Resolution 2020-197 File No. SPMj-10201925624 A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF ST. LUCIE COUNTY GRANTING A MAJOR ADJUSTMENT TO THE ST. LUCIE COUNTY CORRECTIONAL CENTER SITE PLAN TO ADD A VISITOR CENTER AND STORAGE WAREHOUSE TO THE COMPLEX SITUATED ON APPROXIMATELY 68.97 ACRES OF PROPERTY LOCATED GENERALLY AT 900 N ROCK ROAD IN ST. LUCIE COUNTY, FLORIDA. WHEREAS, the Board of County Commissioners of St. Lucie County, Florida, based on the testimony and evidence, including but not limited to findings in the staff report, has made the following determinations: 1. Stephen Cooper, PE, of Stephen Cooper PE &Associates, on behalf the St. Lucie County Sheriff's Office, presented a petition for a Major Adjustment to the existing Site Plan for the St. Lucie County Correctional Center to add a Visitors Center and Warehouse located within the I (Institutional) and U (Utilities) Zoning Districts on property located at 900 N Rock Road, as legally described in Part "A" and depicted on the attached map as Exhibit 2. The proposed Major Adjustment to the Major Site Plan adds a 7,200 sq. ft. visitor center, 27,094 sq. ft. warehouse to be utilized by the Sheriffs Office for evidence storage, support parking, and other site improvements to the existing 313,200 sq. ft. complex. 3. On October 6, 2020 this Board held a public meeting on the petition. 4. The St. Lucie County Development Review Committee has reviewed the Major Adjustment to the Major Site Plan, as depicted on Exhibit "B", for the project and found it to meet all technical requirements and to be consistent with the Future Land Use Map of the St. Lucie County Comprehensive Plan, subject to the conditions set forth in Part B of this Resolution. 5. The proposed project is consistent with the general purpose, goals, objectives, and standards of the St. Lucie County Land Development Code, the St. Lucie County Comprehensive Plan, and the Code of Ordinances of St. Lucie County. 6. The proposed project will not have an undue adverse effect on adjacent property, the character of the neighborhood, traffic conditions, parking, utility facilities, or other matters affecting the public health, safety, and general welfare. 7. All reasonable steps have been taken to minimize any adverse effect of the proposed project on the immediate vicinity through building design, site design, landscaping, and screening. 8. The proposed project will be constructed, arranged, and operated so as not to interfere with the development and use of neighboring property, in accordance with applicable district regulations. The property on which the Major Adjustment to Major Site Plan is being granted is described as follows: LEGAL DESCRIPTION BEING THE EAST HALF OF THE WEST HALF OF THE SOUTHEAST QUARTER OF THE NORTHWEST QUARTER AND THE EAST HALF OF THE SOUTHEAST QUARTER OF THE NORTHWEST QUARTER OF SECTION 11, TOWNSHIP 35 SOUTH, RANGE 39 EAST, LESS RIGHTS-OF-WAY FOR PUBLIC ROADS AND DRAINAGE CANALS. AND THE NORTHEAST QUARTER OF THE NORTHWEST QUARTER OF SECTION 11, TOWNSHIP 35 SOUTH, RANGE 39 EAST, LESS RIGHTS-OF-WAY FOR PUBLIC ROADS AND DRAINAGE CANALS. CONTAINING 68.974 ACRES MORE OR LESS. PARCEL IDENTIFICATION NUMBER: 2311-210-0000-000-6 ADDRESS: 900 N Rock Road, Fort Pierce, FL B. Pursuant to Section 11.02.04 of the St. Lucie County Land Development Code, the proposed Major Adjustment to the existing Major Site Plan project to be known as the St. Lucie County Correctional Center to add a 7,200 sq. ft. visitor center, 26,860 sq. ft. warehouse to be utilized by the Sheriff's Office for evidence storage, support parking and other site improvements, as depicted in Exhibit "B", is hereby approved as shown on the site plan drawings for the project prepared by Stephen Cooper, PE & Associates, dated August 2019, and date stamped received by the St. Lucie County Planning & Development Services Department on, July 16, 2020, subject to the following conditions: Planning and Development Services Department— Planning Division 1. Prior to the issuance of a Building Permit or within 90 days of site plan approval, whichever comes first, the developer shall pay a fee in lieu of construction of a sidewalk. The fee shall be based on an approved engineers estimate utilizing the unit cost provided by the Public Works Department. The acceptable method of payment shall be a certified check payable to St. Lucie County. Public Works Department 2. Prior to the issuance of a Certificate of Occupancy, the applicant shall submit an updated site plan identifying the 10-foot future Right-of-Way reservation line. Environmental Resources Department 3. Prior to issuance of a Certificate of Occupancy, all Category I listed invasive species shall be eradicated from the site. C. The approvals and authorizations granted by this Resolution shall expire on October 6, 2022 unless a building permit is secured or a site plan extension is granted in accordance with Section 11.02.06(6)(2), St. Lucie County Land Development Code. The owner(s), developer, etc. including any successors in interest are advised that the expiration date may differ from a corresponding Conditional Use Adjustment, where applicable. D. The developer is advised as part of this Major Adjustment approval that the property owner(s), developer, etc. including any successors in interest, shall obtain all applicable File No.: SPMj-10201925624 Resolution No. 2020-197 Page 2 development permits and construction authorizations from the appropriate State and Federal and local regulatory agencies including, but not limited to, the United States Army Corps of Engineers, the Florida Department of Environmental Protection, Florida Department of Transportation, South Florida Water Management District, and the Environmental Resources, Public Works, and Building Departments prior to the commencement of any development activities on the property described in Part A. Issuance of this permit by the County does not in any way create any rights on the part of the developer to obtain a permit from a state or federal agency and does not create any liability on the part of the County for issuance of this permit if the developer fails to obtain requisite approvals or fulfill the obligations imposed by a state or federal agency or undertake actions that may result in a violation of state or federal law. E. The conditions set forth in Part B are an integral non-severable part of the site plan approval granted by this Resolution. If any condition set forth in Part B is determined to be invalid or unenforceable for any reason and the developer declines to comply voluntarily with that condition, the site plan approval granted by this resolution shall become null and void. F. A Certificate of Capacity, a copy of which is attached hereto as Exhibit "C" and made a part hereof the Resolution, was granted by the Planning & Development Services Department Director on October 12, 2020. G. This Resolution shall become effective upon the date indicated below. An appeal of the Board of County Commissioners' action may be processed within thirty (30) days in accordance with Section 11.11.02.F, of the St. Lucie County Land Development Code. H. A recorded copy of this Resolution shall be attached to the site plan drawings described in Part B, which plan shall be placed on file with the St. Lucie County Planning & Development Services Department Director. I. This Resolution shall be recorded in the Public Records of St. Lucie County. J.
