HomeMy WebLinkAbout21-020RESOLUTION NO. 2021-20 A RESOLUTION AMENDING RESOLUTION NO. 2020- 289 WHICH APPROVING THE PETITIONS TO EXPAND THE BOUNDARIES OF THE ST. LUCIE COUNTY MOSQUITO CONTROL DISTRICT TO ADD CARLTON COUNTRY ESTATES TO CORRECT A SCRIVENER'S ERROR IN THE LEGAL DESCRIPTION; AND PROVIDING AN EFFECTIVE DATE WHEREAS, the St. Lucie County Mosquito Control District has made the following determinations: 1. Section 29, Chapter 87-510, Laws of Florida, establishes a procedure whereby the owners of property located outside of the boundaries of the District may petition the district to expand the boundaries of the District to include their property. 2. On December 15, 2020, the District held a public hearing to consider the petitions submitted by owners of lots within Carlton Country Estates, as recorded in Plat Book 46, Page 29 of the public records of St. Lucie County, Florida, to add the property to the District. 3. The subject property is contiguous to the existing boundaries of the District and would benefit from regular treatment for mosquitoes and sandflies by the District. 4. Following the conclusion of the public hearing, the District adopted Resolution No. 2020-289 which determined that it is in the best interest of the District and owners of the subject property to expand the boundaries of the District to add the property, approved the petitions, and waived the referendum requirement as the number of petitions represented a majority of the owners of the subject property. 5. The legal description within Resolution No. 2020-289 contained a scrivener's error. 6. The purpose of this resolution is to correct the above -referenced scrivener's error. NOW, THEREFORE, BE IT RESOLVED by the St. Lucie County Mosquito Control District: 1. Resolution No. 2020-289, which approved the petitions to expand the boundaries of the St. Lucie County Mosquito Control District to add Carlton Country Estates, is hereby amended to correct the scrivener's error in the legal description to read as follows: MICHELLE R. Except as amended herein, Resolution No. 2020-289 remains in full force and effect. 3. This resolution shall take effect on the date of adoption.
