LUCIE COUNTY FOR A WAIVER FROM THE REQUIREMENTS OF SECTION 7.05.07 OF THE LAND DEVELOPMENT CODE REQUIRING PAVED ACCESS TO NEW DEVELOPMENTS WHEREAS, the Board of County Commissioners of St. Lucie County, Florida, based on the testimony and evidence, including but not limited to the staff report, has made the following determinations: 1. Mills, Short & Associates, submitted an application on behalf of the property owners of the proposed Carolyn Clark Subdivision, for a road paving waiver request from access to new development to be paved according to county specification for a proposed two (2) lot subdivision located at 14503 West Angle Road. 2- Robert L. Trenary, Sr. and Robert Trenary, Jr. desires to subdivide a 20.13-acre property into two (2) — 10-acre +/- parcels. A proposed Minor Site Plan and Plat, to subdivide the property, are being reviewed by Development Review Committee for compliance with the St. Lucie County Land Development Code. The property legally described in Paragraph "B" and depicted on the attached map as Exhibit "A". 3. On January 19, 2021, the Board held a public hearing on the petition, after publishing notice at least 10 days prior to the hearing and notifying by mail all owners of property within 500 feet of the subject property. 4. Staff has performed a detailed analysis of the waiver request and determined it to be consistent with the St. Lucie County Land Development Code and Comprehensive Plan. The analysis is found in the Public Works Memorandum titled Paving Waiver Request — Proposed Angle Road Plat, dated January 6, 2021. 5. Section 7.05.07.B.2 of the St. Lucie County Land Development Code provide that the Board of County Commissioners may consider the adoption of a road paving waiver. After reviewing the staff report and considering public comment at the public hearing, this Board granted the paving waiver subject to the following condition of approval: The current and future owners and their heirs/assigns agree to participate and shall be a "yes" vote in any lawfully established MSTU, MSBU or other special assessment district created for the purpose of providing paving and/or drainage improvements to West Angle Road. B. ADDRESS.: 14503 West Angle Road PARCEL ID No.: 2306-211-0002-000-7 C. The condition set forth in Paragraph 5 is an integral non -severable part of the paving Waiver within this Resolution. If any condition set forth in Paragraph 5 is determined to be invalid or unenforceable for any reason and the developer declines to comply voluntarily with the condition, this Resolution shall become null and void. D. A copy of this Order shall be placed on file with the St. Lucie County Planning and Development Services Department and mailed to the developer and agent of record as identified on the paving waiver application. E. This Resolution shall be recorded in the Public Records. F.
