HomeMy WebLinkAboutPDS-19-053 - Aerex Industries (fka Tom Donnick)PDS Order 19-053 SPMj 11201926640 AN ORDER GRANTING A SECOND MAJOR ADJUSTMENT TO A MINOR SITE PLAN PROJECT TO BE KNOWN AS AEREX INDUSTRIES (FKA TOM DONNICK) WHEREAS, the St. Lucie County Planning and Development Services Director has reviewed the application for site plan approval and reviewed the comments of the St. Lucie County Development Review Committee on this application, and made the following determinations: 1. Aerex Industries applied for a second Major Adjustment to a Minor Site Plan, known as Aerex Industries, to add a 13,515 square foot manufacturing building, expand outside storage areas, reconfigure stormwater system, and enhance landscape screening at the existing 27,064 square foot manufacturing facility located at 3504 Industrial 27th Street, in the IL (Industrial, Light) Zoning District, and described in Part B below and identified in Exhibit A. 2. On March 22, 1988, the Board of County Commissioners approved Resolution 88-63 granting site plan approval for a project known as Tom Donnick Fabricated Metal Product Inc. located at the intersection of Industrial 25th Street and Industrial 27th Street. 3. On April 26, 1994, the Board of County Commissioners approved Resolution 94-074 granting a Major Adjustment to the Tom Donnick Fabricated Metal Products, Inc. site plan project for a 16,750 foot addition to an existing 9,228 square foot site plan project. 4. On January 25, 2016, the Planning Director approved PDS Order 16-007 granting a Major Adjustment to the Tom Donnick Fabricated Metal Products, Inc. site plan project to rename the project to Aerex Industries, add an 8,500 square foot building, and expand outside storage areas for the existing 27,064 square foot manufacturing facility. 5. The Development Review Committee has reviewed the proposed site plan for the project and found, with the proposed conditions, it meets the technical requirements of the St. Lucie County Land Development Code and has satisfied the standards of review set forth in Section 11.02.07, Standards for Site Plan Review, of the Land Development Code. The project will not have an undue adverse effect on adjacent property, the character of the neighborhood, traffic conditions, parking, utility facilities, or other matters affecting the public health, safety, and general welfare. 7. Planning Staff has performed a detailed analysis of the project and determined it to be consistent with the St. Lucie County Land Development Code and Comprehensive Plan. The analysis is found in the Staff Report for Major Adjustment to a Minor Site Plan to be known as Aerex Industries, dated December 30, 2019. 8. The applicant has applied for and received a Certificate of Capacity as required by Chapter V, St. Lucie County Land Development Code. NOW, THEREFORE, BE IT ORDERED: A. Pursuant to Section 11.02.03 of the St. Lucie County Land Development Code, the proposed Major Adjustment to the Minor Site Plan project to be known as Aerex Industries is hereby approved as shown on the site plan drawings for the project prepared by Engineering Design and Construction, Inc., as revised on December 12, 2019 and date stamped received by the St. Lucie County Planning Division on December 17, 2019, depicted on Exhibit B, subject to the following conditions: 1) Prior to the issuance of a building permit, constructability plans shall be submitted to the St. Lucie County Engineering Division for review and approval. 2) Prior to issuance of a Certificate of Occupancy for the expansion, a utility easement (Sketch and description) for the existing Fort Pierce Utilities Authority (FPUA) facilities (pad mounted transformer, underground primary line and the fiber optic cable) shall be prepared by the applicant or designee. 3) Prior to issuance of a Certificate of Occupancy, all Category I listed invasive plant species shall be eradicated from the site. [Land Development Code Section 7.09.05]. 4) Prior to issuance of a Vegetation Removal Permit or Exemption, an updated landscape plan including a 4 ft. hedge with a note to be maintained at 8 ft. tall screening the outdoor storage area from the southern property boundary consistent with LDC 7.10.18 and corrected total interior vehicular use area (IVUA) calculations to 103,017 square feet of IVUA with an associated 32 required trees satisfied via onsite preservation shall be provided for review and approval by Environmental Resources Department. PDS Order 19-053 SPMJ 11201925640 Page 2of7 5) Prior to issuance of a Vegetation Removal Permit or Exemption, a survey for gopher tortoises within the northern intact pine flatwoods area consistent with Florida Fish and Wildlife Conservation Commission guidelines shall be provided. If burrows are found to be present within 25 ft. of any construction activities, a relocation permit from Florida Fish and Wildlife Conservation Commission will be required prior to initiation of clearing activities. B. The property on which this Major Adjustment to a Minor Site Plan approval is being granted is described as follows: LOTS 2, 3, 16 AND 17 BLOCK 6, AIRPORT INDUSTRIAL PARK UNIT ONE, ACCORDING TO THE PLAT THEREOF RECORDED IN PLAT BOOK 20, PAGE 3, PUBLIC RECORDS OF ST. LUCIE COUNTY, FLORIDA. Address: 3504 Industrial 27th Street, Fort Pierce, FL 34946 Parcel ID#: 1429-502-0002-0005 C. The developer is advised as part of this major adjustment approval that the developer or any successor in interest shall obtain all applicable development permits and construction authorizations from the appropriate State and Federal and local regulatory agencies including, but not limited to, the United States Army Corps of Engineers, the Florida Department of Environmental Protection, United States Fish and Wildlife, and South Florida Water Management District, and the St. Lucie County Environmental Resources, Building, and Public Works Departments prior to the commencement of any development activities on the property described in Part B. Issuance of this approval by the County does not in any way create any rights on the part of the developer to obtain a permit from a state or federal agency and does not create any liability on the part of the County for issuance of this permit if the developer fails to obtain requisite approvals or fulfill the obligations imposed by a state or federal agency or undertake actions that may result in a violation of state or federal law. D. This Order shall become effective upon the date of approval indicated below. Should the property owner, developer or authorized agent wish to appeal any condition described in Part A above, all such appeals must be filed in writing with the County Administrator within 30 days of the rendering of this Order, as described in Section 11.02.04(B), St. Lucie County Land Development Code. Should an appeal to this Order be filed, no permitting reviews or further administrative action shall take place on the processing of this development project until the appeal is resolved. E. A copy of this Order shall be attached to the site plan drawings described in Part A, which plan shall be placed on file with the St. Lucie Planning and Development PDS Order 19-053 SPMJ 11201925640 Page 3of7 Services Director and mailed, return receipt requested to the developer and agent of record as identified on the site plan applications. F. The conditions set forth in Part A are an integral nonseverable part of the site plan approval granted by this Order. If any condition set forth in Section A is determined to be invalid or unenforceable for any reason and the developer declines to comply voluntarily with that condition, the site plan approval granted by this order shall become null and void. G. The adjusted Major Site Plan, attached as Exhibit B, shall be valid for twenty-four (24) months, unless a development permit is obtained or the authorization is extended in accordance with Section 11.02.06 B. of St. Lucie County Land Development Code. H. The Certificate of Capacity, attached as Exhibit C, shall be valid for the same period as this order. If this order expires or otherwise terminates, the Certificate of Capacity shall automatically terminate. I.
