AN ORDER GRANTING A PARTIAL LANDSCAPE
DEFERRAL FOR CERTAIN PROPERTY LOCATED AT
3504 INDUSTRIAL 27th STREET, FORT PIERCE, FOR A
PROJECT KNOWN AS AEREX INDUSTRIES
WHEREAS, the St. Lucie County Planning and Development Services Director has
reviewed the deferral request and reviewed the comments of the St. Lucie County
Development Review Committee on this application, and made the following
determinations:
1. The applicant, Aerex Industries Inc., filed a Landscape Deferral and Phasing Plan
request for the Major Adjustment to the Minor Site Plan granted via PDS 19-053.
2. On December 31, 2019, the Planning Director approved PDS Order 19-053 granting Aerex
Industries a second Major Adjustment to a Minor Site Plan to add a 13,515 square foot
manufacturing building, expand outside storage areas, reconfigure stormwater system,
and enhance landscape screening at the existing 27,064 square foot manufacturing
facility located at 3504 Industrial 271h Street, in the IL (Industrial, Light) Zoning District,
and described in Part B below and identified in Exhibit A.
3. The Development Review Committee has reviewed the proposed site plan for the
project and found, with the proposed conditions, it meets the technical requirements of
the St. Lucie County Land Development Code and intent of Ordinance 12-003.
4. The deferral and phasing plan will not have an undue adverse effect on adjacent
property, the character of the neighborhood, traffic conditions, parking, utility facilities,
or other matters affecting the public health, safety, and general welfare.
5. Planning Staff has performed a detailed analysis of the request and determined it to be
consistent with the St. Lucie County Land Development Code and Comprehensive
Plan. The analysis is found in the Staff Report for Aerex Industries — Landscape
Deferral & Concrete Phasing Plan for Expansion.
6. The applicant has an active Certificate of Capacity as required by Chapter V, St. Lucie
County Land Development Code.

NOW, THEREFORE, BE IT ORDERED:
A. The petition of Aerex Industries for a Waiver, Deferral or Alternative (WDA) pursuant to
Ordinance 12-003 for up to a two (2) year deferral of a defined portion of landscape
requirement and concrete phasing plan for the Major Adjustment to the Minor Site Plan
project known as Aerex Industries is hereby approved as shown on the deferral
drawings for the project prepared by Aerex Industries as depicted on Exhibit B, subject
to the following conditions-

onditions:1) Upon any development approval for the adjacent southern properties or
within 24 months of this approval, whichever occurs first, the applicant shall
install the southern perimeter landscaping as shown on the approved
Landscape Plan. All other landscaping as shown on the approved plans shall
be installed prior to issuance of the Certificate of Occupancy.
2) Each phase of concrete installation shall be permitted and inspected by the
St. Lucie County Building Division, and completed in accordance with the St.
Lucie County Stormwater Permit.
B. The property on which this deferral is being granted is described as follows:
LOTS 2, 3, 16 AND 17 BLOCK 6, AIRPORT INDUSTRIAL PARK UNIT ONE,
ACCORDING TO THE PLAT THEREOF RECORDED IN PLAT BOOK 20, PAGE 3,
PUBLIC RECORDS OF ST. LUCIE COUNTY, FLORIDA.

C. The developer is advised as part of this approval that the conditions of PDS Order 19-
053 remain active, and the developer or any successor in interest shall obtain all
applicable development permits and construction authorizations from the appropriate
State and Federal and local regulatory agencies including, but not limited to, the United
States Army Corps of Engineers, the Florida Department of Environmental Protection,
United States Fish and Wildlife, and South Florida Water Management District, and the
St. Lucie County Environmental Resources, Building, and Public Works Departments
prior to the commencement of any development activities on the property described in
Part B. Issuance of this approval by the County does not in any way create any rights
on the part of the developer to obtain a permit from a state or federal agency and does
not create any liability on the part of the County for issuance of this permit if the
developer fails to obtain requisite approvals or fulfill the obligations imposed by a state

or federal agency or undertake actions that may result in a violation of state or federal
law.
D. This Order shall become effective upon the date of approval indicated below. Should
the property owner, developer or authorized agent wish to appeal any condition
described in Part A above, all such appeals must be filed in writing with the County
Administrator within 30 days of the rendering of this Order, as described in Section
11.02.03(B), St. Lucie County Land Development Code. Should an appeal to this Order
be filed, no permitting reviews or further administrative action shall take place on the
processing of this development project until the appeal is resolved.
E. A copy of this Order shall be attached to the exhibits described in Part A, which plan
shall be placed on file with the St. Lucie Planning and Development Services Director
and mailed, return receipt requested to the developer and agent of record as identified
on the site plan applications.
F. The conditions set forth in Part A are an integral nonseverable part of the site plan
approval granted by this Order. If any condition set forth in Part A is determined to be
invalid or unenforceable for any reason and the developer declines to comply
voluntarily with that condition, the site plan approval granted by this order shall become
null and void.
G. The deferral and phasing plan, attached as Exhibit B, shall be valid for twenty-four(24)
months, unless a development permit is obtained or the authorization is extended in
accordance with Section 11.02.06 B. of St. Lucie County Land Development Code.
H. This order shall be recorded in the Public Records of St. Lucie County.
