RESOLUTION NO. 20-03
A RESOLUTION OF THE BOARD OF THE ST. LUCIE TRANSPORTATION PLANNING
ORGANIZATION, HEREINAFTER "BOARD", AUTHORIZING THE EXECUTION OF A
METROPOLITAN PLANNING ORGANIZATION (MPO) AGREEMENT WITH THE FLORIDA
DEPARTMENT OF TRANSPORTATION, HEREINAFTER "FDOT", FOR THE RECEIPT OF FEDERAL
HIGHWAY ADMINISTRATION (FHWA) FUNDS.
WHEREAS, the BOARD is eligible to receive FHWA funds to undertake metropolitan planning
activities in the St. Lucie County portion of the Port St. Lucie Urbanized Area as authorized by
U.S. Department of Transportation regulations; and,
WHEREAS, the BOARD and FDOT have authority to enter into an agreement pursuant to 23 United
States Code (USC) 134, 23 Code of Federal Regulations (CFR) 450, and Section 339.175, Florida
Statutes (FS) which identifies the responsibilities for cooperatively carrying out the FHWA-funded portion
of the Metropolitan Planning Process and accomplishing the transportation planning requirements of
State and Federal law; and,
WHEREAS, FDOT requests the BOARD enter into the MPO Agreement to pass through financial
assistance through the FDOT in the form of FHWA funds to the BOARD for the completion of
transportation-related planning activities set forth in the Unified Planning Work Program (UPWP) of the
BOARD which is attached and incorporated into the MPO Agreement as Exhibit"A", state the terms and
conditions upon which FHWA funds will be provided, and set forth the manner in which work tasks and
subtasks within the UPWP will be undertaken and completed.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD THAT:
1. The BOARD's Registered Agent in Florida is the TPO Executive Director. The Registered Agent's
address is 466 SW Port St. Lucie Boulevard, Suite 111, Port St. Lucie, Florida, 34953.
2. The BOARD authorizes the TPO Executive Director to apply for FHWA funds.
3. The BOARD authorizes the TPO Executive Director to execute the MPO Agreement with FDOT
for the receipt of FHWA funds and any and all subsequent amendments to the MPO Agreement.
4. The BOARD authorizes the TPO Executive Director to execute any and all other subsequent
agreements or contracts which are required in connection with the application for and receipt of
FHWA funds.
5. The BOARD authorizes the TPO Executive Director to execute any and all assurances,
reimbursement invoices, warranties, certifications, and any other documents which may be
required in connection with the application for and receipt of FHWA funds.
