LUCIE COUNTY, FLORIDA WHEREAS, the St. Lucie County Planning and Development Services Director has reviewed the request for a Minor Adjustment to the Major Site Plan for the project known as Runway's End Commerce Center, the comments of the Development Review Committee, and has made the following determinations: 1. Nikolaus Schroth with SIB Runway's End, LLC, presented a petition for a Minor Adjustment to the Major Site Plan known as Runway's End Commerce Center, to reflect "As Built"conditions. The proposed revisions to the site include the relocation of three (3) cabbage palms, modification to the excess parking spaces to flex parking, loading, and temporary storage areas, the addition of a silo and CO2 titan tank, and reducing the required loading zone sizes. The applicant shall attain after-the-fact permit(s) for all construction performed without obtaining the required permit(s). 2. On June 15, 2004, the Board of County Commissioners approved Resolution 04-087, granting the construction of a 40,000 sf2 industrial flex space facility, to be known as Runway's End Commerce Center. o m 3 mXIj?- oaou?S 3. On January 14, 2016, the Board of County Commissioners approved Resolution 16-001, o o oini granting a Conditional Use Permit for a Waiver from the requirements of Section 7.10.11(A) N m of the Land Development Code authorizing the on-premises consumption of alcoholic D A 8 3 beverages in an establishment located within the distance separation requirements from a 8 N z religious facility. m N 4 n ram r 46 4. The Development Review Committee reviewed the proposed site plan for the project and -.4 o found it meets the technical requirements of the St. Lucie County Land Development Code g T and has satisfied the standards of review set forth in Section 11.02.07, Standards for Site 0 szig m Plan Review, of the St. Lucie County Land Development Code. o 0 23 c 5. Planning Staff has performed a detailed analysis of the project and determined it to be o consistent with the St. Lucie County Land Development Code and Comprehensive Plan. The analysis is located in the Planning and Development Services Department -4 memorandum titled Runway's End Commerce Center— Minor Adjustment to Major Site Plan (SPMn-1202125929), dated March 26, 2021. 6. The proposed project will not have an undue adverse effect on adjacent property, the character of the neighborhood, traffic conditions, parking, utility facilities, or other matters affecting the public health, safety, and general welfare. 7. All reasonable steps have been taken to minimize any adverse effects of the proposed SPMn-1202125929 PDS 2021-017 Page 1 of 5 project on the immediate vicinity through building design, site design, landscaping, and screening. NOW,THEREFORE, BE IT ORDERED BY THE PLANNING AND DEVELOPMENT SERVICES DIRECTOR OF ST. LUCIE COUNTY, FLORIDA: A. Pursuant to Section 11.02.04(C) of the St. Lucie County Land Development Code, the Minor Adjustment to the Major Site Plan is hereby approved as shown on the Site Plan drawings prepared by Velcon Engineering & Surveying, date stamped by the Planning & Development Services Department on January 15, 2021, subject to the following conditions: 1. Within 30 days of this approval, the applicant shall obtain after-the-fact permit(s) for all construction performed without obtaining the required permit(s). 2. Within 60 days of Minor Adjustment approval, three (3) native cabbage palms with a minimum 10 ft.clear trunk shall be planted onsite as mitigation required in associated with the After-the-Fact Permit 20210246. 3. Within 365 days of Minor Adjustment approval,the site shall come into compliance with the landscape plan dated August 19, 2003, including replacement of landscaping which has been removed or died since the original inspection. ERD shall be contact at (772) 462- 2526 for a final inspection once these deficiencies have been corrected. B. The property on which this Minor Adjustment to the Major Site Plan is being granted is described as follows: LEGAL DESCRIPTION: PARCEL 1: LOTS 1 THROUGH 9 INCLUSIVE AND LOTS 28 THROUGH 36 INCLUSIVE, BLOCK 64 AND THE EAST '/2 OF VACATED CUYAGA AVENUE, ADJACENT ON THE WEST OF LOTS 28 THROUGH 36, ALL IN SAN LUCIE PLAZA UNIT ONE, AS RECORDED IN PLAT BOOK 5, PAGE 57 OF THE PUBLIC RECORDS OF ST LUCIE COUNTY, FLORIDA. PARCEL 2: LOTS 10 THROUGH 18 INCLUSIVE IN BLOCK 65 AND THE WEST '/2 OF VACATED CUYAGA AVENUE, ADJACENT ON THE EAST, ALL IN SAN LUCIE PLAZA UNIT ONE, AS RECORDED IN PLAT BOOK 5, PAGE 57, OF THE PUBLIC RECORDS OF ST LUCIE COUNTY, FLORIDA. Parcel Identification Number: 1428-702-1492-000-4 Address(es): 3200 & 3250 St. Lucie Boulevard, Fort Pierce, FL, 34946 C. This Minor Adjustment to the Major Site Plan for Runway's End Commerce Center shall expire within twenty-four(24) months of the effective date of this Order, unless a building permit is issued or an extension is granted in accordance with Section 11.02.06, St. Lucie County Land Development Code. The developer is advised as part of this Minor Adjustment approval for STB Runway's End, LLC, including any successors in interest, the developer shall obtain all applicable development permits and construction authorizations from the appropriate State and Federal and local regulatory agencies including, but not limited to,the United States Army Corps of Engineers, the Florida Department of Environmental Protection,and South Florida Water Management District, and the St. Lucie County Environmental Resources Public Works and Building Departments prior to the commencement of any development activities on the property described in Part B. Issuance of this approval by the County does not in any way create any rights on the part of the developer to obtain a permit from a state or federal agency and does not create any liability on the part of the County for issuance of this permit if the developer fails to obtain requisite approvals or fulfill the obligations imposed by a state or federal agency or undertake actions that may result in a violation of state or federal law. E. A copy of this Order shall be attached to the Site Plan drawings described in Part A,which then shall be placed on file with the St. Lucie County Planning and Development Services Department and mailed to the developer and agent of record as identified on the Site Plan application. F. The conditions set forth in Part A are an integral non-severable part of the Site Plan approval granted by this Order. If any condition set forth in Section A is determined to be invalid or unenforceable for any reason and the developer declines to comply voluntarily with that condition,the site plan approval granted by this Order shall become null and void. G. A Certificate of Capacity Exemption, a copy of which is attached hereto as Exhibit B and made a part hereof the Order, was granted by the Planning and Development Services Department Director, which shall remain valid for the period of Site Plan approval.
