LUCIE COUNTY GRANTING A MAJOR ADJUSTMENT TO A MAJOR SITE PLAN APPROVAL FOR A-1 ROOF TRUSSES EXPANSION (AKA A-1 ROOF TRUSSES) ON APPROXIMATELY 23.11 ACRES OF PROPERTY LOCATED GENERALLY AT 4451 ST. LUCIE BOULEVARD IN ST. LUCIE COUNTY, FL. WHEREAS, the Board of County Commissioners of St. Lucie County, Florida, based on the testimony and evidence, including but not limited to the staff report, has made the following determinations: 1. A-1 Roof Trusses, represented by Engineering Design & Construction, Inc., presented a petition for a Major Adjustment to a previously approved Major Site Plan known as A-1 Roof Truss to add 4.53 +/- acres and 71,890 sq. ft. of manufacturing space to the existing site. The expansion represents an 181,960 sq. ft. build -out with associated staging and loading areas on the site located generally at 4451 St. Lucie Boulevard in the IL (Industrial, Light) zoning district on approximately 23.11 acres of land as described in Part A. 2. On December 5, 2000, the Board of County Commissioners approved Resolution 00-136 granting Major Site Plan approval for A-1 Roof Trusses to construct a 151,900 square foot manufacturing plant. In 2002 the applicant constructed 100,150 sq. ft. of the approved roof truss manufacturing plant. 3. On March 23, 2016, the Planning & Development Services Director approved PDS Order 16-017, granting a Minor Adjustment to the existing Major Site Plan to construct a 9,920 sq. ft. two-story office, and 18,930 sq. ft. storage facility, utilizing originally authorized space. 4. On January 14, 2020, this Board held a public meeting on the petition. 5. The St. Lucie County Development Review Committee has reviewed the Major Adjustment to the Major Site Plan, as depicted on Exhibit C, for the project and found it to meet all technical requirements and to be consistent with the Future Land Use Map of the St. Lucie County Comprehensive Plan, subject to the conditions set forth in Part B of this Resolution. 6. The proposed project is consistent with the general purpose, goals, objectives, and standards of the St. Lucie County Land Development Code, the St. Lucie County Comprehensive Plan and the Code of Ordinances of St. Lucie County. The proposed project will not have an undue adverse effect on adjacent property, the character of the neighborhood, traffic conditions, parking, utility facilities or other matters affecting the public health, safety and general welfare. 8. All reasonable steps have been taken to minimize any adverse effect of the proposed project on the immediate vicinity through building design, site design, landscaping and screening. 9. The proposed project will be constructed, arranged and operated so as not to interfere with the development and use of neighboring property, in accordance with applicable district regulations. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of St. Lucie County, Florida: A. SUBJECT TO: ALL RESTRICTIONS, EASEMENTS RIGHT-OF-WAY RESTRICTIONS OF RECORDS. CONTAINING 18.590 ACRES, MORE OR LESS. Pursuant to Section 11.02.04 of the St. Lucie County Land Development Code, the proposed Major Adjustment to the existing Major Site Plan project to be known as A- 1 Trusses Expansion, as depicted in Exhibit C, is hereby approved as shown on the site plan drawings for the project prepared by Engineering Design & Construction, Inc., dated December 19, 2019 and date stamped received by the St. Lucie County Planning & Development Services Department on December 23, 2019, subject to the following conditions: Planning and Development Services — Planning Division 1. The property owner(s), the developer, his successors or assigns shall finalize the parcel combination or unity of title (Parcels 1432-221-0001-0006 & 1432-211- 0002-0002) prior to the issuance of a Certificate of Occupancy for the development. Prior to final site plan recording, the applicant shall provide a revised landscap plan relocating landscaping proposed within the future ROW donation for revie, and approval by the Environmental Resources Department. 3. Within 90 days of site plan approval, all Category I listed invasive plant species shall be eradicated from the site. [Land Development Code Section 7.09.05]. 4. Clearing activities will be performed outside of scrub jay nesting season (March 1- June 30). Public Works Department, Engineering & Water Quality Divisions 5. Prior to the issuance of a Certificate of Occupancy, the property owner(s), the developer, his successors or assigns, shall convey to St. Lucie County in a manner or form acceptable to the St. Lucie County Attorney, a five (5) ft. strip of land totaling +/- 1,551 square feet of right-of-way along Sapp Road (Parcel 1431- 114-0001-000-4), as depicted on the project site plan. The required sketch and legal description shall be prepared by a Florida licensed surveyor and mapper. 6. Prior to the issuance of a Certificate of Occupancy for the primary building expansion (51,200 sq. ft.) or August 31, 2020, whichever comes first, the property owner(s), the developer, successors or assigns, shall convey to St. Lucie County in a manner or form acceptable to the St. Lucie County Attorney, a thirty (30) ft. strip of land totaling +/- 20,013 square feet of right-of-way along St. Lucie Boulevard (1431-112-0001-000-8), as depicted on the project site plan. 7. Prior to the issuance of a Certificate of Occupancy, the property owner(s), the developer, his successors or assigns shall execute an agreement to pay a fee -in - lieu of construction for a concrete sidewalk along St. Lucie Boulevard and Sapp Road property lines, and remit required payment to the County. The acceptable method of payment shall be a certified check payable to St. Lucie County. C. The approvals and authorizations granted by this Resolution shall expire on January 14, 2022 unless a building permit is secured or a site plan extension is granted in accordance with Section 11.02.06(B)(2), St. Lucie County Land Development Code. D. The developer is advised as part of this Major Adjustment approval that the property owner(s), developer, etc. including any successors in interest, shall obtain all applicable development permits and construction authorizations from the appropriate State and Federal and local regulatory agencies including, but not limited to, the United States Army Corps of Engineers, the Florida Department of Environmental Protection, Florida Department of Transportation, South Florida Water Management District, and the St. Lucie County Environmental Resources, January 14, 2020 Resolution No. 2020-05 Page 4 File No.: SPMj-11201925641 Public Works, and Building Departments prior to the commencement of any development activities on the property described in Part A. Issuance of this permit by the County does not in any way create any rights on the part of the developer to obtain a permit from a state or federal agency and does not create any liability on the part of the County for issuance of this permit if the developer fails to obtain requisite approvals or fulfill the obligations imposed by a state or federal agency or undertake actions that may result in a violation of state or federal law. E. The conditions set forth in Part B are an integral non -severable part of the site plan approval granted by this Resolution. If any condition set forth in Part B is determined to be invalid or unenforceable for any reason and the developer declines to comply voluntarily with that condition, the site plan approval granted by this resolution shall become null and void. F. A Certificate of Capacity, a copy of which is attached hereto as Exhibit B and made a part hereof the Resolution, was granted by the Planning & Development Services Department Director on January 15, 2020. G. This Resolution shall become effective upon the date of recording. H. A recorded copy of this Resolution shall be attached to the site plan drawings described in Part B, which plan shall be placed on file with the St. Lucie County Planning & Development Services Department Director. I.
