A RESOLUTION ALLOWING LINCOLN PARK MAIN STREET, A NOT
FOR PROFIT CORPORATION, THE USE OF SPACE AT THE
INTERMODAL TRANSIT FACILITY LOCATED AT 725 AVENUE D
AND NORTH 8T" STREET IN FORT PIERCE, FLORIDA IN
CONJUNCTION WITH ITS JAZZ ON MOORE'S CREEK EVENT;
PROVIDING FOR AN EFFECTIVE DATE
WHEREAS, Lincoln Park Main Street, ("LPMS"), a not for profit organization, has
requested the use of space at the St. Lucie County Intermoda) Transit Facility, 725 Avenue D and
North 8th Street in Fort Pierce, Florida, (the "Site"), in conjunction with its Jazz on Moore's Creek
events; and
WHEREAS, Section 125.38, Florida Statutes (2019) requires that any not for profit
organization wishing to use any real or personal property that may be owned by any county or
this state or by its board of county commissioners, for public or community interest and welfare,
may apply to the Board of County Commissioners for a conveyance or lease of such property; and
WHEREAS, Section 125.38 further provides that if it is determined by the Board of County
Commissioners that such property is required for such use and is not needed for County
purposes, the Board may allow the use of such property; and
WHEREAS, the LPMS and the County desires to make the subject property available to
LPMS for its Jazz on Moore's Creek events.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of St. Lucie
County, Florida:
i. The Board does hereby grant permission to LPMS to use the Site for the Jazz on Moore's
Creek events.
2. The term of this use shall begin retroactively on December 1, 2019 and run through and
including November 30, 2020, unless otherwise terminated.
After motion and second, the vote on this resolution was as follows:
