2. The findings in the St. Lucie County Declaration of Emergency are
incorporated herein; and
3. On March 16, 2020, President Donald J. Trump and the Centers for Disease
Control and Prevention ('CDC") issued the "15 Days to Slow the Spread" guidance advising
individuals to adopt far-reaching social distancing measures, such as avoiding gatherings
of more than 10 people, and in states with evidence of community spread, recommending
restrictions to certain establishments conducive to mass gatherings and congregations;
and
4. On March 29, 2020, the President extended such guidance to be in effect
until April 30, 2020; and
5. On March 24, 2020, the Governor of the State of Florida issued Executive
Order No. 20-83 directing the State Surgeon General and State Health Officer to issue a
public health advisory to all persons over 65 years of age and persons that have serious
underlying medical conditions that place them at high risk of severe illness from COVID-
19 urging them to stay home and to take such other measures as necessary to limit their

6. Pursuant to Executive Order No. 20-83, the Governor of the State of Florida
further directed the State Surgeon General and the State Health Officer to issue a public
health advisory providing that individuals should cease all social or recreational
gatherings of 10 or more people; and
7. On March 25, 2020, the State Surgeon General issued a Public Health
Advisory consistent with Executive Order 20-83; and
8. On March 25, 2020, the President of the United States declared that a major
disaster exists in the State of Florida as a result of COVID-19; and
9. On April 1, 2020, the Governor of the State of Florida issued Executive Order
20-91 directing senior citizens, individuals with a significant underlying medical condition,
and persons engaging in nonessential services or activities to stay at home.
10. On March 4, 2020 bids were received for the Bridge Repairs contract (Bid
No. 20-038) that includes repairs to the Keen Road Bridge over Taylor Creek and the
Taylor Dairy Road Bridge over FPFWCD Canal 1 "Bridge Repairs Project". Normal bid
procedures were followed, and the low bidder was Ferriera Construction, Inc. for
$515,422.33 (please see attached). CEI services for the Project were originally included in
an RFQ combining this Bridge Repair Project with the replacement of the Gordy Road
Bridge. The RFQ was postponed due to the public participation requirements and how
to meet those needs while meeting CDC guidelines for social distancing. In an effort to
keep the Bridge Repair project moving forward, the Engineer Division obtained a proposal
for CEI services from Culpepper & Terpening in the amount of $84,473.80 (please see
attached) and a proposal from Anderson Andre Consulting Engineers for geotechnical
services in the amount of $10,116.50 (copy attached). Both Culpepper & Terpening and
Anderson Andre have current contracts with the County to provide CEI and Geotechnical
Services, respectively. Engineering staff recommends that the County Administrator
proceed on an emergency basis to enter into work authorizations with Culpepper &
Terpening and Anderson Andre to perform CEI and Geotechnical Services on this

Agreement. Due to public health, safety and welfare concerns, Engineering staff
recommends that the bridge repairs commence immediately including construction CEI
and Geotechnical services.
11. Due to Executive Order 20-91, the Board has cancelled all public meetings
through April 30, 2020, including District public meetings. The next Board meeting is
currently scheduled for May 19, 2020 but may be pushed further delayed due to the
COVID-19 emergency.
12. The County has determined that public health, safety and welfare requires
that the County proceed with the Bridge Repairs project including construction and CEI
services before the next Board meeting.
13. Paragraph 2 of the St. Lucie County Declaration of Emergency provides that
the County Administrator may take all actions necessary and appropriate to protect
human life and prosperity, to the extent necessary to accommodate the emergency; and
NOW, THEREFORE, BE IT ORDERED AS FOLLOWS:
1. The determinations, orders, and declarations identified above are
incorporated herein.
2. 1 hereby authorize the County Administrator or designee to sign work
authorizations with Culpepper & Terpening and Anderson Andre
Consulting Engineers for CEI and Geotechnical Services, respectively, for the
Bridge Repair Project, as reviewed and approved by the County Attorney.
3. 1 hereby authorize the County Administrator or designee to award the bid
on the on the Bridge Repairs project to the low bidder Ferreira Construction
and further to sign a contract to construct the Bridge Repairs Project with
Ferreira Construction, as reviewed and approved by the County Attorney.
4. This Order, as set out above, shall be placed on the agenda of the next Board
of County Commissioners meeting for purposes of review and ratification.
Severability.

Any provision(s) within this Order that conflict(s) with any State or Federal law or
constitutional provision, or conflict(s) with or are superseded by a current or
subsequently -issued Executive Order of the Governor or the President of the United
States, shall be deemed inapplicable and deemed to be severed from this Order, with the
remainder of the Order remaining intact and full force and effect.
This Order is effective as of 8:00 a.m. ono%-L—day of April 2020. This Order will expire upon
the expiration of the existing State of Local Emergency, as same may be extended by
subsequent order or declaration, unless earlier terminated by subsequent Order.
Prior resolutions and emergency orders remain in force and effect unless modified or
superseded.
This Order shall be filed in the Office of the Clerk of the Circuit Court.

