AN ORDER GRANTING APPROVAL FOR A THREE
(3) YEAR DEFERMENT ALLOWING THE
CONSTRUCTION OF AN ALL-WEATHER
VEHICULAR USE AND PARKING AREA FOR THE
PROPERTY LOCATED AT 3500 S. US HIGHWAY 1,
FORT PIERCE.
WHEREAS, the St. Lucie County Planning and Development Services Director has reviewed the
request to defer the construction of an all-weather vehicular use and parking area in accordance
with the provisions for relief set forth in Land Development Code Section 7.06.03(A) for the property
located at 3500 S. US Highway 1, Fort Pierce and has made the following determinations:
Bill Huston, owner of Wildar, Inc., has been granted administrative relief to allow a three (3)
year deferment to construct an all-weather surface vehicular use and parking area in
accordance with the provisions of Section 7.06.00 — Off -Street Parking and Loading. The
subject property is located at 3500 S. US Highway 1 and consists of 3.20-acres, with a split
zoning of CG (Commercial, General) and IL (Industrial, Light).
2. On August 1, 1990, the Board of County Commissioners of St. Lucie County, Florida,
adopted the St. Lucie County Land Development Code and has adopted amendments to
the Land Development Code through certain ordinances.
3. On May 15, 2012, the Board of County Commissioners of St. Lucie County, Florida,
adopted Ordinance 12-003 granting the Planning and Development Services Director the
authority to allow certain on -site improvements, including the construction of an all-weather
vehicular use and parking area, to be deferred to a future date.
4. This request for Administrative Relief has met the provisions for relief set forth in LDC
Section 7.06.03(A). Staff has provided a written analysis that demonstrates the proposed
relief is based upon conditions that are unique and peculiar to the site conditions.
5. The Development Review Committee reviewed the request and Planning Staff performed
an analysis of the request for deferral of the construction of a vehicular use and parking
area. The analysis is found in the Planning and Development Services Department
memorandum entitled Wildar Golf Carts and Trailers — Request for Administrative Relief
(WDA-8201925581) dated February 7, 2020.
6. The proposed project will not have an undue adverse effect on adjacent property, the
character of the neighborhood, traffic conditions, parking, utility facilities, or other matters
affecting the public health, safety, and general welfare.

NOW, THEREFORE, BE IT ORDERED: BY THE PLANNING AND DEVELOPMENT SERVICES
DIRECTOR OF ST. LUCIE COUNTY, FLORIDA:
A. Pursuant to Ordinance 12-003 and the St. Lucie County Land Development Code, the
request from Bill Huston for administrative relief to defer the construction of a vehicular use
and parking area is hereby approved subject to the following conditions:
1. Within three (3) years from the date of this approval, all site improvements associated with
the vehicle parking and storage shall be complete.
2. Within one (1) year of this approval, the applicant shall obtain a Site Development Permit.
Construction for Phase I must be complete within (2) years. Phase I parking shall be
installed with an all-weather surface material approved by the County Engineer, with
required stormwater, associated landscaping, and certified. Parking shall not take place in
Phase II and Phase III until Phase I is complete.
a. Concurrent with the installation of the first row of parking, the eastern driveway and
gate located on Dickson Drive shall be removed and the right-of-way restored.
b. Concurrent with the installation of the first row of parking, the existing western
driveway on Dickson Drive shall be restored to the required width in accordance
with LDC Section 7.05.06.
c. The applicant is advised that prior to executing any work within the road -right-of-
way, a Right -Of -Way (ROW) Permit is required.
3. Within 60 days of this approval, a landscape plan consistent with LDC Section 7.09.00 shall
be submitted, displaying the phased installation of the landscape material as the site is
improved. Upon completion of each improvement phase, the property owner will be
required to schedule a landscape inspection with the Environmental Resources Department
(ERD) at 772-462-2526.
4. Prior to each Phase, the property owner shall submit construction plans for the vehicular
use areas to the County Engineer for review and approval.
5. If the applicant fails to complete the requirements of Phase I, the approval may be voided
within 30 days through written notice by the Planning and Development Services Director.
B. The property on which this deferment is being granted is described as follows:

C. The approvals and authorizations granted by this Order are granted to the applicant for the
purpose of obtaining construction authorizations or Zoning Compliance from St. Lucie
County.
D. The developer is advised as part of this approval for Wildar, Inc., including any successors
in interest, the developer shall obtain all applicable development permits and construction
authorizations from the appropriate State and Federal and local regulatory agencies
including, but not limited to, the United States Army Corps of Engineers, Florida
Department of Environmental Protection, South Florida Water Management District, and St.
Lucie County's Environmental Resources and Building Departments prior to the
commencement of any development activities on the property described in Part B.
Issuance of this approval by the County does not in any way create any rights on the part of
the developer to obtain a permit from a State or Federal agency and does not create any
liability on the part of the County for issuance of this approval if the developer fails to obtain
requisite approvals or fulfill the obligations imposed by a State or Federal agency or
undertake actions that may result in a violation of State or Federal law.
E. The conditions set forth in Part A are an integral non -severable part of the Administrative
Relief approval as granted by this Order. If any condition set forth in Part A is determined to
be invalid or unenforceable for any reason and the developer declines to comply voluntarily
with that condition, the Administrative Relief approval granted by this order shall become
null and void.
F. A copy of this Order shall be placed on file with the Planning and Development Services
Director and mailed to the developer or agent of record as identified on the written request
for administrative relief.
G. This Order shall be recorded in the Public Records of St. Lucie County.
