WHEREAS, Jennings Road is currently a two lane unimproved dirt
roadway that is classified as a 'Minor Collector" by the St. Lucie
County Board of County Commissioners, and for the purpose of level
of service determination is considered to be a Local City/County
Roadway, and has been determined to have a Level of Service "p"
capacity o£;3,200 vpd, based on its dirt condition; and,

WHERSAs, on May 4, 1994, "St. Lucie County" —an "Jennings" entered
into Road Impact Fee Credit Agreement IF 94-0 _far the eutn of one
hundred fifty three thousand, six hun re and eighty two 25/100
($153,682.25) dollars in consideration for the value of the ri.ght-
of-Way acquisitions described above; and,
WHEREAS, the Level of Service "D" capacity of a two lane Local.

the provieione of Section 1-17-33.1(c) of the St. Lucie County Code
and CompiIled laws, no Road Impact fee Credits can be granted that

$364,711.1

cost - of -providing -for the construction of Jennings Road are in
excess of the proportionate impacts of "Marketplace', for the
improvement of Jennings Road; and,

and ninety ($262,990) dollars under the criteria set forth in
Section 1-7-33.1.(c) of the Code and Compiled Laws of St. Lucie

Assignability of Credit.
"Marketplace" may assign all or part of the credit described
in Section 2-above-to its successors in title and interest.
Such assignment shall be by recordable written instrument.
Before the assignment is effective, a copy of the assignment
shall be provided by "Marketplace" to St. Lucie County and the
City`of Port St. Lucie, at the address set forth below and the
original assignment shall be recorded in the public records of
St. Lucie County:
