HomeMy WebLinkAboutPDS-20-032 - 7680 S US Hwy 1 PDS 2020-032 File No. CUMn-1202025668 AN ORDER GRANTING APPROVAL FOR A MINOR ADJUSTMENT TO CONDITIONAL USE PERMIT TO BE KNOWN AS CUBESMART (FKA TAYLOR RENTAL) FOR A PROPERTY LOCATED AT 7680 S US HIGHWAY 1, PORT ST. LUCIE, FL WHEREAS, the St. Lucie County Planning and Development Services Director has reviewed the application for a Minor Adjustment to the Conditional Use Permit submitted by Tropical South 7680 LLC and the Shields Family Partnership LLC, and the comments made by the St. Lucie County Development Review Committee on this application and has made the following determinations: 1. Tropical South 7680 LLC and the Shields Family Partnership LLC filed an application for a Minor Adjustment to the Conditional Use Permit to be known as Cubesmart (FKA Taylor Rental), for the a change in ownership. 2. On June 6, 2000, the Board of County Commissioners approved Resolution 00-016, granting a Conditional Use Permit, and Major Site Plan approval for a 68,815 sq. ft. mini- owarehouse and self-storage facility previously known as Taylor Rental, on approximately a; 3.92 acres of land as described in Part "B", within the CG (Commercial, General) Zoning H District. The St. Lucie County Development Review Committee has reviewed the proposed Minor 0 N Adjustment to the Conditional Use Permit and found it to meet the technical requirements o° F.4 of the St. Lucie County Land Development Code, and consistent with the St. Lucie County Comprehensive Plan, and has satisfied the standards of review set forth in Section ()Zo<0� 1-o a 11.02.07, Standards for Conditional Use Review, subject to the conditions set forth in Part "A" of this Order. The project will not have an undue adverse effect on adjacent property, the character of o a w " the neighborhood, traffic conditions, parking, utility facilities, or other matters affecting the �o� public health, safety, and general welfare. 5. All reasonable steps have been taken to minimize any adverse effect of the proposed project on the immediate vicinity through building design, site design, landscaping, and screening. 6. The project will be constructed, arranged, and operated so as not to interfere with the development and use of neighboring property, in accordance with applicable district regulations. 7. The project is to be served by the City of Port St. Lucie Utilities for water and wastewater services. 8. Planning Staff has performed detailed analysis of the project and determined it to be consistent with Sections 11.07.03 Standards for Review of Conditional Use Permits, of the St. Lucie County Land Development Code. The analysis is found in the Staff Report for the Cubesmart Minor Adjustment to the Conditional Use, dated May 27, 2020. Page 1 PDS No. 2020-032 File No.: CUMn-1202025668 9. A Certificate of Capacity Exemption has been issued for this development, a copy of which is attached to this order in Exhibit "C", as required under Chapter V, St. Lucie County Land Development Code. NOW, THEREFORE, BE IT ORDERED: A. Pursuant to Section 11.07.03 of the St. Lucie County Land Development Code, the Minor Adjustment to the Cubesmart Conditional Use Permit (FKA Taylor Rental) is hereby approved as shown on the boundary survey prepared by Bock & Clark Corporation dated June 16, 2018, and date stamped received by the St. Lucie County Planning and Development Services Department on January 17, 2020, as depicted in Exhibit "A" subject to the following conditions: 1. Within 90 days of conditional use approval, all invasive vegetation located within the property boundary shall be removed (Land Development Code Section 7.09.05). B. The property on which this Minor Adjustment to Conditional Use Permit, as depicted in Exhibit "B" is being granted is described as follows: LEGAL DESCRIPTION: FROM THE SOUTHEAST CORNER OF SECTION 22, TOWNSHIP 36 SOUTH, RANGE 40 EAST, RUN NORTH ON THE EAST SECTION LINE 665.26 FEET TO NORTHEAST CORNER OF LANDS DESCRIBED IN OFFICIAL RECORDS BOOK 465, PAGE 2640 FOR THE POINT OF BEGINNING; THENCE CONTINUE NORTH 393.97 FEET, MORE OR LESS, TO THE SOUTHEAST CORNER OF LANDS AS DESCRIBED IN OFFICIAL RECORDS BOOK 200, PAGE 430; THENCE SOUTHWESTERLY ALONG THE SOUTH LINE OF SAID LANDS 702.31 FEET, MORE OR LESS, TO THE EAST RIGHT OF WAY LINE OF U.S. HIGHWAY NO. 1; THENCE SOUTHEASTERLY ALONG SAID RIGHT OF WAY LINE 160 FEET, MORE OR LESS, TO THE NORTHWEST CORNER OF AFORESAID LANDS IN OFFICIAL RECORDS BOOK 465, PAGE 2640; THENCE EASTERLY ALONG THE NORTH LINE OF AFORESAID LANDS 582.59 FEET, MORE OR LESS, TO THE POINT OF BEGINNING. PARCEL ID No.: 3422-441-0003-000-1 C. The approvals granted by this administrative order shall expire twenty-four (24) months from the effective date, unless a Zoning Compliance is obtained or an extension is granted in accordance with the provisions of Section 11.02.06 of the St. Lucie County Land Development Code. D. The developer, including any successors in interest, is advised as part of this Minor Adjustment approval for Cube Smart (FKA Taylor Rental), all applicable development permits and construction authorizations shall be obtained from the appropriate State and Federal and Local regulatory agencies including, but not limited to, the United States Army Corps of Engineers, the Florida Department of Environmental Protection, and South Florida Water Management District, and the St. Lucie County Environmental Resources, Public Works, and Building Departments prior to the commencement of any development activities on the property described in Part "B". Issuance of this permit by the County does not in any way create any rights on the part of the developer to obtain a permit from a state or federal agency and does not create any liability on the part of the County for issuance Page 2 PDS No. 2020-032 File No.: CUMn-1202025668 • of this permit if the developer fails to obtain requisite approvals or fulfill the obligations imposed by a state or federal agency or undertake actions that may result in a violation of state or federal law. E. This Order shall become effective upon the date of approval indicated below. Should the property owner, developer or authorized agent wish to appeal any condition described in Part"A" above, all such appeals must be filed in writing with the County Administrator within 30 days of the rendering of this Order, as described in Section 11.02.04(B), St. Lucie County Land Development Code. Should an appeal to this Order be filed, no permitting reviews or further administrative action shall take place on the processing of this development project until the appeal is resolved. F. A copy of this Order shall be attached to the boundary survey described in Part "B", which plan shall be placed on file with the St. Lucie County Planning and Development Services Department and mailed to the developer and agent of record as identified on the site plan application. G. The conditions set forth in Part "A" are an integral non-severable part of the adjustment approval granted by this Order. If any condition set forth is Part "A" is determined to be invalid or unenforceable for any reason and the developer declines to comply voluntarily with that condition, the approval granted by this order shall become null and void.
