We will need to reference Building Code requirements(which cannot be waived at the local level) and Fire Code
requirements in the Order, as we will need to review these for any proposed location.

Leslie,
I found a section of the building code that would allow St James Academy to have classes in a church.The code section
below should be referenced in the emergency order. Maybe with the building code stating that it is allowable you might
not need an emergency order?
303.1.3 Associated with Group E occupancies.A room or space used for assembly purposes that is associated with
a Group E occupancy is not considered a separate occupancy.

AN ORDER OF THE ST. LUCIE COUNTY ADMINISTRATOR
REQUIRING SHORT TERM ACCOMMODATIONS FOR ST.JAMES ACADEMY
(HURRICANE IRMA)
WHEREAS,the St. Lucie County Administrator has made the following determinations:
1. Pursuant to Section 252.38, Florida Statutes, political subdivisions of the state
have the power during a state of local emergency to provide for the health and safety of
persons and property.
2. The Board of County Commissioners of St. Lucie County has adopted Resolution
No. 00-277 authorizing the St. Lucie County Administrator and the St. Lucie County Public Safety
Director to exercise certain emergency powers and authority during a local emergency.
3. The National Hurricane Center identified Hurricane Irma as a hurricane and
issued Hurricane Warnings for the east coast of Florida, including St. Lucie County.
4. The Governor of the State of Florida issued Executive Order 17-235 dated
September 4, 2017, declaring a state of emergency for the entire State of Florida; and
5. Executive Order 17-235, in accordance with Section 252.38, Florida Statutes,
authorizes political subdivisions to take whatever prudent action is necessary to ensure the
health, safety, and welfare of the community; and
6. The presence of Hurricane Irma placed St. Lucie County in a state of emergency,
exposing the citizens thereof to danger to life and property.
7. On September 7, 2017, at 6:00 p.m., the St. Lucie County Public Safety Director
declared a state of local emergency (copy attached).
8. In order to respond to such emergency, upon this declaration, the County
Administrator or his designee is authorized to initiate and take such actions authorized by
Resolution No. 00-277 (copy attached) for and on behalf of the Board of County Commissioners
during the term of such local state of emergency.
9. St. James Academy, a private school, is located in the Orange Blossom Mall,
which was severely damaged by flooding from Hurricane Irma. As a result St. James Academy is
unable to hold classes until repairs are completed at the Mall. Several local churches have
agreed to allow the Academy to temporarily hold classes at their facilities.
10. Section 303.1.3 of the Florida Building Code provides that a room or space used
for assembly purposes that is associated with Group E occupancy is not considered a separate
occupancy.
11. Based on the recommendation of the Planning and Development Services
Director, and to ensure the health, safety and welfare of the community there is a need to
temporarily allow St. James Academy to hold classes in churches located in the community until
repairs are completed at the Orange Blossom Mall.
NOW,THEREFORE, I am issuing the following Order:
1. Effective , 20 at +.m., the County's
Planning and Development Services Director is authorized to temporarily allow St. James
Academy to hold classes in churches located in the community.
2. This Order shall automatically terminate upon a declaration terminating the
state of local emergency or upon further Order of the County Administrator or the Board of
County Commissioners. This Order may be modified at any time by subsequent Order of the
County Administrator or the Board of County Commissioners. This Order may be extended in
not more than seven (7) day increments by subsequent Orders issued by the County
Administrator or the Board of County Commissioners.
3. This Order shall, as promptly as practicable, be filed in the office of the Clerk of
the Circuit Court.
