LUCIE COUNTY, FLORIDA WHEREAS, the Board of Adjustment of St. Lucie County, Florida, based on the testimony and evidence, including, but not limited to the staff report, has made the following determinations: 1. Petition of Mario Arbucci's request for a Variance from the minimum building setback requirements in the Watersong PUD for a proposed single-family residence to encroach 13 feet, respectively, into the required 40 foot rear yard setback measured from the 1978 Coastal Construction Control Line (CCCL) for the property located on South Hutchinson Island at 4800 Watersong Way, Fort Pierce. 2. On November 18, 2020, this Board held a public hearing on the petition, after publishing a notice of such hearing, installing a sign on the property, and notifying by mail all owners of property within 500 feet of the subject property. 3. The requested variance has not met the standards of review as set forth in Section 10.01.02, St. Lucie County Land Development Code and is in conflict with the goals, objectives, and policies of the St. Lucie County Comprehensive Plan, because: a) The granting of the requested variance would permit one property owner use of land, building(s), and structure(s) in a manner not otherwise permitted and that does not comply with the Watersong PUD Site Plan as approved by the Board of County Commissioners; b) The granting of the requested variance would impair or otherwise injure other property or improvements in the neighborhood in which the subject property is located; c) The granting of the requested variance is not necessary to make possible the reasonable use of the land, building or structure; and d) The granting of the variance will be opposed to the general spirit and intent of the Land Development Code and the Comprehensive Plan. NOW, THEREFORE, BE IT RESOLVED by the Board of Adjustment of St. Lucie County, Florida: A. The petition of Mario Arbucci for a variance from the minimum building setback requirements in the Watersong PUD for the property depicted on the attached site plan as Exhibit "A" and more specifically described as follows: November 18,2020 BOA Resolution No.2020-013 File No.BA 10202025867 Page 1 Leaal Description: BEING ALL OF LOT 31, ACCORDING TO THE PLAT OF WATERSONG P.U.D. THEREOF AS RECORDED IN PLAT BOOK 42, PAGE 34 A-D, PUBLIC RECORDS OF SAINT LUCIE COUNTY, FLORIDA. Address: 4800 Watersong Way, Fort Pierce, FL, 34949 Parcel Identification Number: 2532-500-0045-000-2 B. Based on the evidence presented, this variance is denied. C. This Order shall become effective upon the date indicated below. An appeal from the Board of Adjustment's action may be processed within thirty (30) days following the rendition of the decision of this order in accordance with Section 10.01.07, of the St. Lucie County Land Development Code. D. This Order shall be recorded in the public records of St. Lucie County.
