A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF ST. LUCIE COUNTY
DESIGNATING PROPERTIES ON SEGMENTS OF SR-713/KINGS HIGHWAY CORRIDOR,
FROM NORTH OF 1-95 OVERPASS TO ST. LUCIE BOULEVARD AS ELIGIBLE TO APPLY
FOR "EMINENT DOMAIN WAIVERS," AS SPECIFIED IN ORDINANCE NO. 11-005.
WHEREAS, the Board of County Commissioners of St. Lucie County, Florida, adopted Ordinance No.
11-005 on February 1, 2011, which amended the St. Lucie County Land Development Code to
provide for eminent domain wavers, and added Section 10.03.00 "Eminent Domain Waiver," which
provides for the use of a waiver where an eminent domain action renders a site non-conforming.
WHEREAS, Ordinance No. 11-005 states "Sections 10.03.00 and 10.3.01 shall be applicable only after
the Board of County Commissioners adopts a resolution approving the use of eminent domain
waivers for specific public projects." The Florida Department of Transportation has a specific public
transportation project on SR-713/Kings Highway corridor from North of 1-95 Overpass to north of
Commercial Circle (FP#438379-1), continuing to north of St. Lucie Boulevard (FP#438379-2), which
necessitates the use of eminent domain action and requests that the following roadway segments be
designated as eligible to apply for eminent domain waivers:
FDOT Public Transportation Project
1. SR-713/Kings Highway from north of the 1-95 Overpass to north of Commercial
Circle.
2. SR-713/Kings Highway from north of Commercial Circle to St. Lucie Boulevard.
Based on testimony and evidence, including, but not limited to the staff report, the following
determinations have been made:
Properties located within the above referenced segment of SR-713/Kings Highway from north of the
1-95 Overpass to St. Lucie Boulevard should be eligible for eminent domain waivers.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of St. Lucie County,
Florida, that:
A. The Florida Department of Transportation has a public transportation project on SR-713/Kings
Highway from north of the 1-95 Overpass to north of Commercial Circle (FP#438379-1), continuing
to north of St. Lucie Boulevard (FP#438379-2), which requires the use of eminent domain actions.
This roadway segment is designated as a specific public project and properties within the
limits of this segment are eligible to use eminent domain waivers.
B. This Resolution shall be recorded in the Public Records.
C. After motion and second, the vote on this Resolution was as follows:
