A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF ST. LUCIE COUNTY,
FLORIDA, CLOSING, VACATING AND ABANDONING A PORTION OF A 25' RIGHT-OF-WAY
KNOWN AS POINSETTA AVENUE ON THE REVISED PLAT OF THE TROPICS SUBDIVISION
RECORDED IN PLAT BOOK 6, PAGE 21 OF THE PUBLIC RECORDS OF ST. LUCIE COUNTY,
FLORIDA.
WHEREAS, the Board of County Commissioners of St. Lucie County, Florida, has made the
following determinations:

That Sections 177.101, 336.09 and 336.10, Florida Statutes, as amended, and Section
11.10.01 et. seq. of the St. Lucie County Land Development Code, provide that the County
may adopt resolutions vacating plats in whole or in part, which are under the jurisdiction
of the Board of County Commissioners of St. Lucie County, Florida.
Pursuant to Plat Book 6, Page 21, known as The Revised Plat of the Tropics Subdivision,
St. Lucie County and the general public have a dedicated interest in the following
described land:
Being all of Poinsetta Avenue, being 25 feet in width, between Lots 9 and
10 and N 1/2 of Lot 18 and all Lots 19 and Lot 20, Block 1 and Lots 16 and
17 and S 1/2 of Lot 18, Block 1, as shown on the Revised Plat of The Tropics
Subdivision recorded in Plat Book 6, Page 21.
3. A Notice of Intent to Abandon was advertised on May 22 and May 29, 2019 and no
objections were received.
4. On September 10, 2019, the Board of County Commissioners approved Permission to
Advertise a Public Hearing to be held on October 1, 2019 at 6:00 p.m. or as soon thereafter
as possible.
5. On September 13, 2019, property owners within 500 feet were notified and no objections
were received.
6. On September 18, 2019, a Notice of Public Hearing was advertised in the St. Lucie News
Tribune.
7. Fort Pierce Utilities Authority and AT&T/Bell South have provided written consent to the
abandonment. Florida Power & Light has stated they are willing to consent to the
abandonment if the property owner grants an Easement. If the Board of County
Commissioners recommend approval, the affected property owner will granted the
Easement to Florida Power & Light.
8. County staff has reviewed the petition and have filed no objections to the proposed
abandonment.
9. It is in the best interest of the public to vacate and abandon a portion of Poinsetta Avenue
on the Revised Plat of The Tropics Subdivision more particularly described as follows:
Being all of Poinsetta Avenue, being 25 feet in width, between Lots 9 and
10 and N 1/2 of Lot 18 and all Lots 19 and Lot 20, Block 1 and Lots 16 and
17 and S 1/2 of Lot 18, Block 1, as shown on the Revised Plat of The Tropics
Subdivision recorded in Plat Book 6, Page 21.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of St. Lucie
County, Florida:

Being all of Poinsetta Avenue, being 25 feet in width, between Lots 9 and
10 and N 1/2 of Lot 18 and all Lots 19 and Lot 20, Block 1 and Lots 16 and
17 and S 1/2 of Lot 18, Block 1, as shown on the Revised Plat of The Tropics
Subdivision recorded in Plat Book 6, Page 21.
Is hereby closed, vacated and abandoned.
