HomeMy WebLinkAboutPDS-19-049 - Carlton RoadPDS ORDER 19-049 FILE NO.: MH 11201925643 AN ORDER GRANTING APPROVAL FOR A CLASS A MOBILE HOME IN THE AG-5 (AGRICULTURAL - 5, 1 DU/5 AC) ZONING DISTRICT LOCATED ON CARLTON ROAD, PORT ST. LUCIE, FL. WHEREAS, the St. Lucie County Planning and Development Services Director has reviewed the request of James & Lisa Mowers and made the following determinations: James & Lisa Mowers presented an application to define a 24' X 52' Class A Mobile Home as a detached single family dwelling unit in the AG-5 (Agricultural — 5, 1 du/5 acres) Zoning District for the property described below and depicted on Exhibit "A". 2. On November 26, 2019, mail notices were sent to all owners of property within 500 feet of the subject property. Within (14) calendar days of mailing the notification, no written objections were received by the Planning and Development Services Department. 3. Staff performed analysis of the request and determined it to be consistent with Section 11.05.02. — Class A Mobile Home Permits, of the St. Lucie County Land Development Code. The analysis is found within the Planning and Development Services Department Memorandum titled James & Lisa Mowers — Class A Mobile Home Permit, dated January 7, 2020. NOW, THEREFORE, BE IT ORDERED: A. The St. Lucie County Planning and Development Services Director hereby approves the request of James & Lisa Mowers to permit a Class A Mobile Home as a guesthouse, on the property described in Part "B", subject to the following condition of approval: 1. Prior to issuance of a Certificate of Occupancy, all Category I invasive plants shall be removed. B. The property on which this Class A Mobile Home Permit is being granted is described as follows: Legal Description: Lot 7, Montoya 2 Estates, According to the Plat Thereof, As Recorded in Plat Book 41, Pages 15 and 15A, of the Public Records of St. Lucie County, Florida. Lot Area: 378, 843 Sq. Ft.; 8.72 Acres+/ - Street Address: 6105 Carlton Road, Port St. Lucie, Florida 34987 File No.: MH 11201925643 JOSEPH E. The developer, including any successors in interest, is advised as part of this Class A Mobile Home Permit approval, shall obtain all applicable development permits and construction authorizations from the appropriate state and federal and local regulatory agencies including, but not limited to, the United States Army Corps of Engineers, the Florida Department of Environmental Protection, and South Florida Water Management District, and the St. Lucie County Environmental Resources, Public Works, and Building Departments prior to the commencement of any development activities on the property described in Part B. Issuance of this permit by the County does not in any way create any rights on the part of the developer to obtain a permit from a state or federal agency and does not create any liability on the part of the County for issuance of this permit if the developer fails to obtain requisite approvals or fulfill the obligations imposed by a state or federal agency or undertake actions that may result in a violation of state or federal law. D. A copy of this Order shall be attached to the building permit, which shall be placed on file with the St. Lucie County Planning and Development Services Director. E.
