LUCIE COUNTY BOARD OF COUNTY COMMISSIONERS URGING MEMBERS OF THE FLORIDA LEGISLATURE TO OPPOSE STATE LEGISLATION THAT WOULD PREEMPT COUNTY HOME RULE ABILITY TO ACT IN THE BEST INTEREST OF THE RESIDENTS OF THE COUNTY UNLESS EXPRESSLY AUTHORIZED BY THE LEGISLATURE; AND AUTHORIZES TRANSMISSION OF THE RESOLUTION TO THE ST. LUCIE COUNTY LEGISLATIVE DELEGATION, THE FLORIDA ASSOCIATION OF COUNTIES, AND OTHER INTERESTED PARTIES WHEREAS, the Board of County Commissioners of St. Lucie County, Florida, has made the following determinations: 1. In 1968, Florida voters amended the state constitution conferring broad Home Rule powers to counties and municipalities, authorizing local officials to pass local ordinances and exercise all powers not specifically prohibited by law. 2. Local governments are instrumental in improving the quality of life of its citizens and uses Home Rule authority to provide vital public services such as parks and recreation,water, sewer, electricity, streets and public rights-of-way, drainage and storm water management, and police and fire protection that are used and counted on by citizens, businesses, and visitors every day. 3. Home Rule powers, both administrative and fiscal, allow local governments to develop and implement community based solutions to local problems without state interference. 4. There are a significant number of legislative bills that have already been filed for the upcoming 2021 State of Florida Legislative Session that propose to preempt the Home Rule authority of local governments thereby preventing the ability of local governments to respond in a timely manner to matters of local importance. 5. St. Lucie County anticipates future legislative attempts to curtail, restrict and/or preempt it from its Home Rule authority. 6. it is imperative and critical that decisions and legislation regarding local government services be left to the form of government closest to the citizens NOW, THEREFORE, BE IT RESOLVED BY THE ST. LUCIE COUNTY BOARD OF COUNTY COMMISSIONERS that this Board request the members of the Florida Legislature to oppose state legislation that would preempt Home Rule authority of local governments. FURTHERMORE, the ST. LUCIE COUNTY BOARD OF COUNTY COMMISSIONERS directs the transmission of a certified copy of this Resolution to the St. Lucie County Legislative Delegation, the Florida Association of Counties, and other interested parties. Section 4. This resolution shall take effect on adoption.
