WHEREAS, the St. Lucie County Planning and Development Services Director has reviewed the request for the vehicular use and parking area to be constructed of an alternate paving material (asphalt millings) and forwarded the request to the County Engineer for a recommendation for and made the following determinations: Wade Tindall, on behalf of Environmental Land Development, Inc., petitioned for administrative relief from the provisions of Section 7.06.02 of the St. Lucie County Land Development Code (LDC) to allow for the use of asphalt millings material as an alternate paving material surface for an existing on -site parking and vehicular use area for a property located at 201 Campbell Road, Fort Pierce. 2. The Development Review Committee reviewed the request and Planning Staff has performed a detailed analysis of the request to allow the vehicular use and parking area to be constructed of an alternate paving surface material (asphalt millings) is found in the Planning and Development Services Department memorandum entitled Environmental Land Development Shop - Request for Administrative Relief dated September 19, 2019. 3. Per Land Development Code Section 7.06.02(B)(3), the County Engineer reviewed the request for administrative relief to allow an alternate paving material surface and found it to be acceptable. 4. The determination to allow a vehicular use and parking area to be constructed of an alternate paving surface material (asphalt millings) is consistent with the general purpose, goals, objectives and policies of the St. Lucie County Comprehensive Plan and the Land Development Code. 5. The proposed project will not have an undue adverse effect on adjacent property, the character of the neighborhood, traffic conditions, parking, utility facilities, or other matters affecting the public health, safety, and general welfare. NOW, THEREFORE, BE IT ORDERED: by the Planning and Development Services Director of St. Lucie County, Florida: A. Pursuant to Section 7.06.03(B) of the St. Lucie County Land Development Code, the request for administrative relief is hereby approved as shown on the survey prepared by WDA-9201925595 PDS 19-039 Page 1 of 4 CivilSury Design Grounp, Inc., date stamped by the St. Lucie County Planning Division on April 11, 2019, subject to the following conditions of approval: The millings shall not be expanded or increased beyond the asphalt milling area represented in the above -mentioned survey. In the future, if the parking area is expanded, the site will need to be constructed with the required all-weather, impervious surface materials outlined in Section 7.06.02 of the St. Lucie County Land Development Code. 2. The property may not be granted any further requests for administrative relief under the St. Lucie County Land Development Code Section 7.06.03 without the vehicular use areas being in full compliance with St. Lucie County Land Development Code Section 7.06.02. B. The developer is advised as part of this Waiver, Deferral, and Alternative approval for Environmental Land Development, Inc., including any successors in interest, the developer shall obtain all applicable development permits and construction authorizations from the appropriate State and Federal and local regulatory agencies including, but not limited to, the United States Army Corps of Engineers, the Florida Department of Environmental Protection, and South Florida Water Management District, and the St. Lucie County Environmental Resources and Building Departments prior to the commencement of any development activities on the property described in Part B. Issuance of this permit by the County does not in any way create any rights on the part of the developer to obtain a permit from a state or federal agency and does not create any liability on the part of the County for issuance of this permit if the developer fails to obtain requisite approvals or fulfill the obligations imposed by a state or federal agency or undertake actions that may result in a violation of state or federal law. D. The conditions set forth in Part A are an integral non -severable part of the Administrative Relief approval as granted by this Order. If any condition set forth in Part A is determined to be invalid or unenforceable for any reason and the developer declines to comply voluntarily with that condition, the administrative relief approval granted by this order shall become null and void. E. A copy of this order shall be attached to the drawings described in Part A, which plans shall be placed on file with the Planning and Development Services Director and mailed to the developer or agent of record as identified on the written request for administrative relief.
