HomeMy WebLinkAboutPDS-20-028 - American Legion Post 318 PDS 2020-028 File No. SPMn-12201925656 AN ORDER GRANTING A MINOR ADJUSTMENT TO THE PREVIOUSLY APPROVED MINOR SITE PLAN FOR THE PROJECT KNOWN AS AMERICAN LEGION POST 318 LOCATED AT 1000 SAVANNA CLUB BLVD, PORT ST LUCIE, FLORIDA WHEREAS, the St. Lucie County Planning and Development Services Director has reviewed the application for a Minor Adjustment to the Minor Site Plan for American Legion Post 318 and comments of the Development Review Committee, and made the following determinations: 1. American Legion Post 318 presented a petition for a Minor Adjustment to the Minor Site Plan known as American Legion Post 318. The adjustment proposal includes a lot line adjustment to add a 0.56-acre recreation/special event area and two (2) metal storage sheds totaling 200 sq. ft. A future phase seeks to incorporate an overflow parking area in accordance with St. Lucie County Land Development Code (LDC). The subject property is located at 1000 Savanna Club Blvd, Port St Lucie, FL as described in Part B below. 2. On July 6, 2012, the St. Lucie County Growth Management Director, through PDS Order No. 12-026, granted approval for a Minor Site Plan known as American Legion Post 318. 3. On July 19, 2013, the Planning & Development Services Director, through PDS Order No. 13-022, granted approval for a Minor Adjustment to a Minor Site Plan to cover an existing 1,050 square foot patio to remain open air on three (3) sides. 4. The Development Review Committee has reviewed the Minor Adjustment pursuant to Land Development Code (LDC) Section 11.02.07, and found it to meet technical requirements and to be consistent with the general purpose, goals, and objectives, of the St. Lucie County Comprehensive Plan. 5. Planning Staff has performed a detailed analysis of the project and determined it to be consistent with the St. Lucie County Land Development Code and Comprehensive Plan. The analysis is located in the Planning and Development Services Department memorandum titled American Legion Post 318 SPMn-12201925656. 6. The proposed project will not have an undue adverse effect on adjacent property, the character of the neighborhood, traffic conditions, parking, utility facilities, or other matters affecting the public health, safety, and general welfare. 7. All reasonable steps have been taken to minimize any adverse effect of the proposed project on the immediate vicinity through site design, landscaping, and screening. 8. The proposed project will be constructed, arranged, and operated so as not to interfere with the development and use of neighboring property, in accordance with St. Lucie County Land Development Code requirements. Pursuant to Section 11.02.03(C) of the St. Lucie County Land Development Code, the Minor Adjustment is hereby approved as shown on drawing prepared by Engineering Design & Construction, Inc. dated September 17, 2019, revised March 10, 2020, and stamped received by the St. Lucie County Planning and Development Services Department on March 26, 2020, subject to the following conditions: Environmental Resources Department 1. Prior to issuance of a Certificate of Occupancy all Category I listed invasive species shall be eradicated from the site. Planning & Development Services Department 2. There shall be no live amplified music or entertainment on the recreational/special event area unless a Temporary Special Event Permit is obtained and approved by the St. Lucie County Planning and Development Services Department, Planning Division. The property owner shall make application for such permit at least one (1) month in advance of any event. Upon issuance of said permit, the property owner shall provide written notice to the Lake Lucie Estates HOA at least ten (10) calendar days in advance of an event. Such notice shall include the date, time, type, contact information, and purpose of the event. No event shall extend past 9:00 p.m. 3. In accordance to the St. Lucie County Land Development Code (LDC) Section 8.02.02, no more than four (4) events of seven (7) days each are to be conducted on the same property during any calendar year. 4. Within 30 days of Minor Adjustment approval, the applicant and/or property owners shall record a warranty deed reflecting a Unity of Title with the St. Lucie County Clerk of Court combining the portion of Lot 1, Savanna Plat #18 consisting of 0.56-acres, as a single lot of record. 