CEI Services for St. Lucie County Bridge Repairs

Project Description/Objectives:
Culpepper & Terpening, Inc. will provide CEI Services to St. Lucie County for the Keen Road over
Taylor Creek and Taylor Dairy Road over FPFWCD Canal 1 bridge repairs.
SCOPE OF SERVICES — Exhibit
The part-time CEI Services to be provided shall include the following scope.
Scope of Work:
Task #1- Preconstruction and Contract Administration
The Engineer will provide the following administrative services:
a. Engineer will schedule, coordinate, and conduct a pre -construction conference with all
required parties in attendance - virtual if required.
b. Engineer will review project specific permit requirements with the contractor and will monitor
the work to coordinate delivery of contractor work product including NPDES reports and as-
builts.
c. Engineer will review the storm water and erosion control plan to confirm the contractor has
addressed each feature and phase of construction and has provided a complete application
package to FDEP. The Engineer will require the contractor to maintain a copy of the plan
and permit readily accessible to project personnel or an official desiring to review the site.
d. The Engineer will monitor the submittal/shop drawing process. Engineer will provide the
follow up needed to assure the reviews are completed timely.
e. Engineer will work with the contractor to identify and answer Requests for Information
(RFIs). The Engineer will log all RFIs received from the contractor
f. Engineer will utilize the pay item list to process monthly progress estimates. Engineer will
confirm all quantities requested for payment and confirm the contractor's tabulation includes,
amount requested, pervious payments and amount retained. The Engineer will assure the
contractor provides partial releases from its subcontractors and suppliers and will produce a
written recommendation for each partial payment.
g. If changes to the project scope are required, Engineer will negotiate fairly with the contractor
as needed to adjust the cost of the work. The Engineer will provide the County with a fully
detailed finding of fact, entitlement analysis, record of negotiation and amendment form.
Engineer personnel will support the Project Manager when the items are presented for
commission approval.

Task # 2- Construction Engineering and Inspection
The Engineer will perform the following Construction Engineering and Inspection Services:
a. The contractor is responsible for selecting the appropriate means and methods to complete
the work as described in the plans and specifications; while maintaining compliance with all
regulatory permits, and applicable state and federal laws. Engineer will inspect the work for
conformance with plans and specifications, document and advise the County of observed
violations, and will consult with the County regarding stop work orders if needed to correct
deficiencies in the contractor's operations.
b. Engineer will review sampling and testing of component materials and completed work in
accordance with the Construction Contract documents. The 1ngineer will provide surveillance
of the Contractor's Quality Control activities and review the sampling and testing of materials
and completed work items for verification and acceptance.
c. Engineer will verify that storm water controls are deployed in accordance with the approved
storm water plan. The Engineer will verify the contractor cleans and maintains the devices and
that maintenance inspections are performed weekly at a minimum and after each 1/2-inch
rainfall and the appropriate reports are completed. The Engineer will monitor flow patterns
to verity the control devices contain turbidity within the site and have not altered or impeded
existing drainage patterns or directed additional flow to adjacent properties.
d. Engineer will maintain a daily report of project activity. A report will be prepared for each day
that the inspector is onsite. The report will include documentation of weather conditions, and
contractor work activities. The written report will be supplemented with photographs as
needed. Progress photographs will be on a regular basis. Engineer shall also document if
weather has impacted the contractor's daily progress on a controlling item of work.
e. Engineer shall maintain a log or contract time (days) and track any additional contract time
that was credited due to inclement weather, additional work, etc.
f. Engineer will hold periodic progress meetings to coordinate project activities. Bi-weekly
meetings are anticipated but the frequency may be increased based on the scope of work and
the performance of the contractor. Engineer will document each meeting and provide notes
of the discussions to attendees and interested County staff. The meeting will typically review
progress to date and planned activities in the coming period, review the status of submittals
and RFIs, review pending traffic impacts, review and coordinate materials testing, review the
status of pending and upcoming payments, review and address third party coordination needed
by the County and permitting agencies.
g. Engineer will support the County's Public Information Officer (PIO) and provide
coordination of upcoming lane closings or work activities and will supply progress
photographs. The Engineer will escort County staff as needed to access different areas of the
project and describe work in progress.
h. Upon receipt of the contractor's notice the work is substantially complete; Engineer will
schedule and conduct an initial inspection of the project and will compile a punch list of
remaining work items and deficiencies. Once all items have been corrected the Engineer will
schedule and conduct a final inspection to confirm the project is complete and ready for
acceptance by the County. Engineer will prepare a recommendation of final acceptance for
the Project Manager and a letter of final acceptance for the contractor.

Task #3 Project Closeout
Engineer will document closing of all permits, prepare the contractor's final change order and
certificate of payment, initiate the warranty period and prepare a deliverable transfer of project
records to the County.
a. Engineer will verify the contractor has filed its notice of termination for the generic National
Pollutant Discharge Elimination System (NPDES) permit. A copy of the notice of termination
will be included in the file. If specific project permits are required any records required by the
permit will be transferred to the agency and Engineer will prepare the required Certificate of
Construction Completion. The Engineer will include agency personnel in all acceptance
inspections and document satisfaction of their punch list items through photographs and as-builts.
b. Engineer will obtain any warranty documents required from the contractor and will prepare a
warranty certificate initiating the warranty period. Engineer will review the contractor's as -built
drawings and will work with the contractor to complete revisions until the drawings accurately
reflect the as -built condition.
c. Engineer will prepare a close-out change order to zero -out the contract balance. The Engineer
will work with the contractor to obtain all final releases of liens required for final payment and will
prepare a recommendation of final payment.
d. Engineer will compile and transfer all required project documents in PDT' format.
Assumptions/Clarifications:
• As -built plans are to be performed by others.
• Testing and geotechnical consultation and reviews to be by others.
• Budget is based on contractor 40 hour work week for a construction duration of 17 weeks.
SCHEDULE — Exhibit B
Work will commence upon written notification to proceed (estimated May 2020). Invoices will be
submitted monthly. Duration of CEI services work is estimated as 21 weeks. All work shall be
completed no later than October 31, 2020.
COMPENSATION — Exhibit C
Services will be provided on a time & expense (unit rate) basis in accordance with Attachment A. The
estimated total fee is $84,473.80.
Authorization to work will be provided by St. Lucie County. Work will be performed under terms and
conditions of the St. Lucie County Contract.
