LUCIE COUNTY FOR AN AMENDMENT TO THE FINAL A. PLANNED NON-RESIDENTIAL DEVELOPMENT (PNRD) SITE °) m PLAN KNOWN AS TREASURE COAST RESEARCH, EDUCATION -, 0 AND DEVELOPMENT PARK (TCERDA) QUAD 1A ON +/-30.63 73 ACRES OF PROPERTY LOCATED AT THE NORTHWEST o 0 CORNER OF KINGS HIGHWAY AND PRUITT RESEARCH ROAD, FORT PIERCE, FLORIDA WHEREAS, the Board of County Commissioners of St. Lucie County, Florida, ba upon acceptable evidence, including but not limited to the staff report, has made following determinations: 1. St. Lucie County / Treasure Coast Education and Research Development Authority presented a petition for a Major Adjustment to the existing PNRD Final Site Plan known as TCERDA Quad 1A in the PNRD, (Planned Non-residential Development) Zoning District and TCERDA Overlay Zone for the property located at 7550 Pruitt Research Road, as legally described in Part "B" and depicted on the attached map as Exhibit "A". 2. The proposed Major Adjustment to the approved PNRD Final Site Plan for Quad 1A within the TCERDA Park to: 1) Expand allowable uses in accordance with Land Development Code (LDC) Section 4.03.02. - Research and Education Park Overlay Zone — Zone A, 2) Delineate Proposed Lot Boundaries 3) Adjust retention Pond Boundary 4) Allow future Lot Development to be eligible for Minor Site Plan, 5) Provide an internal street design within Quad 1A and 6) Update the Quad 1A Design Review Standards Manual. 3. The Development Review Committee has reviewed the proposed Major Adjustment and found it to be in substantial conformity with the approved Preliminary/Final Site Plan. 4. St. Lucie County Planning and Development Services staff has performed the required land use analysis for this application. 5. On June 1, 2021, this Board held a public hearing on the petition, after publishing a notice of such hearing and notifying by mail all owners of property within 500 feet of the subject property. 6. The Adjusted PNRD Final Site Plan, with the conditions therein, is consistent with the goals, objectives and policies of the St. Lucie County Comprehensive Plan Resolution No. 2021-140 Page 1 of 10 File No: SPMj-5202126048 and has satisfied the requirements of Section 11.07.03 of the St. Lucie County Land Development Code. 7. The proposed project, with conditions therein, will not have an undue adverse effect on adjacent property, the character of the neighborhood, traffic conditions, parking, utility facilities, or other matters affecting the public health, safety and general welfare. 8. The proposed project will be serviced by adequate public facilities and services. 9. A Certificate of Capacity, in accordance with Section 5.08.04, has been secured for the initial development phase. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of St. Lucie County, Florida: A. Pursuant to 11.02.05. B. of the St. Lucie County Land Development Code, the Adjusted Planned Non-Residential Development (PNRD) Final Site Plan for the project known as the TCERDA Quad 1A is hereby approved, for the subject property described in Part "B" below, as shown on the site plan drawings for the project prepared January 2020, and date stamped received by the St. Lucie County Planning & Development Services Department on February 20, 2020 subject to the following conditions: Planning Division — Planning & Development Services (PDS) Department 1. Prior to Plat recording, provisions to ensure long-term open space preservation shall be enacted for the Quad. 2. Development of future Lots shall require a Minor Site Plan, consistent with the Master PNRD Site Plan. Each application for development beyond the established Capacity Certificate (up to 76,000 sq. ft.) shall include a Traffic Impact Statement or Report, as necessary, to evaluate transportation capacity and required improvements. Environmental Resources Department 3. Prior to issuance of a Vegetation and Removal Permit or Exemption, the applicant shall finalize an improvement agreement or other similar financial agreement, acceptable to the Environmental Resources Department (ERD) covering the cost to purchase and install all required landscaping, irrigation, tree mitigation, tree relocation, and related improvements for the common open space, including the required littoral and upland buffer plantings for Quad 1 detailed in the approved landscape plan dated March 1, 2011. Prior to the release of an improvement agreement or other financial agreement, all landscaping requirements of the common open space, including the required littoral and upland buffer plantings of Quad 1 detailed on the approved landscape plan dated March 1, 2011, shall be installed and maintained in accordance with Land Development Code 7.09.00 by the established property owner's association (POA) in perpetuity. 5. Within sixty (60) days of issuance of a Vegetation Removal Permit or Exemption for each individual lot, all Category I listed invasive plant species shall be eradicated from the site in accordance with Land Development Code Section 7.09.05. B. The subject property is described as follows: LEGAL DESCRIPTION: QUAD 1A, TREASURE COAST RESEARCH AND EDUCATION PARK-CORE CAMPUS, ACCORDING TO THE PLAT THEREOF, AS RECORDED IN PLAT BOOK 68, PAGE 27 & 28, PUBLIC RECORDS OF ST, LUCIE COUNTY, FLORIDA. LOCATION: Northwest corner of Kings Highway and Pruitt Research Road. PARCEL I.D.: 2314-800-0001-000-3 C. The Adjusted PNRD Final Site Plan approval granted by this Resolution is vested through prior permit issuance and development. D. The developer is advised as part of this approval that the property owner(s), developer, etc. including any successors in interest, shall obtain all applicable development permits and construction authorizations from the appropriate State and Federal and local regulatory agencies including, but not limited to, the United States Army Corps of Engineers, the Florida Department of Environmental Protection, Florida Department of Transportation, South Florida Water Management District, and the St. Lucie County Environmental Resources, Public Works, and Building Departments prior to the commencement of any development activities on the property described in Part B. Issuance of this authorization or permit by the County does not in any way create any rights on the part of the developer to obtain a permit from a state or federal agency and does not create any liability on the part of the County for issuance of this permit if the developer fails to obtain requisite approvals or fulfill the obligations imposed by a state or federal agency or undertake actions that may result in a violation of state or federal law. E. The conditions set forth in Part "A" are an integral non-severable part of the site plan approval granted by this Resolution. If any condition set forth in Part "A" is determined to be invalid or unenforceable for any reason and the developer declines to comply voluntarily with that condition, the site plan approval granted Resolution No. 2021-140 Page 3 of 10 File No: SPMj-5202126048 by this resolution shall become null and void. F. A Certificate of Capacity for the first 76,000 sq. ft. of development, a copy of which is attached hereto as Exhibit "B" and made a part hereof the Resolution, was granted by the Planning & Development Services Department Director on January 4, 2011. G. A Concurrency Deferral Affidavit for further development phases, a copy which is attached to this Resolution as Exhibit "C", was signed by the applicant's designee on June 7, 2021. H. A list of eligible permitted and conditional uses for the TCERDA Quad 1A PNRD is attached to this Resolution as Exhibit "E", and may be expanded automatically by amendment to LDC Section 4.03.05. I. A copy of this Resolution shall be filed with the owner, St. Lucie County. J. This Resolution shall be recorded in the Public Records. K.
