WHEREAS, the St. Lucie County Planning and Development Services Director has reviewed the request for a Major Adjustment to the Minor Site Plan for the project known as Love's Travel Stop, the recommendation of the Development Review Committee, and has made the following determinations: 1. Greg Love, representing Love's Travel Stop& Country Store, Inc., presented a petition for a Major Adjustment to the Minor Site Plan known as Love's Travel Stop to expand an existing vehicle maintenance shop. The proposal includes a new 2,100 square foot pull- thru service bay and supplemental site improvements to include oil pits for the new and existing bay, a two thousand gallon oil waste tank, converting an existing oil waste tank to product oil, new light pole, and a new concrete parking island. The proposed addition will be adjoined to the north end of the existing maintenance building. 2. The Development Review Committee reviewed the proposed site plan for the project and found it meets the technical requirements of the St. Lucie County Land Development Code and has satisfied the standards of review set forth in Section 11.02.07, Standards for Site Plan Review, of the St. Lucie County Land Development Code. 3. Planning Staff has performed a detailed analysis of the project and determined it to be consistent with the St. Lucie County Land Development Code and Comprehensive Plan. The analysis is located in the Planning and Development Services Department memorandum titled Love's Travel Stop#467—Major Adjustment to Minor Site Plan(SPMj- 9201925597), dated July 8, 2020. 4. The proposed project will not have an undue adverse effect on adjacent property, the character of the neighborhood, traffic conditions, parking, utility facilities, or other matters affecting the public health, safety, and general welfare. 5. All reasonable steps have been taken to minimize any adverse effects of the proposed project on the immediate vicinity through building design, site design, landscaping, and screening. NOW,THEREFORE, BE IT ORDERED BY THE PLANNING AND DEVELOPMENT SERVICES DIRECTOR OF ST. LUCIE COUNTY, FLORIDA: SPMj-9201925597 PDS 2020-041 Page 1 of 5 A. Pursuant to Section 11.02.03 of the St. Lucie County Land Development Code, the Major Adjustment to the Minor Site Plan is hereby approved as shown on the site plan drawings prepared by Harrison French & Associates, date stamped by the Planning & Development Services Department on July 8, 2020, subject to the following conditions: 1. Prior to issuance of a Certificate of Occupancy/Completion, all Category I invasive plant species shall be eradicated from the site. B. The property on which this Major Adjustment to the Minor Site Plan is being granted is described as follows: LEGAL DESCRIPTION: A portion of the Southwest one-quarter of Section 12, Township 35 South, Range 39 East, St. Lucie County, Florida, being more particularly described as follows: Commencing at the Southwest corner of said Section 12, Thence North 89°40' 32" East, along the South line of said Section 12, a distance of 40.00 feet; Thence North 00°13' 52" West, along a line 40.00 feet East of and parallel with the west line of said Section 12 and the existing East Right-of Way of Kings Highway, a distance of 1476.04 feet to the POINT OF BEGINNING, Thence continue North 00°13' 52'West, along the last described course, a distance of 928.40 feet; Thence along the South line of the Parcels described in Official Records Book 240, Page 2529, of the Public Records of St. Lucie County, Florida, the following six (6) courses: North 89°39 16" East, a distance of 200.00 feet; Thence North 00° 13' 22" West, a distance of 133.00 feet; Thence North 89°38' 46" East, a distance of 56.61 feet; Thence South 67°09' 32" East, a distance of 177.67 feet; Thence South 59°02' 47" East, a distance of 165.29 feet; Thence South 48°36' 20" East, a distance of 1374.64 feet; Thence South 90° 00' 00" west, a distance of 1589.04 feet to the POINT OF BEGINNING. This Major Adjustment to the Minor Site Plan for Love's Travel Stop shall expire within twenty-four (24) months of the effective date of this Order, unless a building permit is issued or an extension is granted in accordance with Section 11.02.06, St. Lucie County Land Development Code. D. The developer is advised as part of this Major Adjustment approval for Love's Travel Stop including any successors in interest, the developer shall obtain all applicable development permits and construction authorizations from the appropriate State and Federal and local S P Mj-9201925597 PDS 2020-041 Page 2 of 5 regulatory agencies including, but not limited to, the United States Army Corps of Engineers, the Florida Department of Environmental Protection, and South Florida Water Management District, and the St. Lucie County Environmental Resources, Public Works and Building Departments prior to the commencement of any development activities on the property described in Part B. Issuance of this approval by the County does not in any way create any rights on the part of the developer to obtain a permit from a state or federal agency and does not create any liability on the part of the County for issuance of this permit if the developer fails to obtain requisite approvals or fulfill the obligations imposed by a state or federal agency or undertake actions that may result in a violation of state or federal law. E. A copy of this Order shall be attached to the site plan drawings described in Part A, which then shall be placed on file with the St. Lucie County Planning and Development Services Department and mailed to the developer and agent of record as identified on the site plan application. F. The conditions set forth in Part A are an integral non-severable part of the site plan approval granted by this Order. If any condition set forth in Part A is determined to be invalid or unenforceable for any reason and the developer declines to comply voluntarily with that condition, the site plan approval granted by this Order shall become null and void. G. A Certificate of Capacity, a copy of which is attached hereto as Exhibit B and made a part hereof the Order, was granted by the Planning and Development Services Department Director, which shall remain valid for the period of Site Plan approval.
