RECORDING: $61.00 PDS 2020-043 File No. SPMn-4202025733 AN ORDER GRANTING APPROVAL FOR A MINOR ADJUSTMENT TO A MAJOR SITE PLAN KNOWN AS PGA LEARNING CENTER FOR A PROPERTY LOCATED AT 8563 S COMMERCE CENTRE DRIVE, PORT ST. LUCIE, FL WHEREAS, the St. Lucie County Planning and Development Services Director has reviewed the application for Minor Adjustment to a Major Site Plan submitted by Cotleur& Hearing, on behalf of Common Wealth Trust Services, LLC, and the comments made by the St. Lucie County Development Review Committee on this application and has made the following determinations: 1. Cotleur & Hearing filed an application on behalf of Common Wealth Trust Services, LLC for a Minor Adjustment to the Major Site Plan known as PGA Learning Center to convert the existing 37,446 sq. ft. PGA Learning Center facilities to office suites, abandon the recreational golf use, eliminate undeveloped PGA Learning Center phases, and adjust an interior lot line to form a "Future Development Tract" on approximately 38.28 acres of land as described in Part "B", within the CG, Commercial General and PNRD, Planned Non- residential Development Zoning Districts. 2. On March 14, 1989, the Board of County Commissioners granted the Development Order for the Development of Regional Impact (DRI) known as The Reserve, encompassing the subject site. 3. On August 18, 1998, the Board of County Commissioners granted a sixth amendment to Resolution 89-73 the approved Development Order for The Reserve DRI through Resolution 98-100. 4. On June 28, 1999, the Board of County Commissioners granted a change in zoning from AR-1 (Agricultural, Residential - 1 du/ac) to PNRD (Planned Nonresidential Development) - 24.02 Acres, for a portion of POD 37B and Commercial Parcel 4, and Final Site Plan through Resolution 99-009 for the project known as PGA Learning Center @ PGA Villages at the Reserve. 5. On December 18, 2001, the Board of County Commissioners granted a Major Adjustment to the Major Site Plan to reconfigure the lot lines associated with the PGA Learning Center and a 9,000 square foot "Historical Center" addition at the PGA Learning Center. 6. On December 4, 2012, the Board of County Commissioners granted a tenth amendment to the amended Development Order approval for The Reserve DRI, via Resolution 12-004, which affirmed the DRI intensity as follows: 2,900 residential units; 500,000 square feet of industrial space; 150,000 square feet of retail/commercial use; 71,100 square feet of office space; 310 hotel rooms; 4 golf courses with accessory buildings and uses; and 1 PGA Learning Center.to the Major Site Plan to reconfigure the lot lines associated with the PGA Learning Center and a 9,000 square foot "Historical Center" addition at the PGA Learning Center. On March 20, 2020, the Planning & Development Services Director approved PDS Order 2020-021 which extended the Reserve DRI Development Order until May 18, 2021, in accordance with Florida Statute 252.363 and Executive Orders (EO) 19-189, 19-234, 19- 281 and 20-43. 8. The St. Lucie County Development Review Committee has reviewed the proposed Minor Adjustment to the Major Site Plan and found it to meet the technical requirements of the St. Lucie County Land Development Code, and to be consistent with the St. Lucie County Comprehensive Plan, and to have satisfied the standards of review set forth in Section 11.02.07, Standards for Site Plan Review, subject to the conditions set forth in Part "A" of this Order. 9. The proposed project will not have an undue adverse effect on adjacent property, the character of the neighborhood, traffic conditions, parking, utility facilities, or other matters affecting the public health, safety, and general welfare. 10. All reasonable steps have been taken to minimize any adverse effect of the proposed project on the immediate vicinity through building design, site design, landscaping, and screening. 11. The proposed project will be constructed, arranged, and operated so as not to interfere with the development and use of neighboring property, in accordance with applicable district regulations. 12. The proposed project is served by Reserve Utility Authority for water and wastewater services. 13. Planning Staff has performed a detailed analysis of the project and determined it to be consistent with Sections 11.02.04(C) and 11.02.07, Standards for Site Plan Review of the St. Lucie County Land Development Code, and generally consistent the exception to the conditions outlined below. The analysis is found in the Staff Report for the PGA Learning Center Minor Adjustment to Major Site Plan, dated July 14, 2020. NOW, THEREFORE, BE IT ORDERED: A. Pursuant to Section 11.02.04 of the St. Lucie County Land Development Code, the Minor Adjustment to the PGA Learning Center Site Plan is hereby approved as shown on the site plan drawings prepared by Cotleur & Hearing, overlaid onto the prior Thomas Lucido & Associates Plan, dated and date stamped received by the St. Lucie County Planning and Development Services Department on July 9, 2020, as depicted in Exhibit "A" subject to the following conditions: 1. All development activity on the subject parcels is subject to the applicable requirements of the final development order for the Reserve DRI/DO, last revised through Resolution 12-004, and as may be amended in the future. 