AN ORDER GRANTING A MINOR SITE PLAN FOR THE PROJECT
KNOWN AS SERENITY AT THE PRESERVE LOCATED ON THE EAST
SIDE OF CARLTON ROAD, FORT PIERCE
WHEREAS, the St. Lucie County Planning and Development Services Director has reviewed the
request for a Minor Site Plan for the project known as Serenity at the Preserve, the
recommendation of the Development Review Committee, and has made the following
determinations:
1. Engineer Design & Construction, Inc., representing OSCO Holdings, LLC, presented a
petition for a Minor Site Plan known as Serenity at the Preserve to subdivide a +/- 300-
acre undeveloped site into seven (7) new agricultural/residential parcels consisting of Lot
1 (5.26-acres), Lot 2 (5.24-acres), Lot 3 (5.12-acres), Lot 4 (5.27-acres), Lot 5 (5.43-
acres), Lot 6 (148.68-acres), and Lot 7 (125-acres), to be located within the AG-5
(Agricultural — 1du/5ac) Zoning District.
2. On April 26, 2018, the St. Lucie County Planning and Development Services Director
approved PDS Order 2018-021 authorizing the Robert Teague Lot Split for an
approximately 320-acre property located on the east side of Carlton Road, creating Lot 1
(300 +/- acres) and Lot 2 (21.33 +/- acres).
3. On September 20, 2019, Jo Linn Osborn applied for a Minor Site Plan approval to create
nine (9) agricultural/residential parcels, including the previous Lot Split (Lot 1). The
project to be known as Serenity at the Preserve consists of two phases: Phase 1 includes
proposed Lot 2 (145 +/- acres) and proposed Lot 3 (125 +/- acres), Phase 2 includes
proposed Lots 4-9 (5 acres each). The subject 300 +/- acre property is located within the
AG-5 (Agricultural-5) Zoning District.
4. On March 5, 2020, the Planning and Development Services Director approved PDS
Order 2020-016, granting Minor Site Plan approval for the project known as Serenity at
the Preserve, creating parcels inconsistent with the lot size and dimensional standards of
the AG-5 Zoning District. This Development Order revokes that previous approval.
5. The Development Review Committee reviewed the proposed Site Plan for the project and
found it meets the technical requirements of the St. Lucie County Land Development
Code and has satisfied the standards of review set forth in Section 11.02.07, Standards
for Site Plan Review, of the St. Lucie County Land Development Code.
6. Planning staff performed a detailed analysis of the project and found it to be consistent
with the St. Lucie County Land Development Code and Comprehensive Plan. The
analysis can be found in the Planning and Development Services Department
memorandum titled Serenity at the Preserve - Minor Site Plan (MNSP-9201925603),
dated October 30, 2020.
7. All reasonable steps have been taken to minimize any adverse effects of the proposed
project on the immediate vicinity through building design, site design, landscaping, and

screening.

