A RESOLUTION PROVIDING FOR THE DONATION OF A PARCEL TO ARC
OF ST. LUCIE COUNTY, INC., A FLORIDA NON-PROFIT CORPORATION,
FOR THE CONSTRUCTION OF HOUSING OF DEVELOPMENTAL AND
INTELLECTUAL DISABILITIES PURSUANT TO SECTION 32-26(E), ST. LUCIE
COUNTY CODE OF ORDINANCES; PROVIDING AN EFFECTIVE DATE
WHEREAS, Subsection 197.502(7), Florida Statutes, provides that the Clerk of the Circuit Court
shall place any parcel which does not sell at a tax deed auction on the list of lands available for taxes; and,
WHEREAS, Subsection 197.502(8), Florida Statutes, provides that any parcel which remains on
the list of lands available for taxes three years after the date the land was offered for sale at a tax deed
auction shall escheat to the county in which the land is located; and,
WHEREAS, on July 27, 2018, a certain parcel of land identified with Parcel ID 3420-545-0549-000-
3 ('Subject Property") escheated to St. Lucie County pursuant to Subsection 197.502(8), by the
Escheatment Tax Deed recorded in Official Records Book 4168 at Page 499 in the public records of St.
Lucie County; and,
WHEREAS, the County has adopted an ordinance governing the declaration and disposal of
County -owned surplus property codified as Sections 32-24 and 32-26, St. Lucie County Code of
Ordinances; and,
WHEREAS, pursuant to Section 32-26(e), the County is authorized to convey surplus property,
regardless of appraised value, to another governmental entity or a charitable institution at a private sale
at such price as the Board of County Commissioners shall fix as set forth in a resolution; and,
WHEREAS, ARC of St. Lucie County, Inc., a Florida non-profit corporation, which provides services
to local residents has expressed a desire to acquire the Subject Property to be used for housing for adults
with developmental and intellectual disabilities; and,
WHEREAS, the Board of County Commissioners has determined that the proposed use of the
Subject Property will serve a public purpose for the residents of St. Lucie County.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of St. Lucie County,
Florida:
1. The Board does hereby donate all right, title and interest in the Subject Property, as
further described in the legal description attached hereto and incorporated herein as Exhibit "A" to ARC
of St. Lucie County, Inc. to be used for housing for adults with developmental and intellectual disabilities
pursuant to Section 32-26, St. Lucie County Code of Ordinances.
2. In the event the Subject Property is no longer used for housing for adults with
developmental and intellectual disabilities, title to the Subject Property shall revert to St. Lucie County.
3. This resolution shall take effect upon recording of this resolution and a County deed in