5. Within 60 days of the issuance of a Vegetation Removal Permit to clear the existing vegetation, the applicant shall install an eight (8) ft. opaque wall along the northern property line of the subject property and associated landscaping per LDC 7.09.04.E. 6. Within 60 days of this approval, the applicant shall obtain a Building Permit to verify the existing 10ft. x 12ft. storage shed complies with the Commercial General setbacks and a Building Permit for the existing 8ft. x 10ft. metal storage shed. 7. There shall be no parking of vehicles on the recreation/special event space or any grass area, unless otherwise provided for by the St. Lucie County Land Development Code (LDC). All required off-street parking spaces shall be paved in accordance to LDC Section 7.06.02 (B)(3) or otherwise compliant with the LDC as adopted or revised. 8. There shall be no parking of vehicles along the Savanna Club Blvd Right-of-Way or within any required landscape buffer. 9. Any future development west of Savanna Plat #18 Lot 1 will require the removal of the fence blocking the 26-foot cross-access easement. Public Works Department 10. For future vehicular access and parking, a site improvement plan shall include but are not limited to off-street parking in accordance to the LDC Section PDS Order 2020-028 Page 2 File No SPMN—12201925656 7.06.00, landscaping and screening pursuant to the LDC Section 7.09.04, and stormwater management in accordance to the LDC Section 7.07.06 11. Future improvements shall include stormwater runoff management compliant with applicable codes and regulations. 12.The use of the unpaved parking area near the detention system shall be discontinued and grounds restored to comply with the LDC and approved site plan. B. The property on which this Minor Adjustment to the Minor Site Plan is being granted is described as follows: LEGAL DESCRIPTION: LOT 2, SAVANNA PLAT#18, ACCORDING TO THE PLAT THEREOF, AS RECORDED IN PLAT BOOK 63, PAGE 18, OF THE PUBLIC RECORDS OF ST. LUCIE COUNTY, FLORIDA. TOGETHER WITH NON-EXCLUSIVE EASEMENT RIGHTS, ACCORDING TO DECLARATION OF EASEMENT RECORDED IN OFFICAL RECORDS BOOK 1360, AT PAGE 2806, OF THE PUBLIC RECORDS OF ST. LUCIE COUNTY, FLORIDA. SUBJECT TO CONDITIONS, RESTRICTIONS, RESERVATIONS, LIMITATIONS, EASEMENTS AND DEDICATIONS OF RECORD AND TO TAXES FOR THE YEAR 2010 AND SUBSEQUENT YEARS THEREAFTER. The approvals granted by this administrative order shall expire 24 months from the effective date, unless a building permit is issued or an extension is granted in accordance with the provisions of Section 11.02.06 of the St. Lucie County Land Development Code. D. The developer, including any successors in interest, is advised as part of this Minor Adjustment, the developer shall obtain all applicable development permits and construction authorizations from the appropriate state, federal, and local regulatory agencies including, but not limited to, the United States Army Corps of Engineers, the Florida Department of Environmental Protection, South Florida Water Management District, the St. Lucie County Environmental Resources, Public Works, and Building PDS Order 2020-028 Page 3 File No.: SPMN—12201925656 Departments prior to the commencement of any development activities on the property described in Part B. Issuance of this permit by the County does not in any way create any rights on the part of the developer to obtain a permit from a state or federal agency and does not create any liability on the part of the County for issuance of this permit if the developer fails to obtain requisite approvals or fulfill the obligations imposed by a state or federal agency or undertake actions that may result in a violation of state or federal law. E. This Order shall become effective upon the date of approval indicated below. Should the property owner, developer or authorized agent wish to appeal any condition described in Part A above. all such appeals must be filed in writing with the County Administrator within 30 days of the rendering of this Order, as described in Section 11.02.03(B), St. Lucie County Land Development Code. Should an appeal to this Order be filed, no permitting reviews or further administrative action shall take place on the processing of this development project until the appeal is resolved. A copy of this Order shall be attached to the site plan drawing described in Part A, which plan shall be placed on file with the St. Lucie County Planning and Development Services Director and mailed to the developer and agent of record as identified on the application. F. The conditions set forth in Part A are an integral non-severable part of the minor adjustment granted by this Order. If any condition set forth is Part A is determined to be invalid or unenforceable for any reason and the developer declines to comply voluntarily with that condition, the site plan approval granted by this order shall become null and void. G. A Certificate of Capacity Exemption, a copy of which is attached hereto as Exhibit B and made a part hereof the Order, was granted by the Planning and Development Services Department Director, which shall remain valid for the period of Site Plan approval.
