
with the general purpose, goals, objectives, and standards of the St. Lucie County
Comprehensive Plan.
5. Planning staff has performed a detailed analysis of the project and found it to be
consistent with the St. Lucie County Land Development Code and Comprehensive
Plan. The analysis is found in the Planning and Development Services memorandum
titled Franceschi Marble and Granite (FKA Terra International) — Minor Adjustment to
Minor Site Plan (SPMn-1120185399), dated October 7, 2019.
6. The proposed site plan adjustment will not have an undue adverse effect on adjacent
property, the character of the neighborhood, traffic conditions, parking, utility facilities,
or other matters affecting the public health, safety, and general welfare.
7. All reasonable steps have been taken to minimize any adverse effect of the proposed
project on the immediate surroundings through building design, site design,
landscaping, and screening.

8. The project is designed, and will be constructed and operated so as not to interfere with
the development and use of neighboring property, in accordance with applicable district
regulations.
9. The project is to be served by adequate public facilities and services.
NOW, THEREFORE, BE IT ORDERED by the Planning and Development Services Director
of St. Lucie County, Florida.
A. Pursuant to Section 11.02.03(C) of the St. Lucie County Land Development Code, the
Minor Adjustment to the Minor Site Plan to be known as Franceschi Marble and
Granite (FKA Terra International) is hereby approved as shown on the site plan
drawings prepared by Richard K. Davis Construction Corporation, dated October 31,
2018 (Revised thru July 31, 2019) and date stamped received by the St. Lucie County
Planning and Development Services Department on September 6, 2019, subject to the
following conditions:
1. Prior to issuance of a Certificate of Occupancy all Category I listed invasive
species (i.e., carrotwood, Brazilian pepper, etc.) shall be eradicated from the site.
2. Prior to the issuance of a Certificate of Occupancy the two subject parcels shall
be combined via Unity of Title through the St. Lucie County Clerk of Court.
B. The property on which this Minor Adjustment to the Minor Site Plan is being granted is
described as follows:

ACCORDING TO THE PLAT THEREOF, AS RECORDED IN PLAT BOOK 32, PAGES
5 AND 5A OF THE PUBLIC RECORDS OF ST. LUCIE COUNTY, FLORIDA.

C. The approvals granted by this administrative order shall expire after twenty-four (24)
months from the date of this approval, unless a building permit is issued or an
extension is granted in accordance with the provisions of Section 11.02.06 of the St.
Lucie County Land Development Code.
D. The developer, including any successors in interest, is advised as part of this Minor
Adjustment, the developer shall obtain all applicable development permits and
construction authorizations from the appropriate state, federal, and local regulatory
agencies including, but not limited to, the United States Army Corps of Engineers, the
Florida Department of Environmental Protection, South Florida Water Management
District, the St. Lucie County Environmental Resources, Public Works, and Building
Departments prior to the commencement of any development activities on the property
described in Part B. Issuance of this permit by the County does not in any way create
any rights on the part of the developer to obtain a permit from a state or federal agency
and does not create any liability on the part of the County for issuance of this permit if
the developer fails to obtain requisite approvals or fulfill the obligations imposed by a

state or federal agency or undertake actions that may result in a violation of state or
federal law.
E. A copy of this Order shall be attached to the site plan drawings, which shall be placed
on file with the St. Lucie County Planning and Development Services Director and
copies provided to the developer and agent of record as identified on the site plan
application.
F. The conditions set forth in Part A are an integral non -severable part of the site plan
approval granted by this Order. If any condition set forth in Section A is determined to
be invalid or unenforceable for any reason and the developer declines to comply
voluntarily with that condition, the site plan approval granted by this order shall
become null and void.
G. A Certificate of Capacity, a copy of which is attached hereto as Exhibit B and made a
part hereof the Resolution, was granted by the Planning and Development Services
Department Director.
H. This order shall be recorded in the Public Records of St. Lucie County.