8. The proposed project will not have an undue adverse effect on adjacent property, the
character of the neighborhood, traffic conditions, parking, utility facilities, or other matters
affecting the public health, safety, and general welfare.
9. The applicant has applied for and received a Certificate of Capacity, a copy of which is
attached to this Order as Exhibit A, as required under Chapter V, St. Lucie County Land
Development Code.
NOW, THEREFORE, BE IT ORDERED BY THE PLANNING AND DEVELOPMENT SERVICES
DIRECTOR OF ST. LUCIE COUNTY, FLORIDA:
A. Pursuant to Section 11.02.03 of the St. Lucie County Land Development Code, the Minor
Site Plan to be known as Serenity at the Preserve is hereby approved as shown on the
Site Plan drawings prepared by Engineering Design & Construction, Inc., date-stamped
received by the St. Lucie County Planning and Development Services Department on
October 22, 2020, revised through October 21, 2020, and attached to this Order as
Exhibit B, for the property described in Part B below, subject to the following conditions:
1. Prior to issuance of a Vegetation Removal Permit or Exemption, the developer shall
provide an executed Conservation Easement for the remaining wetlands, along with
an approved Preserve Area Monitoring and Management Plan (PAMMP), with an
attached affidavit and cashier's check (payable to the Clerk of the Court for recording
fees) to the County Attorney. The applicant shall also provide a georeferenced GIS
shapefile or CAD file of the conservation easement boundaries to St. Lucie County.
2. Prior to issuance of a Vegetation Removal Permit or Exemption, listed species
surveys, including but not limited, to gopher tortoise surveys, crested caracaras, etc.,
may be required per State and/or Federal protocol. Should any listed species be
found the appropriate permits from State and Federal agencies shall be required.
3. Within ninety (90) day of issuance of a Vegetation Removal Permit or Exemption, all
Category I listed invasive plant species shall be eradicated from the site.
B. The property on which this Minor Site Plan approval is being granted, as depicted in the
location map attached as Exhibit C, is described as follows:
LEGAL DESCRIPTION
Being a Parcel of land lying in the North one-half (1/2) of Section 28, Township 36 South,
Range 38 East, St. Lucie County, Florida and being more particularly described as
follows:
Commence at the Northeast corner of said Section 28, being a 3" x 3" concrete
monument; thence, along the East line of said Section 28, South 00°22' 13" East, a
distance of 188.18 feet to the Point of Beginning; thence, continue along said East line,
South 00°22'13" East a distance of 2537.13 feet to the intersection with a line that is
25.00 feet south of, as measured perpendicularly to the East-West one-quarter (1/4)
Section line; thence, along said 25 foot offset line, North 89°57'35" West, a distance of
5209.06 feet to the East line of Carlton Road, a 100 foot Right of Way as shown on the
State of Florida State Road Department's Right of Way Map for SR 613, Section 94501-
2602 dated 8/1968; thence, along said East Right of Way, North 00°05'35" East, a
distance of 2490.02 feet to a point on said Right of Way line that is 188.19 feet South of,

as measured along said Right of Way, the North line of the aforesaid Section 28; thence,
along a line that is 188.18 feet South of, as measured perpendicularly to, the North line of
said Section 28, North 89°31'15" East, a distance of 5188.99 feet to the Point of
Beginning.
Containing 300.00 Acres more or less.

Location: On the east side of Carlton Road, Port St. Lucie, approximately three miles
south of Okeechobee Road and 1/z mile north of Carlton Road
C. The approvals granted by this Administrative Order shall expire after twenty-four (24) months
from the effective date unless a plat is recorded in public records or an extension is granted
in accordance with the provisions of Section 11.02.06 of the St. Lucie County Land
Development Code.
D. The developer, including any successors in interest, is advised as part of this Minor Site Plan
approval, the developer shall obtain all applicable development permits and construction
authorizations from the appropriate State, Federal, and Local regulatory agencies including,
but not limited to, the Federal Aviation Administration, Federal Communications Commission,
Florida Department of Environmental Protection, St. Lucie County Environmental Resources,
Public Works, and Building Departments prior to the commencement of any development
activities on the property described in Part B. Issuance of this approval by the County does
not in any way create any rights on the part of the developer to obtain a permit from a State
or Federal agency and does not create any liability on the part of the County for issuance of
this permit if the developer fails to obtain requisite approvals of fulfilling the obligations
imposed by a State or Federal agency or undertake actions that may result in a violation of
State or Federal law.
E. A copy of this Order shall be attached to the Site Plan drawings described in Part A, which
plan shall be placed on file with the St. Lucie County Planning and Development Services
Director and mailed to the developer and agent of record as identified on the Site Plan
applications.
F. The conditions set forth in Part A are an integral non-severable part of the Site Plan approval
granted by this Order. If any condition set forth in Part A is determined to be invalid or
unenforceable for any reason and the developer declines to comply voluntarily with that
condition, the site plan approval granted by this Order shall become null and void.
G. This Order shall be recorded in the Public Records of St. Lucie County.