2. Consistent with prior approvals, any future use proposed on "Lot 1", under the Planned Nonresidential Development zoning designation, shall be limited to those activities or operations of golf training and education center (no other unrelated commercial, residential or nonresidential use shall be permitted) unless this approval order is Page 2 PDS Order No. 2020-043 File No.: SPMn-4202025733 amended, consistent with applicable County codes, standards and Comprehensive Plan. 3. Prior to recording the concurrent Lot (Split) Line Adjustment/Minor Replat or any development approval for Lot 1 — whichever comes first, the applicant, assigns, or successor shall record a cross-access easement between proposed Lots 1 & 2, as referenced on the Site Plan Adjustment. 4. Prior to issuance of a Certificate of Occupancy all Category I listed invasive plants shall be eradicated from the site. B. The property on which this Minor Adjustment to Site Plan, as depicted in Exhibit"A" is being granted is described as follows: LEGAL DESCRIPTION: Commercial Parcel 3A, Second Replat of PGA Commerce Center at the Reserve, according to the Plat thereof as recorded in Plat Book 41, Page 10, of the Public Records of Saint Lucie County, Florida; and POD 37B, Second Replat of PGA Commerce Center at the Reserve, according to the Plat thereof as recorded in Plat Book 41, Page 10 of the Public Records of Saint Lucie County, Florida; PARCEL ID No.s: 3327-805-0002-000-8 & 3327-805-0001-000-1 C. The approvals granted by this administrative order shall expire twenty-four (24) months from the effective date, unless a Building Permit or Zoning Compliance is obtained or an extension is granted in accordance with the provisions of Section 11.02.06 of the St. Lucie County Land Development Code. D. The developer, including any successors in interest, is advised as part of this Minor Adjustment approval for the PGA Learning Center, all applicable development permits and construction authorizations shall be obtained from the appropriate State and Federal and Local regulatory agencies including, but not limited to, the United States Army Corps of Engineers, the Florida Department of Environmental Protection, and South Florida Water Management District, and the St. Lucie County Environmental Resources, Public Works, and Building Departments prior to the commencement of any development activities on the property described in Part B. Issuance of this permit by the County does not in any way create any rights on the part of the developer to obtain a permit from a state or federal agency and does not create any liability on the part of the County for issuance of this permit if the developer fails to obtain requisite approvals or fulfill the obligations imposed by a state or federal agency or undertake actions that may result in a violation of state or federal law. E. This Order shall become effective upon the date of approval indicated below. Should the property owner, developer or authorized agent wish to appeal any condition described in Part A above, all such appeals must be filed in writing with the County Administrator within 30 days of the rendering of this Order, as described in Section 11.02.04(B), St. Lucie County Land Development Code. Should an appeal to this Order be filed, no permitting reviews or further administrative action shall take place on the processing of this development project until the appeal is resolved. A copy of this Order shall be attached to the site plan drawings described in Part"A", which plan shall be placed on file with the St. Lucie County Planning and Development Services Department and mailed to the developer and agent of record as identified on the site plan application. G. The conditions set forth in Part "A" are an integral non-severable part of the site plan approval granted by this Order. If any condition set forth is Part "A" is determined to be invalid or unenforceable for any reason and the developer declines to comply voluntarily with that condition, the site plan approval granted by this order shall become null and void. H. A Certificate of Capacity, a copy of which is attached hereto as Exhibit "B" and made a part hereof the Order, was granted by the Planning and Development Services Department Director. I.
