HomeMy WebLinkAboutPDS-20-052 - Maverick Boat CompanyPDS ORDER 2020-052 File No.: SPMn-2202025685 AN ORDER GRANTING A MINOR ADJUSTMENT TO THE MAJOR SITE PLAN FOR THE PROJECT KNOWN AS MAVERICK BOAT COMPANY FOR PROPERTY LOCATED AT 4551 ST. LUCIE BOULEVARD WHEREAS, the St. Lucie County Planning and Development Services Director has reviewed the request for a Minor Adjustment to the Major Site Plan for the project known as Maverick Boat Company, the recommendation of the Development Review Committee, and has made the following determinations: Jim Leffew, of Maverick Boat Group Inc., and representative, Scott McGuire, P.E., of KMA Engineering & Surveying, LLC, filed an application requesting a Minor Adjustment to the Major Site Plan to amend the parking lot configuration for the existing boat manufacturing facility and phased build -out. This parking lot modification, titled Phase 1 B, seeks to add 130 parking spaces within a new Phase 1 B, providing 282 total parking spaces in Phase 1, with 378 parking spaces provided at build -out. The subject 36.33-acre property is located at 4551 St. Lucie Boulevard, Fort Pierce, within the IL (Industrial, Light) Zoning District. 2. On May 16, 2017, the Board of County Commissioners approved Resolution 2017-112, granting Major Site Plan Approval for the construction of a 252,500 sq. ft. (280,400 sq. ft. inclusive of covered areas) boat manufacturing facility, to be constructed in four (4) phases on approximately 36.33 acres of land as described in Part B, within the IL (Industrial Light) Zoning District, located at 4551 St. Lucie Boulevard. 3. On September 24, 2018, the Planning and Development Services Director granted approval of PDS 18-056 for a Minor Adjustment to the Major Site Plan to amend the parking configuration and access driveways to loading areas, reduce surplus (non - required) parking spaces, and correct minor errors within the site area data table. 4. The Development Review Committee reviewed the proposed Site Plan for the project and found it meets the technical requirements of the St. Lucie County Land Development Code and has satisfied the standards of review set forth in Section 11.02.07, Standards for Site Plan Review, of the St. Lucie County Land Development Code. Planning Staff has performed a detailed analysis of the project and determined it to be consistent with the St. Lucie County Land Development Code and Comprehensive Plan. The analysis is located in the Planning and Development Services Department memorandum titled Maverick Boat Company— Phase 1 B — MinorAdjustment to the Major Site Plan (SPMn-2202025685), dated August 6, 2020. 6. The proposed project will not have an undue adverse effect on adjacent property, the character of the neighborhood, traffic conditions, parking, utility facilities, or other matters affecting the public health, safety, and general welfare. All reasonable steps have been taken to minimize any adverse effects of the proposed project on the immediate vicinity through building design, site design, landscaping, and screening. NOW, THEREFORE, BE IT ORDERED BY THE PLANNING AND DEVELOPMENT SERVICES DIRECTOR OF ST. LUCIE COUNTY, FLORIDA: A. Pursuant to Section 11.02.04 and 11.02.07 of the St. Lucie County Land Development Code, the Minor Adjustment to the Major Site Plan is hereby approved as shown on the Site Plan drawings prepared by KMA Engineering & Surveying, LLC, revised through June 8, 2020, and date stamped by the Planning & Development Services Department on June 10, 2020, subject to the following conditions: Planning and Development Service Department, Planning Division 1) Prior to a Certificate of Occupancy for Phase II development as depicted on the Site Plan, the applicant shall install the ingress turn lanes (an eastbound right -turn lane and a westbound left -turn lane) within the right-of-way at the intersection of St. Lucie Boulevard and Hammond Road and modify the east driveway to provide exclusive left and right turn egress lanes in order to decrease the amount of internal queuing during the peak hours. 2) All boat manufacturing activities shall occur within an enclosed structure. Environmental Resources Department 3) Within 90 days of this Minor Adjustment approval, all Category I listed invasive species shall be eradicated from the site and landscaping shall be installed consistent with the Site Plan dated March 19, 2020 and approved by the Environmental Resources Department. 4) Prior to beginning site work, a vegetation permit application will be required to be submitted. Public Works Department, Water Quality Division 5) Prior to the issuance of a Building Permit for Phase 11 improvements as depicted on the Site Plan, off -site construction (engineering) plans shall be submitted to the Water Quality Division for review and approval. B. The property on which this Minor Adjustment to the Major Site Plan is being granted is described as follows: LEGAL DESCRIPTION: The northwest 1 /3, of the northeast 1 /3 of Section 31, Township 34 south, Range 40 east, LESS the north 98 feet lying in St. Lucie County, Florida. This Minor Adjustment to the Major Site Plan for Maverick Boat Group, Inc. shall expire within twenty-four (24) months of the effective date of this Order, unless a building permit is issued or an extension is granted in accordance with Section 11.02.06, St. Lucie County Land Development Code. D. The developer is advised as part of this Minor Adjustment to the Major Site Plan approval for Maverick Boat Group, Inc., including any successors in interest, the developer shall obtain all applicable development permits and construction authorizations from the appropriate State and Federal and local regulatory agencies including, but not limited to, the United States Army Corps of Engineers, the Florida Department of Environmental Protection, and South Florida Water Management District, and the St. Lucie County Environmental Resources Public Works and Building Departments prior to the commencement of any development activities on the property described in Part B. Issuance of this approval by the County does not in any way create any rights on the part of the developer to obtain a permit from a State or Federal agency and does not create any liability on the part of the County for issuance of this permit if the developer fails to obtain requisite approvals or fulfill the obligations imposed by a State or Federal agency or undertake actions that may result in a violation of State or Federal law. E. A copy of this Order shall be attached to the Site Plan drawings described in Part A, which then shall be placed on file with the St. Lucie County Planning and Development Services Department and mailed to the developer and agent of record as identified on the Site Plan application. F. The conditions set forth in Part A are an integral non -severable part of the Minor Adjustment to the Major Site Plan approval granted by this Order. If any condition set forth in Part A is determined to be invalid or unenforceable for any reason and the developer declines to comply voluntarily with that condition, the Site Plan approval granted by this Order shall become null and void. G. A Certificate of Capacity Exemption, a copy of which is attached hereto as Exhibit B and made a part hereof the Order, was granted by the Planning and Development Services Department Director, which shall remain valid for the period of Site Plan approval.
